Resolution No. 785311i RESOLUTION NO. 7853 2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF 3 VERNON AMENDING SECTION 23(e) AND SCHEDULE III (EXHIBIT "C") OF RESOLUTION NO. 7796 WHICH FIXED 4 THE COMPENSATION FOR CERTAIN EMPLOYEES AND 5 li AUTHORIZED CERTAIN EXPENSE ALLOWANCES 6 WHEREAS, on June 28, 2001, Resolution No. 7796 was adopted by 7 the City Council of the City of Vernon to be effective on July 1, 2001; MIMI 9II WHEREAS, on October 23, 2001, the Finance Committee 10 recommended that the City Council approve the recommendation of Bruce 11 V. Malkenhorst, Director of Finance, dated October 16, 2001, that an 12 automobile allowance be established for the position of Battalion Chief 13 11working as a Training Officer; and 14 WHEREAS, on September 5, 2001, the City Council of the City 15 of Vernon approved a Fifth Side -Letter Agreement with the Vernon Police 16 Officers' Benefit Association ("VPOBA") which, among other things, 17 provided for incentive increases for completion of Peace Officers' 18 Standard and Training ("POST") certificates; and 19 WHEREAS, on October 23, 2001, the Finance Committee 20 recommended that the City Council approve the recommendation of Bruce 21 IIV. Malkenhorst, Director of Finance, dated October 17, 2001, that 22 employees in police management positions (Lieutenants, Captain and 23 Chief) receive the same incentive pay increases for completion of their 24 POST certificates as that received by employees in the classifications 25.I1represented by the VPOBA in Group 2; and 2611 WHEREAS, the City Council of the City of Vernon wishes to 27 (i) amend Section 23(e) of Resolution 7796 to reflect the POST 28 incentive pay increases for police management employees and (ii) 1 amend Schedule III, Exhibit "C" of Resolution No. 7796 to establish an 2 automobile allowance for the position of Battalion Chief working as a 3 Training Officer. 4 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE 5 CITY OF VERNON AS FOLLOWS: 6 SECTION 1: The City Council of the City of Vernon hereby 7 finds and determines that the recitals contained hereinabove are true 8 and correct. 9 - SECTION 2: Effective November, 2001, Schedule III, Exhibit 10 "C" of Resolution No. 7796 is hereby amended to establish the 11 automobile allowance of the position of Battalion Chief in the Fire 12 Department working as a Training Officer, as indicated in Exhibit "A" 13 which is attached hereto and made a part hereof by this reference. 14 SECTION 3: Effective November 4, 2001, Subsection (e) of 15 Section 23, page 5, of Resolution No. 7796 is hereby modified to read 16 as follows: 17 (e) Payment of Incentive Compensation Peace Officers' 18 Standard Training Certificate 19 (1) Police Management Employees. 20 Police management employees (Police Chief, Police Captain and 21 Lieutenants) shall be eligible to receive peace officers' standard 22 training certificate incentive pay as follows: 23 a. POST Intermediate Certificate. 24 Three percent (3%) of the employee's base monthly salary, 25 excluding all other compensation, for the employee earning and 26 possessing a POST intermediate certificate. 27 b. POST Advanced Certificate. 28 Six percent (6%) of the employee's base monthly salary, 2 - 1 2 3 4 5 6 7 8' 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 excluding all other compensation, for the employee earning and possessing a POST advanced certificate. C. Incentive Compensation. Payment of the aforesaid incentive compensation shall not be cumulative and only the highest applicable incentive pay shall be paid. Incentive pay shall be payable the month following the month during which the certificate is received, or the month following completion of the employee's evaluation period, whichever is latest. (2) Group 2 Employees. Employees in the classifications represented by the Police Association in Group 2 who have completed their evaluation period shall be entitled to peace officers' standard and training certificate incentive pay as follows: a. POST Intermediate Certificate. Three percent (3%) of the employee's base monthly salary, excluding all other compensation, for the employees earning and possessing a POST intermediate certificate. b. POST Advanced Certificate. Six percent (6%) of the employee's base monthly salary, excluding all other compensation, for the employees earning and possessing a POST advanced certificate. C. Incentive Compensation. Payment of the aforesaid incentive compensation shall not be cumulative and only the highest applicable incentive pay shall be paid. Incentive pay shall be payable the month following the month during which the certificate is received, or the month following completion of the employee's evaluation period, whichever is latest. 3 - 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 SECTION 4: The provisions of Resolution Nos. 7796, 7819, 7826, 7828 and 7852 not consistent with or in conflict with this resolution are hereby repealed; in all other respects, Resolution No. 7796, as amended by Resolution Nos. 7819, 7826, 7828 and 7852 shall remain in full force and effect. SECTION 5: The City Clerk of the City of Vernon shall certify to the passage of this resolution, and thereupon and thereafter the same shall be in full force and effect. This allowance is for the use and maintenance of said motor vehicle. When authorized in advance by the Department Head, an employee using his/her personal car for City business will be reimbursed at thirty cents (.30c) per mile.
