FOR THE OPERATION OF A TRUCKING TERMINAL AT 4528 BANDINI BOULEVARD WHEREAS, Austin Trucking, Inc. has applied for a conditional use permit to operate a truck terminal at 4528 Bandini Boulevard located in the City of Vernon; and WHEREAS, the City Council of the City of Vernon held a hearing on said application for a conditional use permit on'February 27, 2002; and WHEREAS, the proposed use is allowed in the M-2 Zone, Heavy Industry with the approval of a conditional use permit; and WHEREAS, the proposed site is approximately 42,720 square feet, and is adequate in size, shape and topography for the proposed operation and has adequate drainage; and WHEREAS, the proposed site is surrounded by industrial and commercial uses compatible with the proposed use and no adverse effects from traffic, parking, noise, odors, dust, smoke, light or glare, or risk of fire, infection or explosion is anticipated from the proposed operation; and WHEREAS, the site has adequate on -site parking and loading facilities in accordance with the Zoning Ordinance, therefore, does not have an effect on off-street parking and loading facilities; and WHEREAS, the site has access to Bandini Boulevard, and in general traffic will travel from the proposed site east on Bandini Boulevard to the Bulk Mail Center facility. The streets to be utilized within the City of Vernon are sufficient to handle the -1- 1 traffic generated from the proposed operations; and 2 WHEREAS, the neighboring facilities have.similar uses that are 3 compatible with Austin Trucking proposed use, the number of traffic 4 trips is consistent with these sites, and the number of traffic 5 trips generated by Austin Trucking will not significantly impact the 6 neighboring facilities or public streets' ability to handle the 7 traffic load from the proposed operations; and 8 WHEREAS, the proposed use, as to location, operation and design 9 is consistent with the General Plan and Zoning Ordinance of the City 10 of Vernon; and 11 WHEREAS, the Community Services Department has performed an 12 Initial Study dated January 24, 2002, to determine whether the 13 proposed project will have adverse impacts on the environment and has 14 determined that the proposed project will not have a significant 15 adverse effect on the environment, and the Director of Community 16 Services & Water has recommended that a Negative Declaration be 17 adopted in compliance with the California Environmental Quality Act; 18 and 19 WHEREAS, the conditions imposed on the conditional use permit 20 as set forth heroin will adequately protect the public health, 21 safety and general warfare and the operation is consistent with all 22 applicable rules and laws of the City of Vernon; and 23 WHEREAS, the City Council has received a Staff Report, dated on 24 January 31, 2002 upon which it has relied in making the foregoing 25 recitals; and 26 27 28 -2- p 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY �IOF VERNON AS FOLLOWS: SECTION 1: The City Council of the City of Vernon hereby finds land determines that the recitals contained hereinabove are true and Ilcorrect. SECTION 2: Subject to the conditions set forth below, the conditional use permit is hereby granted to Austin Trucking, Inc. for the operation of a truck terminal and other transportation - related uses at 4528 Bandini Boulevard located in the City of Vernon. SECTION 3: In order to adequately protect the public health and general welfare the following conditions are required: a. The facility shall be operated in accordance with, and made to conform with all current codes, rules, and regulations and subject to permit fees as adopted by the City of Vernon. All trucking operations, including tractor parking, shall be limited to the lot located at 4528 Bandini Boulevard in the City of Vernon. b. All required federal, state, local and regulatory agency permits shall be obtained prior to operation. Prior to occupancy a business license and occupancy permit shall be obtained. c. All parking and loading facilities shall be paved with a hard durable surface material and shall be adequately drained, and kept free of dust, mud, trash and weeds. Where parking or maneuvering areas adjoin the public street a barrier wall or landscaping shall be installed and maintained to meet City standards. The wall or landscape strip shall be placed in accordance with the City of Vernon setback requirements. The facility shall be operated in a manner that will prevent unsanitary conditions, odors or other nuisances. The property shall be provided with adequate refuse containers and refuse disposal services. e. The proposed site shall be