A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF VERNON GRANTING A CONDITIONAL
USE PERMIT FOR UNITED PARCEL SERVICE,
INC. FOR THE OPERATION OF A TRUCKING
TERMINAL AT 2600 SOTO STREET
WHEREAS, United Parcel Service, Inc. ("UPS") has applied for a
conditional use permit to operate a truck terminal at 2600 South
Soto Street located in the City of Vernon; and
WHEREAS, the City Council of the City of Vernon held a hearing
on said application for a conditional use permit on December 13,
2001; and
WHEREAS, the proposed use is allowed in the M-2 Zone, Heavy
Industry with the approval of a conditional use permit; and
WHEREAS, the proposed site is approximately 2.00 acres in area,
and is adequate in size, shape and topography for the proposed
operation and has adequate drainage; and
WHEREAS, the proposed site is surrounded by industrial and
commercial uses compatible with the proposed use and no adverse
effects from traffic, parking, noise, odors, dust, smoke, light or
glare, or risk of fire, infection or explosion is anticipated from
the proposed operation; and
WHEREAS, the site has adequate on -site parking and loading
facilities in accordance with the Zoning Ordinance, therefore, does
not have an effect on off-street parking and loading facilities; and
WHEREAS, the City Council has received a Staff Report, dated on
November 5, 2001 upon which it has relied in making the foregoing
recitals; and
WHEREAS, the site has access to 26th Street and Soto Street, and

in general traffic will travel from the proposed site east on 26th
Street to their main facility at 3333 Downey Road. The streets to be
utilized within the City of Vernon are sufficient to handle the
traffic generated from the proposed operations; and
WHEREAS, the City Staff prepared a Staff Report, dated November
5, 2001, in which it finds, among other things, that the neighboring
facilities have similar uses that are compatible with United Parcel
Service proposed use, the number of traffic trips is consistent with
these sites, and the number of traffic trips generated by United
Parcel Service will not significantly impact the neighboring
facilities or public streets, ability to handle the traffic load
from the proposed operations; and
WHEREAS, the proposed use, as to location, operation and design
is consistent with the General Plan and Zoning ordinance of the City
of Vernon; and
WHEREAS, the project is categorically exempt from the
California Environmental Quality Act as an existing facility
pursuant to Section 15301 of the California Environmental Quality
Act Guidelines and Notice of Exemption shall be filed with the
County Clerk pursuant to Section 15062 of the California
Environmental Quality Act Guidelines; and
WHEREAS, the conditions imposed on the conditional use permit
as set forth heroin will adequately protect the public health,
safety and general warfare and the operation is consistent with all
applicable rules and laws of the City of Vernon; and
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF VERNON AS FOLLOWS:
SECTION 1: The City Council of the City of Vernon hereby finds

land determines that the recitals contained hereinabove are true and
Icorrect.
SECTION 2: Subject to the conditions set forth below, the
conditional use permit is hereby granted to United Parcel Service,
Inc. for the operation of a truck terminal and other transportation -
related uses at 2600 South Soto located in the City of Vernon.
SECTION 3: In order to adequately protect the public health and
general welfare the following conditions are required:
a. The facility shall be operated in accordance with, and made
to conform with all current codes, rules, and regulations and subject
to permit fees as adopted by the City of Vernon. All trucking
operations, including truck and trailer parking, shall be limited to
the lot located at 2600 Soto Street or within existing properties
currently occupied by United Parcel Service in the City of Vernon.
b. All required federal, state, local and regulatory agency
permits shall be obtained prior to operation. Prior to occupancy -a
business license and occupancy permit shall be obtained.
c. All parking and loading facilities shall be paved with a
hard durable surface material and shall be adequately drained, and
kept free of dust, mud, trash and weeds. Where parking or
maneuvering areas adjoin the public street a barrier wall or
landscaping shall be installed and maintained to meet City standards.
The wall or landscape strip shall be placed in accordance with the
City of Vernon setback requirements. Adequate on -site parking shall
be maintained so that off-street parking will not occur.

