A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
VERNON APPROVING AND RATIFYING THE EXECUTION OF AN
APPLICATION FOR FEDERAL ASSISTANCE TO FIREFIGHTERS
GRANT FROM THE FEDERAL EMERGENCY MANAGEMENT AGENCY
WHEREAS, the Federal Emergency Management Agency ("FEMA") has'I
established a 2002 Assistance to Firefighters Grant Program in an
effort to help the nation's fire service community by providing vital
funds to local fire departments across the country to enhance the
abilities of fire departments to protect the health and safety of the
public and their firefighting personnel; and
WHEREAS, the competitive grant program is divided into four
program areas, to wit: Fire Operations and Firefighter Safety, Fire
Prevention, Emergency Medical Services and Firefighting Vehicle
JAcquisition; and
WHEREAS, the Fire Department has determined the need for two
(2) Thermal Imaging Cameras with associated equipment for the Urban
Search and Rescue (USAR) and Hazmat programs as a way of improving the
use of technology and making fire ground operations safer and more
Jefficient; and
WHEREAS, in order to receive the 2002 Assistance to
Firefighters Grant, FEMA required the Application for Federal
Assistance to be submitted prior to April 5, 2002, and through FEMA's
on-line application system the Fire Chief electronically executed and
submitted the Application subject to ratification by the City Council;

on or about April 3, 2002 (confirmed as Application No. 13942) for

(funds in the amount of Twenty -Five Thousand Five Hundred Dollars and No
Cents ($25,500.00), with the City's share being Two Thousand Five
Hundred Fifty Dollars and No Cents ($2,550.00) and FEMA's share being
Twenty -Two Thousand Nine Hundred Fifty Dollars and No Cents
($22,950.00); and
WHEREAS, by letter dated April 11, 2002, Bruce V.
Malkenhorst, City Administrator/City Clerk, recommended that the
electronic execution and submittal of the Application for Federal
Assistance be ratified; and
WHEREAS, the City Council desires to approve and ratify the
Application for Federal Assistance as executed by the Fire Chief.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF VERNON AS FOLLOWS:
SECTION 1: The City Council of the City of Vernon hereby
finds and determines that the recitals contained hereinabove are true
and correct.
SECTION 2: The City Council of the City of Vernon hereby
approves, authorizes and ratifies the submittal to FEMA of a 2002
Assistance to Firefighters Grant Application for Federal Assistance in
the amount of Twenty -Five Thousand Five Hundred Dollars and No Cents
($25,500.00), a copy of which is attached hereto as Exhibit "A" and
made a part hereof.
SECTION 3: The City Council of the City of Vernon hereby
ratifies the execution of the Application by the Fire Chief on behalf
of the City of Vernon and hereby authorizes the City Administrator, or
his designee, to execute any and all documents necessary for the
purpose of securing grant funds and to implement and carry out the
purposes specified in the Grant Application for, and on behalf of, the

SECTION 4: The City Clerk of the City of Vernon shall

Please provide your narrative statement in the space provided below:
Project
The purpose for this grant proposal is to provide Thermal Imaging Technology for the USAR and Hazmat
Programs offered by the Vernon Fire Department. We are dedicated to providing all facets of service to our
business community. Both programs have been implemented and are providing the city with response
capabilities.
Use:
One way to enhance both programs would be to receive grant funds for a Thermal Imaging Camera and the
associated video monitoring equipment. This equipment would improve both programs, decreasing safety
concerns and increasing effectiveness.
Benefit:
The hazardous materials team will benefit by using this equipment in a variety of ways, such as, identifying liquid
levels in tanks and seeing thermal radiation invisible to the eye. In addition, the video monitor can transmit the
same image back to the Command Post. The USAR Team is assigned as our Rapid Intervention Crew during
structure fires. This equipment will assist in finding lost or trapped fire personnel.
Both the USAR Team and the HazMat Team are dedicated to Vernon. As well, each team provides Mutual Aid
to the surrounding Cities of Downey, Montebello, Compton and Santa Fe Springs (Area E). All of these cities are
part of our mutual aid program. The Vernon Fire Department HAZMAT Team is considered a first response unit
for these cities.
Funding
Although the Vernon Fire Department has an equipment budget, the funds available are being used to maintain
suppression equipment and current equipment needs for the Hazmat and USAR teams. Staffing levels also
impact the current budget. For these reasons, we are seeking the funds through the Fire Grant Act.
Additional Info. :
The City of Vernon is located 4 miles South East of the L.A. Civic center. Vernon covers 5.06 square miles and
is home to over 1400 businesses. Vernon has -one elementary school and approximately 100 people call Vernon
home. Our working day population swells to 45,000, with Farmer John Meat packing being one of the largest
employers. The Vernon Fire Department uses 4 stations and 80 uniformed personnel to handle nearly 1800
emergency responses each year. Collectively, the Vernon Fire department is working hard towards minimizing
fire loss and continuing to increase the services we provide. This grant will help us achieve these goals.

