Resolution No. 79011 RESOLUTION NO. 7901 2 3 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON AMENDING RESOLUTION NO. 6944 PERTAINING TO 4 VEHICLE RELEASE FEES FOR VEHICLES IMPOUNDED BY THE 5 CITY OF VERNON 6 7 WHEREAS, on April 22, 1997, the City Council of the City of 8 Vernon adopted Resolution No. 6944 approving the implementation of a g Vehicle Release Fee Program for vehicles impounded by the City of 10 Vernon: and 11 WHEREAS, on October 5, 2001, the Governor signed Assembly 12 Bill 783, which provided for changes in the law regulating the release 13 of impounded vehicles to be effective as of January 1,-2002; and 14 WHEREAS, by letter dated January 17, 2002, Bruce V. 15 Malkenhorst, City Administrator/City Clerk, recommended that 16 Resolution No. 6944 be amended to implement the new State regulations. 17 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE 18 CITY OF VERNON AS FOLLOWS: 19 SECTION 1: The City Council of the City of Vernon hereby 20 finds and determines that the recitals contained hereinabove are true 21 and correct. 22 SECTION 2: The City Council of the City of Vernon hereby 23 approves and adopts the revised Vehicle Release Fee Program, a copy of 24 Which is attached hereto as Exhibit "A" and made a part hereof. 25 26 27 28 / / / SECTION 3: The City Clerk of the City of Vernon shall certify to the passage of this resolution, and thereupon and thereafter the same shall be in full force and effect. Subject to Section B, the following fees shall be collected prior to the release of any vehicle properly impounded by or at the request of the Vernon Police Department: 1. For release of any vehicle impounded as a result of an arrest for driving under the influence of an alcoholic beverage, drug, or any illegal substance $23.0.00 2. For release of any other vehicle properly impounded under the provisions of the California Vehicle Code: $100.00 B. The fees established in Section A shall not be collected from a legal owner, or his agent, who is a motor vehicle dealer, bank, credit union, acceptance corporation, or other licensed financial institution legally operating in this state or is another person, not the registered owner, holding a security interest in the vehicle, unless such legal owner voluntarily requests a poststorage hearing. C. No personal checks will be accepted in payment of any such fee. D. The vehicle shall be released only to the registered owner. E. The fee shall be waived for any vehicle reported stolen prior to its impoundment or on other verifiable proof of theft. F. The fee may be waived by the Chief of Police for any vehicle impounded for any other cause if the vehicle or its driver were not cited for a traffic or other violation.