d. The facility shall be.operated in a manner that will prevent
unsanitary conditions, odors or other nuisances. The property shall
be provided with adequate refuse containers and refuse disposal
services.
e. The proposed site shall be structurally maintained to
exclude rodents and the property shall be maintained rodent free.
f. Servicing of vehicles including washing, steam cleaning and
repairing shall be performed in facilities in compliance with
appropriate codes.
g. No equipment or freight, or materials such as but not
limited to hazardous materials, hazardous waste, refuse, tires,
batteries or abandoned vehicles shall be stored on -site other than in
buildings, trailers or on the docks approved by the City of Vernon
for such use
h. A National Pollutant Discharge Elimination System Permit
shall be obtained from the California State Board of Water Resources,
if required.
i. Adequate plans and materials must be available for handling
leaks or spills from vehicles during storage or transportation.
j. A hazardous materials permit shall be obtained from the City
of Vernon Environmental Health Department if hazardous
materials/waste are used handled or stored. Hazardous
materials/waste shall be handled and managed in compliance with all
appropriate federal, state and local laws.
k. The facility shall be operated in a manner that will not
impede traffic on Soto Street and 26th Street.

1. All existing cracked sidewalk; curb and gutter adjacent to
the site in Soto Street or 26th Street shall be repaired and
(maintained to meet City Standards.
M. Within two years a permanent guard shack with restroom
►facilities shall be constructed at 2600 Soto Street. In the interim
UPS shall obtain a temporary trailer permit for the portable guard
shack. This temporary guard shack shall have restroom facilities.
n. The project site driveway on 26th Street shall be widened by
122 feet in the easterly direction for an overall driveway width of 50
Ifeet.
o. United Parcel Service shall either hire a license contractor
or pay the City to restripe 26th Street to install a two way left turn
median on 26th Street from 2600 Soto Street to approximately 200 feet
east of the subject site to the City standards. Existing striping
shall be removed to City's satisfaction.
p. A setback line shall be established in which no improvements
(shall be constructed within the northerly 15 feet of the subject
property. Additionally the setback shall be along a 50-foot property
line radius concave southeasterly tangent to the southerly line of
said 15-foot strip and the east line of Soto Street. The setback is
required for the future widening of 26th Street.
q. Truck volumes into and out of the 2600 Soto Street site
shall not exceed the volumes submitted in the UPS traffic report.
SECTION 4: United Parcel Service, Inc. and any successors in
interest shall indemnify, hold harmless, and defend the City of
Vernon, its officers, agents, and employees from and against any and
all claims, complaints, or petitions for: (1) damages, losses,
expanses resulting from bodily injury, sickness, disease, disability

or death arising from the operation of the facility excluding
therefrom any such claim resulting from the sole negligence or
intentional wrongdoing of the City of Vernon, its officers, agents
or employees; (2) a peremptory writ or other relief by way of
injunction, mandamus, or administrative mandamus; or (3) legal
expenses and attorney's fees incurred by the City of Vernon on
behalf of any party in such actions or proceedings. The City of
Vernon does not waive its right to participate in the defense of any
such action
SECTION 5: Not later than sixty (60) days from the date of this
Resolution, United Parcel Service, Inc. shall indicate, in writing,
its acceptance of and agreement with the conditions contained in
Section 3 of this Resolution and the indemnification provision
contained in Section 4 of the Resolution.
SECTION 6: The City Clerk of the City of Vernon shall certify
to the passage of this resolution and thereupon and thereafter the
same shall be in full force and effect.

Gentlemen:
United Parcel Service, Inc. has applied for a conditional use permit to operate a
truck terminal at 2600 South Soto Street.
Herewith for your consideration are the following supporting documents:
1. Staff Report.
2. Request for conditional use permit and information supporting the application.
3. Notice of Public Hearing, copies of notification letters to owners and tenants
in the area and affidavits of posting and mailing.
The project is categorically exempt from CEQA because it is an existing facility
as described in Section 15301.
Therefore, it is recommended that the City Council determine:
1. That the project is consistent with the General Plan as adopted by the City of
Vernon.
2. That the project will not have a significant effect on the environment.
3. That the project will not individually or cumulatively have an adverse effect
on wildlife resources.

