RESOLUTION NO. 7886
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF VERNON ACCEPTING THE WORK OF LMT ENTERPRISES,
INC., DBA TYNER PAVING CONTRACTOR IN ACCORDANCE
WITH CONTRACT NO. 556 OF THE CITY OF VERNON
WHEREAS, LMT Enterprises, Inc. DBA Tyner Paving
Contractor was awarded Contract No. 556 for work on Paving of
Pipe Yard pursuant to Resolution No. 7769 of the City of Vernon;
and
WHEREAS, Samuel Kevin Wilson, Director of Community
Services and Water has reported to the City Council of the City
of Vernon on December 12, 2001 that said work has been completed
and recommends that the work be accepted and payment be made to
the Contractor in accordance with the agreement.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF VERNON AS FOLLOWS:
SECTION 1: The City Council of the City of Vernon
hereby finds and determines that the recitals contained
hereinabove are true and correct.
SECTION 2: The work of LMT Enterprises, Inc. DBA
Tyner Paving Contractor pursuant to Contract No. 556 is hereby
approved and accepted by the City Council of the City of Vernon.
SECTION 3: The total contract amount is Two
Hundred Seventy Nine Thousand Sixteen Dollars and seventy-two
cents ($279,016.72). Therefore, of the funds due to LMT
Enterprises, Inc. DBA Tyner Paving Contractor One Hundred Fifty
Nine Thousand Five Hundred Thirty Five Dollars and forty-four
cents ($159,535.44) is now due. The remaining ten percent (10%)
or the sum of Twenty Seven Thousand Nine Hundred One Dollars and
sixty-seven cents ($27,901.67) is payable thirty-five days after
the adoption of this resolution.
SECTION 4: The City Clerk of the City of Vernon
hereby directs payment of said sums as set forth to LMT
Enterprises, Inc. DBA Tyner Paving Contractor and instructs the
City Clerk to file a notice of completion with the County
Recorder.
SECTION'5: The City Clerk of the City of Vernon
shall certify to the passage of this resolution and thereupon
and thereafter the same shall be in full force and effect.