structurally maintained to exclude rodents and the property shall be maintained rodent free. f. Servicing of vehicles including washing, steam cleaning and repairing shall be performed in facilities in compliance with appropriate codes. g. No equipment or freight, or materials such as, but not limited to, hazardous materials, hazardous waste, refuse, tires, batteries or abandoned vehicles shall be stored on -site other than in buildings, trailers or on the docks approved by the City of Vernon for such use. h. A National Pollutant Discharge Elimination System Permit shall be obtained from the California State Board of Water Resources, if required. i. A hazardous materials permit shall be obtained from the City of Vernon Environmental Health Department if hazardous materials/waste are used handled or stored. Hazardous materials/waste shall be handled and managed in compliance with all appropriate federal, state and local laws. j. The facility shall be operated in a manner that will not impede traffic on Bandini Boulevard. k. All existing cracked sidewalk; curb and gutter adjacent to the site in Bandini Boulevard shall be repaired and maintained to meet City Standards. -4- 1 FA 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 ME SECTION 4: Austin Trucking, Inc. and any successors in interest shall indemnify, hold harmless, and defend.the City of Vernon, its officers, agents, and employees from and against any and all claims, complaints, or petitions for: (1) damages, losses, expanses resulting from bodily injury, sickness, disease, disability or death arising from the operation of the facility excluding therefrom any such claim resulting from the sole negligence or intentional wrongdoing of the City of Vernon, its officers, agents or employees; (2) a peremptory writ or other relief by way of injunction, mandamus, or administrative mandamus; or (3) legal expenses and attorney's fees incurred by the City of Vernon on behalf of any party in such actions or proceedings. The City of Vernon does not waive its right to participate in the defense of any such action SECTION 5: Not later than sixty (60) days from the date of this Resolution, Austin Trucking, Inc. shall indicate, in writing, its acceptance of and agreement with the conditions contained in Section 3 of this Resolution and the indemnification provision contained in (Section 4 of the Resolution. SECTION 6: The City Clerk of the City of Vernon shall certify to the passage of this resolution and thereupon and thereafter the same shall be in full force and effect. CONDITIONAL USE PERMIT TO OPERATE A TRUCK TERMINAL AT 4528 BANDINI BOULEVARD January 31, 2002 Austin Trucking, Inc. has submitted an application for a conditional use permit, as required by the Comprehensive Zoning Ordinance Section 26.3.E-3(c) to operate a truck terminal and other transportation -related uses at 4528 Bandini Boulevard. Austin Trucking, Inc. is a United States Postal transportation company, which provides pick-up and delivery services of a wide range of items. The facility's operating hours will be twenty- four hours a day, seven days a week. 1. GENERAL PLAN The proposed use conforms to the Comprehensive Zoning Ordinance and is in accordance with the General Plan. The site is located in the M-2 Zone, Heavy Industry. According to Section 26.3.6-1, the M-2 Zone is intended to permit and encourage the development and preservation of these industries whose operations are so large scale or specialized that they may create heavy traffic or other external effects receivable by surrounding uses. A truck terminal and other transportation -related uses are allowed in this zone with a conditional use permit. 2. SITE The proposed site that the applicant will occupy is approximately 42,720 square feet. The applicant has not proposed any changes to the size, shape or topography of the -1- v existing site. The site plans for the proposed operation indicates the site is adequate in size, shape, topography, including drainage and landscaping. 3. ADVERSE EFFECT The proposed site is surrounded by industrial and commercial uses compatible with the proposed use. No adverse impacts from traffic, parking, noise, odor, dust, smoke, light or glare, or risk of fire, infection or explosion are expected to occur to the adjacent of abutting properties. It is recommended that a Negative Declaration be adopted for the project. 4. ACCESS The site has access to Bandini Boulevard, which is 100 feet wide. The street is of adequate size to handle the traffic generated from the proposed operation. 