Further, it is recommended that a Notice of Exemption be fled with the County

TO OPERATE A TRUCK TERMINAL
AT 2600 SOUTH SOTO STREET
November 5, 2001
United Parcel Service, Inc. (hereinafter referred to as
"UPS, Inc.") has submitted an application for a conditional use
permit, as required by the Comprehensive Zoning Ordinance Section
26.3.E-3(c) to operate a truck terminal and other transportation -
related uses at 2600 South Soto Street. UPS, Inc. is a shipping
company providing worldwide pick-up and delivery services of a
wide range of items. The facility's operating hours will be
twenty-four hours per day, seven days per week.
1. GENERAL PLAN The proposed use conforms to the
Comprehensive Zoning Ordinance and is in accordance with the
General Plan. The site is located in the M-2 Zone, Heavy
Industry. According to Section 26.3.6-1, the M-2 Zone is intended
to permit and encourage the development and preservation of these
industries whose operations are so large scale or specialized
that they may create heavy traffic or other external effects
receivable by surrounding uses. A truck terminal and other
transportation -related uses are allowed in this zone with a
conditional use permit.
2. SITE The proposed site is approximately 2.00 acres
in size, and is adequate in size, drainage, shape and topography
for the proposed operation. The proposed use is also the same as

the past use of this site. No potentially significant impacts are
expected to result from traffic, parking, noise, odor, dust,
smoke, light or glare, or risk of fire, infection or explosion
from the project. The project is categorically exempt under
Section 15301 of the California Environmental Quality Act because
it is an existing facility with no expansion of use. A Notice of
Exemption will be prepared.
3. ADVERSE EFFECT The proposed site is surrounded by
industrial and commercial uses compatible with the proposed use.
The proposed use is also the same as the past use of this site.
4. ACCESS The site has access to Soto Street and 26th
Street, which is 80 and 60 feet wide. The street is of adequate
size to handle the traffic generated from the proposed operation.
5. VEHICLE MOVEMENTS Traffic to and from the site will
primarily consist of UPS trailers that are 24 feet or 50 feet in
length. The trailers are unloaded at the railroad yard and will
then be transferred to the proposed site. From the railroad yard
drivers will exit on to 26th street and travel west to the
proposed site to deliver the trailers. From the UPS plant site at
3333 Downey Road, drivers will travel to the proposed site by
traveling west on 26th Street from the northerly side of the
Downey Road plant. The trailers will then be transported from
proposed site back to the Downey Road plant.(See Table 1-A gives
a 24-hour summary of the expected traffic)
6. OPERATIONS The proposed site will be used as a
staging area for UPS trailers. Trailers are delivered to the
Vernon area via rail and will be transported from the railroad
yard located on 26th Street to the proposed site by railroad
employees. Tractors will be dispatched from the UPS plant located
at 3333 Downey Road to return trailers from the proposed site to
the Downey Road plant.
The 2600 South Soto facility will be in operation 24 hours
per day, 7 days per week. There will be one (1) security guard on
duty at all times. There will be a proposed portable guard shack
at the gate located on 26th Street so that the gate can remain
open at all times. Trailers will be loaded with various kinds of
materials, including somehazardousmaterials. However, the
trailers will not be loaded or unloaded at the site. The site
will be provided with lighting. There is no expansion taking
place in the UPS operations. The only change to the operation is
the location of the trailer staging (which was previously located
at the railroad yard).
7. STATE OR FEDERAL CONDITIONS All Federal, State, and
local regulatory permits shall be obtained as required for the
operation.
8. CONDITIONS It is recommended that the following
conditions be set on the permit to adequately protect the public
interests:

The applicant is required to establish the following before submitting a conditional use permit
application:
A) The site for the proposed use is adequate in size, shape and topography, including drainage
and landscaping. The lot is of adequate size and shape for the proposed number of trucks
to utilize the site (see attached site plan). The topography, drainage, and landscaping are
all existing and the lot has previously supported trucking use.
B) The proposeduse will not have an adverse effect upon adjacent or abutting properties in
terms of traffic, parking noise, odors, dust, smoke, light or glare, or risk of fire, infection or
explosion. Since the site has previously been used for trucking, there will be no significant
adverse effects on the surrounding properties. Traffic, parking, and noise effects are
similar to the surrounding area. None of the other effects could be considered adverse.
Q The proposed use will be compatible with the permitted uses of surrounding and adjacent
properties. The proposed use is: compatible with the permitted uses since a trucking use is
permitted in the M-2 Zone with a conditional use permit.
D) The site has sufficient access to streets and highways, which are adequate in width and
pavement type to carry the quantity of traffic generated by the proposed use, and that the routes
which vehicles will have to follow to reach the site are adequate in width and pavement type to
carry the volume of traffic generated by the proposed use. The site access seems to be ideal
for this proposed use because of the proximity to the railroad and the UPS facility. The
traffic involved with this facility already makes the trip from the railroad yard to the UPS
facility. The proposed number of trailers on this site are less than the previous occupants.
E) The site has adequate off-street parking and loading facilities. Parking facilities are
provided as indicated on the site plan (attached) and will be limited to what the site can
accommodate.
F) The use, as to location, operation and design, is consistent with the general Plan, any
applicable specific plan and the zoning regulations of the City of Vernon and all applicable
County, State and federal law, rules and regulations. The use is consistent with the General
Plan since a trucking use is permitted in the M-2 Zone with a conditional use permit.

