RESOLUTION NO. 7989
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
VERNON REJECTING THE BID RECEIVED FOR BID NO. 1415
AND APPROVING AND AUTHORIZING NOTICE INVITING
SEALED PROPOSALS OR BIDS FOR THE PURCHASE OF A NEW
FORD EXCURSION FOR THE FIRE DEPARTMENT
WHEREAS, on May 8, 2002, the City Council of the City of
Vernon approved Resolution No. 7952 authorizing the advertisement of
bids for the purchase of one new 2002 Ford Excursion; and
WHEREAS, subsequently, City staff issued an addendum to the
bid to accept bids for both 2002 and 2003 vehicles after being advised
that only 2003 models were available made to order and 2002 models
were only available on the lot of some dealerships; and
WHEREAS, only one bid was received in response to said
advertisement and addendum and City staff desires to solicit bids a
second time to obtain the best competitive price possible; and
WHEREAS, by letter dated June 12, 2002, Bruce V.
Malkenhorst, City Administrator/City Clerk, recommended that the bid
of Midway Ford be rejected and that authority be granted for the
Purchasing Agent, or his designee, to seek formal bids for the
purchase a 2002 or 2003 Ford Excursion for the Fire Department; and
WHEREAS, the bid specification for the Ford Excursion has
been revised with a new bid number and is submitted herewith for
reconsideration; and
WHEREAS, pursuant to Section 2.27 of the Code of the City of
Vernon, the City Council of the City of Vernon finds and determines
that it is in the public interest and necessity that the bid received
for Bid No. 1415 be rejected and new bids or proposals be solicited in

accordance with applicable State law and the Vernon City Code.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF VERNON AS FOLLOWS:
SECTION 1: The City Council of the City of Vernon hereby
finds and determines that the recitals contained hereinabove are true
and correct.
SECTION 2: The City Council of the City of Vernon hereby
rejects the bid received for Bid No. 1415.
SECTION 3: The bid specification, which is attached hereto
as Exhibit "A" and made a part hereof, is hereby approved by the City
Council of the City of Vernon.
SECTION 4: The City Clerk of the City of Vernon is hereby
directed to give notice, in writing, inviting sealed proposals or bids
for the purchase of one 2002 or 2003 Ford Excursion vehicle, in
accordance with the bid specification, and in accordance with this
resolution.
SECTION 5: There being no newspaper of general circulation
printed, published or circulated in the City of Vernon, the City Clerk
is hereby directed to post said notice, or cause the same to be
posted, in three of the most public places in the City of Vernon, to
wit: the northwest corner of 38th Street and Santa Fe Avenue, the
northeast corner of Leonis Boulevard and Pacific Boulevard, and on the
bulletin board in the lobby of the City Hall of the City of Vernon,
located at 4305 Santa Fe Avenue, in said City.
SECTION 6: The City Clerk of the City of Vernon is hereby
directed to post said notice forthwith and the first posting of said
notice shall be at least ten (10) days before the opening of the bids
for the proposed contract. Said notice shall provide that sealed

proposals or bids will be received by the City of Vernon at the office
of the City Clerk, or his designee, at the City Hall, 4305 Santa Fe
Avenue, Vernon, CA 90058-0805.
SECTION 7: The City Clerk of the City of Vernon shall
certify to the passage of this resolution, and thereupon and
thereafter the same shall be in full force and effect.

Command Vehicle Specifications
2002 or 2003 Ford Excursion
General
The vehicle covered by this specification is for the purchase of a Ford 2002 or 2003
Excursion and shall be supplied as specified from the manufacturers new, unused and
latest model complete with all necessary equipment and accessories.
The vehicle shall be delivered completely assembled and ready to operate. All equipment
normally furnished, as a standard shall be included. All separate units or components
shall be new, unused, installed connected and delivered in good operating order.
The subject vehicle shall conform in all respects and be equipped to operate legally on
California State Highways as specified in the California Motor Vehicle Code. The
vehicle shall meet all California State and Federal safety and emissions standards when
delivered to the City of Vernon.
The successful bidder shall submit in detail a final draft of all specifications for final
approval by the City of Vernon and the Vernon Fire Department prior to purchase.
All bids submitted shall include sufficient associated literature, as required to fully
describe and detail the items under consideration. This may include photographs,
performance charts, components list, dimensional drawings, etc. The bidder shall clearly
state any changes, exceptions or substitutions of equivalent equipment/materials to these
specifications.
Whenever materials or equipment are specified or described in the specifications by using
the name of proprietary item or the name of a particular manufacturer, fabricator, supplier
or distributor, the naming of the item intended to establish the type, function, and quality
required. Unless the name is followed words indicating that no substitution is permitted,
materials or equipment of other manufacturers, fabricators, suppliers or distributors may
be accepted by the City of Vernon if sufficient information is submitted by the contractor
to allow the City of Vernon to determine that the material or equipment proposed is
equivalent to the named. The term " equivalent' as used in this specification means
"authorized equivalent" and acceptance of the "equivalent' is subject to the approval of
the City of Vernon.
Warranties:.
The manufacturers warranties on the vehicle and any added equipment shall be delivered
to the City of Vernon without waiver by the city of any recourse under California law.
Inspection
The bidder shall arrange for a pre -delivery inspection by the City of Vernon Fire
Department.
Delivery Date
All bidders shall provide a date to deliver the vehicle. It is of utmost concern to the City
of Vernon that the quoted delivery date be met.
Any delay in delivery shall be immediately reported in writing to the purchasing agent
with a copy to the Fire Department representative. Any change in the original quoted
delivery date is subject to approval by the City of Vernon.
The City of Vernon reserves the right to cancel the purchase order for non-performance
of delivery by the quoted date at no cost or obligation to the City of Vernon.
Delivery:
The vehicle shall be delivered to 4305 Santa Fe Ave, Vernon, Ca. 90058. The vehicle
shall be ready for immediate and safe operation, having had a complete pre -delivery
service and inspection. The invoice, any necessary vehicle registration documentation,
warranty information and manuals must accompany delivery.