5. VEHICLE MOVEMENTS Traffic to and from the site will primarily stem from the movements of nine tractors. These tractors will be dispatched at different times throughout the day. The tractors will exit the facility on the northerly side of the property located at 4528 Bandini Boulevard. The tractors will then travel east to the Bulk Mail Center ("BMC"), which will then pick-up an assigned United States Postal trailer and deliver the trailer to its scheduled destination. The proposed site has ample room to provide adequate off-street parking and loading facilities. 6. OPERATIONS The proposed site will be used as a staging area for tractors only. These tractors will be used to -2- transport United States Postal trailers to various BMC locations such as (Los Angeles, Bakersfield, Amtrak station, Texas). The tractors will be dispatched at different times throughout the day. The first tractor is scheduled to leave at 9:00 a.m. to the BMC, while other tractors depart at scheduled time thereafter. After tractors arrive at their destination they will drop off their trailers. The tractors will then return to the proposed site and wait to be dispatched again. The 4528 Bandini Boulevard facility will be in operation 24 hours a day, 5 days a week. There will be one (1) dispatcher/coordinator on duty at all times; so that the gate can remain open at all times. The site will be provided with lighting. 7. STATE OR FEDERAL CONDITIONS All Federal, State, and local regulatory permits shall be obtained as required for the operation. 8. The entire property is completely fenced in and having only one entrance and exit. The property is completely paved with black top and cement. In the front of the property facing Bandini Blvd there are plants and some weeds on both sides of the drive way entry. The building will be used specifically for office use and the rear property will be used to park minimum of 9 tractor and 4R�s and a maximum of 12 on certain holidays. There are no wildlife, cultural, historical scenic aspects. The soil and or foundation appear to be stable and there is no evidence of any toxic contamination. The project is consistent with the City of Vernon Comprehensive Zoning Ordinance and the City of Vernon General Plan as adopted by the City of Vernon. Therefore, it is recommended that the City Council determine: 1. That the project is consistent with the General Plan as adopted by the City of Vernon. 2. That the project will not individually or cumulatively have an adverse effect on wildlife resources. Further, it is recommended that the conditional use permit be granted subject to the following conditions: a. The facility shall be operated in accordance with, and made to conform with all current codes, rules and regulations and subject to permit fees as adopted by the City of Vernon. All trucking operations, including tractor parking, shall be limited to the lot located at 4528 Bandini Boulevard in the City of Vernon. b. All required federal, state, local and regulatory agency permits shall be obtained prior to operation. Prior to occupancy, a business license and occupancy permit shall be obtained. C. All parking and loading facilities shall be paved with a hard durable surface material and shall be adequately drained, and kept free of dust, mud, trash and weeds. Where parking or maneuvering areas adjoin the public street a barrier wall or landscaping shall be installed and maintained to meet City standards. The wall or landscape strip shall be placed in accordance with the City of Vernon setback requirements. Adequate on - site parking shall be maintained so that off-street parking will not occur. d. The facility shall be operated in a manner that will prevent unsanitary conditions, odors or other nuisances. The property shall be provided with adequate refuse containers and refuse disposal services. e. The proposed site shall be structurally maintained to exclude rodents and the property shall be maintained rodent free. f. Servicing of vehicles including washing, steam cleaning and repairing shall be performed in facilities in compliance with appropriate codes. g. No equipment, freight or materials such as but not limited to hazardous materials, hazardous waste, refuse, tires, batteries or abandoned vehicles shall be stored on -site other than in buildings, trailers or on the docks approved by the City of Vernon for such use. h. A National Pollutant Discharge Elimination System Permit shall be obtained from the California State Board of Water Resources, if required. i. A hazardous material permit shall be obtained from the City of Vernon Environmental Health Department if hazardous materials/waste are used handled or stored. The facility shall be operated