Environmental Setting
33. The project site has historically been used for trucking purposes. The site is
typical of Vernon, with level topography and stable soil. The site is paved and is
surrounded by a chain link fence. There are no plants or animals and there are
no cultural, historic or scenic aspects of the property. There are no existing
structures on the property.
34. The surrounding properties are also typical of Vernon and consist of industrial
and commercial uses. There is only minimal landscaping and no animals.
There are no cultural, historical or scenic aspects to the area.
Traffic Report
Traffic to and from the site will be UPS trailers that are 24 feet or 50 feet in
length. The trailers are unloaded at the railroad yard and will then be transferred
to the proposed site. The trailers will be delivered by railroad drivers that exit the
railroad yard on 2e Street and travel west to the proposed site. UPS drivers wiil
travel from the UPS plant located at 3333 Downey Road to the proposed site by
traveling north on Downey Road and then west on 26th Street. The trailers will
then be transported from the proposed site back to the Downey Road plant.
Table 1-A gives a 24-hour summary of the expected traffic.
Operations Report
The proposed site will be used as a staging area for UPS trailers. Trailers
are delivered to the Vernon area via rail and will be transported from the railroad
yard located on 261h Street to the proposed site by railroad employees. Tractors
will be dispatched from the UPS plant located at 3333 Downey Road to return
trailers at the proposed site to the Downey Road plant:
The proposed site will be in operation 24 hours per day, 7 days per week.
There will be one security guard on duty at all times. There will be a proposed'
guard shack at the gate located on 26t' Street so that the gate can remain open
at all times.
Trailers will be loaded with various kinds of materials, including some
hazardous materials (see Hazardous Materials Report). However, the trailers will
not be loaded or unloaded at the site. The site will be provided with night-time
lighting.
There is no expansion taking place in the UPS operations. The only
change to the operation is the location of trailer staging (which was previously
located at the railroad yard).
Hazardous Materials Report
There will be no hazardous materials being used, produced or processed
at the proposed site. There will, however, be some amounts of hazardous
materials within the UPS trailers. These materials will not be loaded or unloaded
at the site. All materials will remain within the trailers. A list of potential
hazardous materials that may be contained within the trailers is attached.'
Hazardous materials are not contained in all UPS shipments, however, they are
allowed as indicated by the attached list. While it is difficult to estimate the
maximum amount of hazardous materials that could be located on the proposed
sight, there will be no more than four containers in any one shipment. As stated,
these materials will remain in the trailers and will be untouched while at the
proposed site. These materials are currently being transported on Vernon
streets by the existing UPS operations.