7. Will comply, or has already complied, with the requirements of Tdles II and III of the Uniform
Relocation Assistance and Real Property Acquisition Policies Act of 1970 (P.L. 91-646)
which provide fair and equitable treatment of persons displaced whose property is acquired
as a result of Federal federally assisted programs. These requirements apply to all interests
in real property acquired for project purposes regardless of Federal participation in

'8. Will comply with the provisions of the Hatch Act (5 U.S.C. Sections 1501-1508 and 7324-

9. Will comply, as applicable, with the provisions of Davis -Bacon Act (40 U.S.C. Section 276a to
276a-7), Copeland Act (40 U.S.C. Section 276c and 18 U.S.C. Sections 874), and the

523); and (h) protection of endangered species under the Endangered Special Act of 1973,
as amended, (P.L. 93-205).
12. Will comply with the Wild and Scenic Rivers Act of 1968 (16 U.S.C. Section 1271 et seq.)
related to protecting components or potential components of the national wild and scenic
rivers system.
13. Will assist the awarding agency in assuring compliance with Section 106 of the National
Historic Preservation Act of 1966, as amended (16 U.S.C. 470), EO 11593 (identification
protection of historic properties), and Archaeological and Historic Preservation Act of 1974
(16 U.S.C. 469a-1 et seq.)
14. Will comply with P.L. 93-348 regarding protection of human subjects involved in research,
development, and related activities supported by this award of assistance.
15. Will comply with the Laboratory Animal Welfare Act of 1966 (P.L. 89-544, as amended, 7
U.S.C. 2131 et seq.) pertaining to the care, handling and treatment of warm blooded animals
held for research, teaching, or other activities supported by this award of assistance.
16. Will comply with the Lead -Based Paint Poisoning Prevention Act (42 U.S.C. -Section 4801 et
seq.) which prohibits the use of lead based paint in construction or rehabilitation of residence
structures.
17. Will cause to be performed the required financial and compliance audits in accordance with
the Single Audit Act of 1984.
18. Will comply with all applicable requirements of all other Federal laws, executive orders,
regulations and policies governing this program.
19. It will comply with the rpinimum wage and maximum hours provisions of the Federal fair
Labor Standards Act (29 U.S.0 201), as they apply to employees of institutions of higher
education, hospitals, and other non-profit organizations.

(a) No federal appropriated funds have been paid or will be paid by or on behalf of the undersigned
to any person for influencing or attempting to influence an officer or employee of any agency, a
Member of Congress, an officer or employee of congress, or an employee of a Member of
Congress in connection with the making of any federal grant, the entering into of any cooperative
agreement and extension, continuation, renewal amendment or modification of any Federal Grant
or cooperative agreement.
(b) If any other funds than Federal appropriated funds have been paid or will be paid to any person
for influencing or attempting to influence an officer or employee of any agency, a Member of
Congress, an officer or employee of congress, or an employee of a Member of Congress in
connection with this Federal grant or cooperative agreement, the undersigned shall complete and
submit Standard Form LLL, "Disclosure of Lobbying Activities", in accordance with its
instructions.This form must be attached to certification if nonappropriated funds are to be used to
influence activities.
(c) The undersigned shall require that the language of this certification be included in the award
documents for all the subawards at all tiers (including subgrants, contracts under grants and