in a manner that will not impede traffic on Bandini Boulevard. k. An initial study was preformed as part of this project, which studied the affects of water quality impact. Alteration of surface water quality is unlikely. All businesses will be required to obtain a National Pollution Discharge Elimination System (NPDES) permit, if required. There are no surface water bodies within the vicinity of the project. No changes in water currents or water movements will occur. There will be no impacts on the direction or rate of flow of groundwater and no impact on its quality. The City of Vernon is the primary water service provider in Vernon. Therefore, there will be no substantial increase in public water demand and no reduction in the demand for groundwater. V AIR QUALITY: Would the proposal: a) Violate any air quality standard or contribute to an existing or projected air quality violation? ❑ ❑ X ❑ ME a. The City of Vernon is located within the South Coast Air Basin of California. The basin covers a 6,600- square mile area within Orange County, non -desert portions of Los Angeles County, Riverside County, and San Bernardino County. Air quality in the basin is monitored by the South Coast Air Quality Management District (SCAQMD) at 35 monitoring stations throughout the area. The monitoring station nearest to the City of Vernon is the Pico Rivera station. Readings at the station are used to characterize air quality in the City of Vernon. , b) Expose sensitive receptors to pollutants? ❑ ❑ ❑ X b. The project as proposed will not cause an impact to these sensitive receptors. c) Alter air movement, moisture, or temperature, or cause any change in climate? ❑ ❑ ❑ X c. The proposed project will create no unusual conditions which could alter air movement, moisture, temperature, or climate. d) Create objectionable odors? ❑ ❑ ❑ X d. The proposed project will not create objectionable odors. Therefore, there will be no significant environmental impact. VI. TRANSPORTATION/CIRCULATION. To the north is the Santa Ana (I-5), Santa Monica (I-10) and the Hollywood (I-101) freeways, to the west is the Harbor Freeway (I-110), and to the east is the Long Beach Freeway (I-710). City of Vernon has several arterials, which bisect the City. The streets surrounding the proposed use are adequate in width and are improved as necessary to carry the traffic expected by this proposed use. Bandini Boulevard, an arterial roadway, serves the subject site witha right-of-way of 100 feet. Therefore, there will be no impact on transportation during operation due to increased traffic trips. b) Hazards to safety from design features (e.g. sharp curves or dangerous intersections) or incompatible uses (e.g. farm equipment)? ❑ ❑ ❑ X b. The proposed site is located in an existing industrial area, and the project is compatible with surrounding uses. No safety hazard resulting from incompatible uses are expected. c) Inadequate emergency access or access to nearby uses? ❑ ❑ ❑ X c. The proposed site will include emergency access and access to nearby uses, as required by the City. d) Insufficient parking capacity on -site or off -site? ❑ ❑ ❑ X d. According to the Comprehensive Zoning Ordinance the proposed site will exceed the parking requirements defined in the zoning code. In response to their letter the staff has prepared the following responses. • The anticipated construction -related traffic emissions at the proposed site is forecast to be small because of the small construction work due the size of building and minor work proposed to the site. The work proposed is limited to minor remodeling of the 1,200 square foot office structure. Therefore, there will be no significant impacts in fugitive emissions on -site or by equipment being used. • The anticipated operational emissions from the operation are expected to decrease significantly due to the truck terminal facility being moved from the City of Whittier to the City of Vernon. The number of trucks being utilized in the operation is not increasing. This change in location will provide easier access to the 710, 5, 110, 101 and 60 Fwy, which tractors will spent most of their time on the road. This change in location will also change their operational commute. The tractors traveled from the Whittier facility to the U.S. postal center located in the City of Bell, which is approximately a twenty- (20) mile commute to pick-up their trailers. This relocation to Vernon will reduce their commute by more then half the distance previously mentioned. The relocation will also reduce f the miles traveled by the tractors, thereby reducing operational emissions in the air basin.