SUBJECT: UNITED PARCEL SERVICE PARKING LOT TRAFFIC CONCERNS
United Parcel Service (UPS) is proposing to operate a truck terminal at the property
located at the southeast corner of 26h Street and Soto Street (2600 Soto Street). Attached
herewith is the project traffic volumes for the facility. The peak period for UPS truck
movements into the facility will occur in the early morning hours when approximately 15 trucks
will arrive and leave the site during both the 2:00 a.m. and 4:00 a.m. hours.
The following is a description of the truck movements as described by UPS
representatives: Piggyback trucks arrive at the B.N.S.F. railyard facility and are off loaded. A
tractor is dispatched from the UPS plant located at 3333 Downey Road to pick up the trailers.
The trailers are brought back to the 3333 Downey Road UPS plant for processing. After the
packages are sorted they are reloaded onto the trailers. Due to space limitations, a tractor will
take the full trailer westerly from the UPS facility to the 2600 Soto Street site. This sites'
primary access is off of 26' Street. Therefore, trucks will not have to travel through any
signalized intersections to access the sites. When the truck arrives at the site it will make a left
hand turn into the yard. The trailer will be parked and detached and only the tractor portion will
return to the 3333 Downey Road plant.
At a later time a tractor will again be dispatched from the 3333 Downey Road site to pick
up a trailer at the 2600 Soto Street site. After picking up the trailer it will long haul the trailer
outside of the City typically to points due east. Normally the truck will exit the site and travel
easterly on 2e Street to Bonnie Beach, then south on Bonnie Beach to Bandini Boulevard, then
east on Bandini Boulevard to the I-710. Occasionally a truck will take Soto Street north to the I
5, I-60 or I10. It should be noted that the number of trucks traveling to the freeway remain
unchanged since the project consists of only relocating the truck staging area from the railroad
yards to the 2600 Soto Street site.
The current A.M. peak hour for westbound 26t' Street traffic is the hour ending at 12:00
p.m. with a total vehicle count of 316. The P.M. peak hour is the hour ending at 12:15 p.m.
Therefore, the heaviest volumes for westbound 26"' Street is around the noon hour. Typically
highest traffic volumes for arterials are recorded in the 7:00-9:00 a.m. and 3:00-5:00 p.m. hours.
Unlike most streets, 26' Street has a relatively uniform flow during the daylight hours averaging
between 250 to 330 vehicles per hour between the hours of 7:15 a.m. to 5:30 p.m. with no major
peaking.
The intersection of 26`1 Street and Soto Street currently operates at a level of service F.
Total intersection delay time currently is 119.5 second. Traffic during the normal peak hour
(3:00 to 5:00 p.m) is rather mild on 26' Street when compared to northbound Soto Street. While
20b Street has a westbound traffic volume of 331, northbound traffic volume on Soto Street is
1376.
The City is currently in the process of studying both the 26" Street and Soto Street
corridors. Our initial findings indicate that the 26th Street corridor does not presently operate at
an acceptable level of service. The problem is not caused by the vehicle demand on 26t' Street,
but is primarily due to the delay at the Soto Street/26`'' Street intersection. Because of the
extreme delay in the northbound direction there is not enough room for all vehicles to turn on
Soto Street, therefore some vehicles are forced to wait until the next cycle, which deteriorates the
intersection and corridor level of service.
Currently Soto Street bottlenecks north of 26t'' Street causing traffic to back up to the 26`''
Street intersection causing delays. In order to alleviate backups a third lane in the northbound
direction is necessary. In order to accommodate the third lane railroad bridge will have to be
widened. Current estimates for the Soto Street and bridge widening are over forty million
dollars. Until this improvement is completed the Soto/26' Street intersection will continue to
suffer long delays. A third lane could be constructed between 26' Street and Washington
Boulevard at an estimated cost of $3.1 million. A possible interim solution to alleviate some of
the traffic delays to thru movements on 26"' Street is to construct a right turn pocket. Vehicles
could queue in the right turn pocket and not adversely effect the thru or left hand turn movements
on 26`" Street.
UPS trucks will enter the 2600 Soto site via a driveway on 26`h Street. Vehicles will not
travel thru the 26/Soto Street intersection therefore not increasing delays to the intersection
during the peak rush hour (3:00 to 5:00 p.m.). UPS estimates that a maximum of 8 trucks per
hour will enter and leave the site during this afternoon peak hour. Due to the close proximity of
the intersection with the driveway, trucks waiting to enter the site could effect thru movements
on 26 h Street. Currently the channelization of 26' Street at the driveway consists of a double
yellow line with one lane in each direction. Additionally as you travel west toward the
intersection a left turn pocket is added. In order to alleviate any impact to thru movements it is
recommendedthat a painted two way left turn center median be constructed at this location. The
median shall extend a minimum of 200 feet east of the UPS driveway. The trucks can store in
this median when accessing the site thereby not effecting thru movements. The existing roadway
has adequate width to accommodate the median. The street is currently zoned for no parking in
this area and therefore there will be no adverse impacts to neighboring properties by eliminating
on street parking.
Based on the above analysis it is recommended that the following three additional
conditions be placed on the United Parcel Service Conditional Use Permit.
o) United Parcel Service shall either hire a license contractor or pay the City to
restripe 26' Street to install a two way left turn median on 26' Street from 2600
Soto Street to approximately 200 feet east of the subject site to City standards.
Existing striping shall be removed to City's satisfaction.
p) A setback line shall be established in which no improvements shall be constructed
within the northerly 15 feet of the subject property. Additionally the setback shall
be along a 50-foot property line radius concave southeasterly tangent to the
southerly line of said 15-foot strip and the east line of Soto Street. The setback is
required for the future widening of 26" Street.
q) Truck volumes into and out of the 2600 Soto Street site shall not exceed the
volumes submitted in the UPS traffic report.