2. Debarment, Suspension and Other Responsibility Matters (Direct Recipient)
As required by Executive Order 12549, Debarment and Suspension, and implemented at 44CFR Part 67, for
prospective participants in primary covered transactions, as defined at 44 CFR Part 17, Section 17.510-A, the
applicant certifies that it and its principals:
(a) Are not presently debarred, suspended, proposed for debarment, declared ineligible, sentenced
to a denial of Federal benefits by a State or Federal court, or voluntarily excluded from covered
transactions by any Federal department or agency.
(b) Have not within a three-year period preceding this application been convicted of or had a
civilian judgment rendered against them for commission of fraud or a criminal offense in
connection with obtaining, attempting to obtain or perform a public (Federal, State, or local)
transaction or contract under a public transaction; violation of Federal or State antitrust statutes or
commission of embezzlement, theft, forgery, bribery, falsification or destruction of records, making
false statements, or receiving stolen property.
(c) Are not presently indicted for or otherwise criminally or civilly charged by a government entity
(Federal, State, or local) with commission of any of the offenses enumerated in paragraph (1)(b) of
this certification: and
(d) have not within a three-year period preceding this application had one or more public

3. Drug -Free Workplace (Grantees other than individuals)
As required by the Drug -Free Workplace Act of 1988, and implemented at 44CFR Part 17, Subpart F, for
grantees, as defined at 44 CFR part 17, Sections 17.615 and 17.620:

(A) The applicant certifies that it will continue to provide a drug -free workplace by:
(a) Publishing a statement notifying employees that the unlawful manufacture,
distribution, dispensing, possession, or use of a controlled substance is prohibited in
the grantee's workplace and specifying the actions that will be taken against
employees for violation of such prohibition;
(b) Establishing an on -going drug free awareness program to inform employees
about:
(1) The dangers of drug abuse in the workplace;
(2) The grantees policy of maintaining a drug -free workplace;
(3) Any available drug counseling, rehabilitation and employee
assistance programs; and
(4) The penalties that may be imposed upon employees for drug abuse
violations occurring in the workplace;
(c) Making it a requirement that each employee to be engaged in the performance of
the grant to be given a copy of the statement required by paragraph (a);
(d) Notifying the employee in the statement required by paragraph (a) that, as a
condition of employment under the grant, the employee will:
(1) Abide by the terms of the statement and
(2) Notify the employee in writing of his or her conviction for a violation
of a criminal drug statute occurring in the workplace no later than five
calendar days after such conviction.
(e) Notifying the agency, in writing within 10 calendar days after receiving notice
under subparagraph (d)(2) from an employee or otherwise receiving actual notice of
such conviction. Employers of convicted employees must provide notice, including
position title, to the applicable FEMA awarding office, i.e. regional office or FEMA
office.

Grant Requirements
Those applicants who are awarded a grant must satisfy both legal and regulatory requirements of the
Assistance to Firefighters Grant Program. Some of the major requirements are:
1. Grantees must share in the cost of the grant activities. When a fire department submits their program
narrative and budget information, the total project cost should include the federal portion and the fire
department's match. The required match percentage is based on the population served. The matching
requirement for a fire department whose population is less than 50,000 is 10 percent. The matching
requirement for a fire department whose population served is 50,000 or more is 30 percent. You should
provide adequate information on the source of the matching funds and the match must be a cash match.
2. Grantees must report to an incident reporting system either through their State or at the Federal level
through the United States Fire Administration's National Fire Incident Reporting System (NFIRS) during the
grant period. If you already report to USFA or to the State, that is sufficient. If you do not report to USFA or
the State, you must start as soon as possible and report for a period of 12 months. USFA staff can assist
you if you are awarded a grant and have questions about NFIRS.
3. Grantees must agree to maintain expenditures at the average of their departments' expenditures in the
awarded grant program activity areas from the previous two years. Maintaining operating expenditures
refers to the fact that these funds are meant to be a supplement to existing funds not a replacement of
funds in the departments' current budgets. Therefore, on top of the federal grant (if selected) and the
matching funds, grantees must maintain the average of the last two years' spending levels on items for
which the grantees receive a grant during the grant period of performance. For example: Your department
wins a grant that includes a Wellness and Fitness Program. You want your firefighters to get the complete
physical instead of the rudimentary physical you normally provide. For the year of the grant, you have to pay
what you normally would pay for your physicals first. Then, the grant funds can be used to cover the extra.
Another example would be that your department received a training grant and your department usually
spends $5,000 a year on training. The grant can be used to cover training expenses over that $5,000.
4. Grant recipients must maintain their grant files and supporting documents for three years after the closure
of their grant.
5. All grantees must follow the audit requirements of OMB Circular A-133, Audits of States, Local
Government, and Non -Profit Organizations. The main requirement of this OMB Circular is that grantees
who expend $300,000 or more in Federal funds (from all Federal sources) must have a single audit or
independent audit performed in accordance with the circular.

