A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
3 VERNON AUTHORIZING THE CITY CLERK TO MAKE AND
DELIVER A CERTIFICATE OF ELECTION TO COUNCIL
4 MEMBERS LEONIS C. MALBURG, THOMAS A. YBARRA AND
WILLIAM MCCORMICK AND TO ADMINISTER THE OATH OF
5 OFFICE

7 WHEREAS, the City Council of the City of Vernon by
8 Resolution No. 7902 on February 6, 2002, appointed Leonis C. Malburg,
9 Thomas A. Ybarra and William McCormick members of the City Council to
10 serve a term of four (4) years pursuant to Section 2.90 of the Vernon
11 City Code and Elections Code Section 10229; and
12 WHEREAS, the General Municipal Election scheduled for
13 April 9, 2002, was thereafter cancelled because only one person filed
14 nomination papers for each office; and
15 WHEREAS, Section 10229 of the Elections Code provides, in
16 part, as follows:
17 "The person appointed, if any, shall qualify and
18 take office and serve exactly as if elected at a
19 municipal election for the office;" and
20 WHEREAS, Section 3.4 of the Vernon City Charter requires the
21 City Council to canvass the returns of an election on the first Tuesday
22 following a City Council election or such other date within fifteen
23 (15) days of the election as may be provided by ordinance; and
24 WHEREAS, Section 3.4 also states that the term of each
25 elected councilmember shall begin at the hour of the completion of the
26 canvas of the election returns; and
27 WHEREAS, on April 3, 2002, the City Council of the City of
28 Vernon adopted Ordinance 1084 which established the third Wednesday
1 following an election as the date to canvass returns and install
2 appointed councilmembers; and
3 WHEREAS, Section 10265 of the Elections Code requires that
4 the City Clerk sign and deliver a Certificate of Election to each person
5 elected and administer the oath of office.
6 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
7 CITY OF VERNON AS FOLLOWS:
8 SECTION 1: The City Clerk shall immediately make and
9 deliver to Leonis C. Malburg, Thomas A. Ybarra and William McCormick a
10 Certificate of Election signed by the City Clerk and duly
11 authenticated.
12 SECTION 2: The City Clerk shall administer to Leonis C.
13 Malburg, Thomas A. Ybarra and William McCormick the oath of office
14 prescribed in the State Constitution of the State of California and
15 shall have them subscribe thereto and file the same in the office of
16 the City Clerk, whereupon, Mr. Malburg, Mr. Ybarra and Mr. McCormick
17 shall be inducted into the respective office to which they have been
18 elected.
19 SECTION 3: The City Clerk of the City of Vernon shall
20 certify to the passage of this resolution, and thereupon and
21 thereafter the same shall be in full force and effect.
22 APPROVED AND ADOPTED this 17th day of April, 2002.
