A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
VERNON ADOPTING A JURY DUTY POLICY AND REPEALING
RESOLUTION NO. 4021
WHEREAS, on December 1, 1970, the City Council of the City of
Vernon adopted Resolution No. 4021 which determined that City employees
would not be compensated for jury duty because Vernon was a small City
with a limited number of employees who were unable to serve extended
periods of time as a juror without reducing essential public services,
thereby endangering the safety and well-being of the residents of the
City of Vernon; and
WHEREAS, Los Angeles Superior Court Rule No. 861 implements
Government Code § 68550 which intends to make jury service more
convenient by shortening the time a person would be required to serve
to one day or one trial; and
WHEREAS, by letter dated December 13, 2001, Bruce V.
Malkenhorst, City Administrator/City Clerk, recommended the adoption
of a jury duty policy; and
WHEREAS, the City Council of the City of Vernon recognizes
that the court system no longer recognizes financial hardship as an
excuse for dismissal from jury duty.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF VERNON AS FOLLOWS:
SECTION 1: The City Council of the City of Vernon hereby
finds and determines that the recitals contained hereinabove are true
and correct.
SECTION 2: The City Council of the City of Vernon hereby

adopts the Jury Duty Policy, a copy of which is attached hereto as
Exhibit "A" and made a part hereof.
SECTION 3: This Resolution shall take effect immediately and
shall remain in full force and effect unless repealed by action of the
City Council of the City of Vernon.
SECTION 4: Resolution No. 4021 is specifically repealed, and
all resolutions or minute orders in conflict with this resolution are
hereby repealed.
SECTION 5: The City Clerk of the City of Vernon shall
certify to the passage of this resolution, and thereupon and
thereafter the same shall be in full force and effect.

CITY OF VERNON
JURY DUTY POLICY
(December 19, 2001)
I. STATEMENT OF POLICY
This Policy shall exclude police and fire personnel because they are needed for the protection
of the public health and safety, and it is not feasible to make alternative arrangements to relieve
the person of those responsibilities during the period of service as a juror without substantially
reducing essential public services.
II. DEFINITIONS
A. "Jury my Pay" - means the juror expenses of per diem fees and mileage paid to
jurors in the superior and municipal courts, in civil and criminal cases, authorized by
Section 215 of the California Code of Civil Procedure. The fees at the current time are
fifteen dollars ($15) a day for each day's attendance as a juror after the first day and
reimbursement for mileage at the rate of fifteen cents ($0.15) per mile for each mile
actually traveled to the court house, one way, when attending court as a juror, from the
first day of service.
B. "Regular Pay" - means compensation in accordance with the formula adopted in the
current City of Vernon Salary Resolution which provides a monthly amount for each
position and each step in each City department.
C. "Salary Resolution" - means the resolution adopted every fiscal year and any
amendments thereto fixing the compensation of certain employees.
D. "Perfect Attendance" - means the Perfect Attendance Incentive Program established by
resolution and any amendments thereto.
E. "Vacation" - means vacation policies for employees of the City of Vernon established
in the current vacation resolution and any amendments thereto.
III. WORK SCHEDULE WHILE SERVING ON JURY DUTY
A. An employee must immediately notify his or her supervisor upon receipt of a jury duty
summons.
B. An employee who is called for jury duty shall come to work before and after appearing
in court in order to be paid by the City for the day and shall also be required to submit proof of
jury duty attendance.
C. An employee will receive only Jury Duty Pay for the day(s) he or she attends if they do
not report to work during the same day he or she is to appear in court.
D. Employees will be required to return to work, if regularly scheduled to work, as soon
as they are released from their jury duty.
IV. VACATION AND PERFECT ATTENDANCE
A. The City of Vernon will not require employees who are called for jury duty to schedule
vacation time when summoned to appear in court.
B. An employee's absence due to jury duty shall not affect the employee's Perfect
Attendance.
V. COMPENSATION
The City of Vernon will ONLY compensate those employees called for jury duty for the days
he or she appears in court pursuant to Section III. B. , based upon the following formula:
Regular Pay for the day less any Jury Duty Pay received.

Gentlemen:
Effective immediately the following applies to employees who are
called for Jury Duty:
• Do not need to schedule vacation time when summoned to
appear before court,
• Will be allowed to come to work before or after appearing in
court, depending on the time summoned by the court,
• The employee will be paid Jury Duty Pay for the days he/she
attends.
The following formula will be used when calculating an employee's
salary pay while in Jury Duty:
• Regular Pay for the Day - Jury Duty Pay
Jury Duty Pay, as authorized by Section 215(a) of the California
Code of Civil Procedure, trial jurors are currently reimbursed 15
cents per mile, one way, on the first day of service. The second
day of service and after, Juror pay is $15.00 per day plus mileage
of 15 cents per mile per day, one way.
Furthermore, this type of absences will not affect the employee's
perfect attendance.

RESOLUTION NO. 4021
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON, DETER-
MINING THAT SALARIES OR WAGES OF CITY EMPLOYEES SHALL NOT BE
PAID DURING THE TIME AN EMPLOYEE IS SERVING AS A JUROR.
THE CITY COUNCIL OF THE CITY OF VERNON RESOLVES AS FOLLOWS:
WHEREAS, the City Council of the City of Vernon feels
that it is a citizens highest duty to serve as a juror in either
the federal or state courts when called upon, and
WHEREAS, the City Council of the City of Vernon feels
that serving as a juror should not work a hardship on either
the prospective juror or others within his community, and
WHEREAS, the City of Vernon is a small City with a
limited number of employees, all of whom perform important
governmental tasks necessary to the safety and well-being of
the residents and occupants of the City of Vernon, and
WHEREAS, experience has shown that a person summoned
to jury duty is often absent from his employment for an extended
period of time, resulting iri the curtailment or limitation of the
activities which were formerly performed by said employee, or
working a hardship on co -employees of the City of Vernon,
NOW, THEREFORE, BE IT RESOLVED:
SECTION 1: That the City Council of the City of Vernon
determines that an employee absent for service in a federal or
state jury shall forego his salary or wages during the period he
is unable to attend to municipal functions.
SECTION 2: The City Clerk of the City of Vernon shall
certify to the passage of this resolution, and thereupon and
thereafter the same shall be in full force and effect.
ADOPTED and APPROVED this lst day of December, 1970.