Project
The purpose for this grant proposal is to provide Thermal Imaging Technology for the USAR and Hazmat
Programs offered by the Vernon Fire Department. We are dedicated to providing all facets of service to our
business community. Both programs have been implemented and are providing the city with response
capabilities.
Use:
One way to enhance both programs would be to receive grant funds for a Thermal Imaging Camera and the
associated video monitoring equipment. This equipment would improve both programs, decreasing safety
concerns and increasing effectiveness.
Benefit:
The hazardous materials team will benefit by using this equipment in a variety of ways, such as, identifying
liquid levels in tanks and seeing thermal radiation invisible to the eye. In addition, the video monitor can
transmit the same image back to the Command Post. The USAR Team is assigned as our Rapid Intervention
Crew during structure fires. This equipment will assist in finding lost or trapped fire personnel.
Both the USAR Team and the Hazmat Team are dedicated to Vernon. As well, each team provides Mutual
Aid to the surrounding Cities of Downey, Montebello, Compton and Santa Fe Springs (Area E). All of these
cities are part of our mutual aid program. The Vernon Fire Department HAZMAT Team is considered a first
response unit for these cities.
Funding
Although the Vernon Fire Department has an equipment budget, the funds available are being used to
maintain suppression equipment and current equipment needs for the Hazmat and USAR teams. Staffing
levels also impact the current budget. For these reasons, we are seeking the funds through the Fire Grant
Act.
Additional Info. :
The City of Vernon is located 4 miles South East of the L.A. Civic center. Vernon covers 5.06 square miles
and is home to over 1400 businesses. Vernon has one elementary school and approximately 100 people call
Vernon home. Our working day population swells to 45,000, with Farmer John Meat packing being one of the
largest employers. The Vernon Fire Department uses 4 stations and 80 uniformed personnel to handle nearly
1800 emergency responses each year. Collectively, the Vernon Fire department is working hard towards
minimizing fire loss and continuing to increase the services we provide. This grant will help us achieve these
goals.

