Resolution No. 7925• ,1 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 7925 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON REQUESTING AN ALLOCATION AND PAYMENT OF COUNTY AID TO CITIES FUND FOR THE RESURFACING OF SOTO STREET FROM THE LOS ANGELES RIVER TO THE NORTHERN CITY BOUNDARY WHEREAS, the County of Los Angeles has appropriated certain monies to the City of Vernon as County Aid to Cities; and WHEREAS, the Los Angeles County Board of Supervisors has adopted policies limiting the use of said monies to regional traffic signal synchronization projects, transportation system management (TSM), and congestion management (CM) projects that improve regional traffic mobility; or the design, acquisition of right of way, and construction of city streets on the County's highway plan which are of general County interest and regional significance; and WHEREAS, the City's proposed resurfacing of Soto Street from the Los Angeles River to the northern City boundary (26th Street to Bandini Boulevard) is a project meeting the criteria set forth by the Board of Supervisors for the use of Aid to Cities Funds pursuant to a County of Los Angeles Department of Public Works letter dated June 27, 2001; and WHEREAS, the Director of Community Services has recommended that the City Council find that this project is categorically exempt under Section 15301 of the California Environmental Quality Act (Class 1 (c)) because the project is maintenance to existing streets; and WHEREAS, by letter dated February 28, 2002, Bruce V. Malkenhorst, City Administrator/City Clerk, has recommended that the City prepare a resolution requesting the allocation and payment of Aid 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 to Cities Funds for the proposed project; and WHEREAS, the City Council desires to expend the amount of Thirty Thousand Six Hundred Forty -Five Dollars and No Cents ($30,645.00) of said funds accrued to the City for projects in accordance with said policies. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF VERNON AS FOLLOWS: SECTION 1: The City Council of the City of Vernon hereby finds and determines that the recitals contained hereinabove are true land correct. SECTION 2: The City Council of the City of Vernon hereby finds that the project is categorically exempt from the requirement for an Environmental Impact Report pursuant to Section 15301, Class 1 (c), of the California Environmental Quality Act Guidelines and a Notice of Exemption shall be filed with the County Clerk pursuant to Section 15062 of the California Environmental Quality Act Guidelines. SECTION 3: The City Council of the City of Vernon hereby requests the County of Los Angeles to allocate Thirty Thousand Six Hundred Forty -Five Dollars and No Cents ($30,645.00) of the Aid to Cities Funds apportioned to the City for the project specified above which will improve regional traffic mobility in accordance with the Los Angeles County Board of Supervisors policy regarding the use of said Aid to Cities Funds. SECTION 4: After the allocation is approved by the Board of Supervisors and funds are available, the City Council of the City of Vernon hereby requests that the County of Los Angeles send such allocated amount to the City when claimed. These funds are granted by the County of Los Angeles Public Works to be utilized on street improvement projects that are within the County's Highway plan. Last year, the Community Services and Water Department nominated "Soto Street" to be resurfaced from 26th Street to Bandini Boulevard. Pursuant to the California Environmental Quality Act, Section 15301, maintenance to existing streets is exempt; therefore, per section 15062 of the same code, a Notice of Exemption will be prepared and filed with the County Clerk. The nomination has been approved by the County and it is hereby recommended that a resolution be approved and adopted for the allocation of the ATC funds to be utilized toward the costs of the resurface of Soto Street. We are required to pass a resolution by the City Council for the allocation of the fund for the proposed project and forward it to the County for their execution. Also, it is recommended that the City Council find that the project is categorically exempt from the California Environmental Quality Act because the project is maintenance to existing streets and is exempt per Section 15301. A Notice of Exemption will be prepared and filed with the County Clerk pursuant to Section 15062 of the California Environmental Quality Act Guidelines. In my opinion the project will pose no adverse effects to the City of Vernon and will have no significant effects on the environment.