cooperative agreement and extension, continuation, renewal amendment or modification of any
Federal Grant or cooperative agreement.
(b) If any other funds than Federal appropriated funds have been paid or will be paid to any
person for influencing or attempting to influence an officer or employee of any agency, a
Member of Congress, an officer or employee of congress, or an employee of a Member of
Congress in connection with this Federal grant or cooperative agreement, the undersigned shall
complete and submit Standard Form LLL, "Disclosure of Lobbying Activities", in accordance
with its instructions.This form must be attached to certification if nonappropriated funds are to
be used to influence activities.
(c) The undersigned shall require that the language of this certification be included in the award
documents for all the subawards at all tiers (including subgrants, contracts under grants and
cooperative agreements and subcontract(s)) and that all subrecipients shall certify and disclose
accordingly.
2. Debarment, Suspension and Other Responsibility Matters (Direct Recipient)
As required by Executive Order 12549, Debarment and Suspension, and implemented at 44CFR Part 67, for
prospective participants in primary covered transactions, as defined at 44 CFR Part 17, Section 17.510-A, the
applicant certifies that it and its principals:
(a) Are not presently debarred, suspended, proposed for debarment, declared ineligible,
sentenced to a denial of Federal benefits by a State or Federal court, or voluntarily excluded
from covered transactions by any Federal department or agency.
(b) Have not within a three-year period preceding this application been convicted of or had a
civilian judgment rendered against them for commission of fraud or a criminal offense in
connection with obtaining, attempting to obtain or perform a public (Federal, State, or local)
transaction or contract under a public transaction; violation of Federal or State antitrust statutes
or commission of embezzlement, theft, forgery, bribery, falsification or destruction of records,
making false statements, or receiving stolen property.
(c) Are not presently indicted for or otherwise criminally or civilly charged by a government entity
(Federal, State, or local) with commission of any of the offenses enumerated in paragraph (1)(b)
of this certification: and
(d) have not within a three-year period preceding this application had one or more public
transactions (Federal, State, or local) terminated for cause or default; and
B. Where the applicant is unable to certify to any of the statements in this certification, he or she shall attach
an explanation to this application.
3. Drug -Free Workplace (Grantees other than individuals)
As required by the Drug -Free Workplace Act of 1988, and implemented at 44CFR Part 17, Subpart F, for
grantees, as defined at 44 CFR part 17, Sections 17.615 and 17.620:
(A) The applicant certifies that it will continue to provide a drug -free workplace by:
(a) Publishing a statement notifying employees that the unlawful manufacture,
distribution, dispensing, possession, or use of a controlled substance is prohibited
in the grantee's workplace and specifying the actions that will be taken against
employees for violation of such prohibition;

(b) Establishing an on -going drug free awareness program to inform employees
about:
(1) The dangers of drug abuse in the workplace;
(2) The grantees policy of maintaining a drug -free workplace;
(3) Any available drug counseling, rehabilitation and employee
assistance programs; and
(4) The penalties that may be imposed upon employees for drug
abuse violations occurring in the workplace;
(c) Making it a requirement that each employee to be engaged in the performance
of the grant to be given a copy of the statement required by paragraph (a);
(d) Notifying the employee in the statement required by paragraph (a) that, as a
condition of employment under the grant, the employee will:
(1) Abide by the terms of the statement and
(2) Notify the employee in writing of his or her conviction for a
violation of a criminal drug statute occurring in the workplace no later
than five calendar days after such conviction.
(e) Notifying the agency, in writing within 10 calendar days after receiving notice
under subparagraph (d)(2) from an employee or otherwise receiving actual notice
of such conviction. Employers of convicted employees must provide notice,
including position title, to the applicable FEMA awarding office, i.e. regional office
or FEMA office.
(f) Taking one of the following actions, against such an employee, within 30
calendar days of receiving notice under subparagraph (d)(2), with respect to any
employee who is so convicted:
(1) Taking appropriate personnel action against such an employee,
up to and including termination, consistent with the requirements of
the Rehabilitation Act of 1973, as amended; or
(2) Requiring such employee to participate satisfactorily in a drug
abuse assistance or rehabilitation program approved for such
purposes by a Federal, State, or local health, law enforcement or
other appropriate agency.
(g) Making a good faith effort to continue to maintain a drug free workplace
through implementation of paragraphs (a), (b), (c), (d), (e), and (f).
(8) The grantee may insert in the space provided below the site(s) for the performance of work
done in connection with the specific grant:

Section 17.630 of the regulations provide that a grantee that is a State may elect to make one certification in

records, they must be able to somehow view and print what was actually submitted or otherwise 1 don't see how they

I can't not explain why the information that we entered did not show up on the final copy.
I called the FEMA hotline and they said that is the way it prints up! If you have any questions let me know. All
information requested was entered, including our account information, which also does not show up on the
application that we printed.

I was in receipt of another copy of the grant application. This also states "in progress" with a date of 3/19. 1 was
also in receipt of a copy that the application was submitted successfully. However, to have this ratified we need
to have a copy of what was submitted. The current copy in hand shows the submittal date as blank, no federal
identifier or applicant identifier, no proposed start or end date of the project, and does not show the congressional
district. If these were intentionally left blank that is fine, however the final submitted document is required. The
deadline for agend items is 10:00am tomorrow.
