CONSTRUCTION INC. FOR RESURFACING OF FIRE STATION NO. 3 AND NEW PAVING & FENCING OF BOOSTER PLANT NO. 3 IN ACCORDANCE WITH CONTRACT NO. 561 OF THE CITY OF VERNON AND APPROVING THE EXECUTION OF SAID CONTRACT WHEREAS, Contract No. 561 of the City of Vernon was approved by the City Council of the City of Vernon pursuant to Resolution No. 7955, and sealed bids were opened on June 5, 12002; and WHEREAS, said bids were referred to Samuel Kevin Wilson, Director of Community Services & Water, WHEREAS, upon opening the bids, Pacific Asphalt Services was the lowest bidder; and WHEREAS, the City was unable to verify Pacific Asphalt Services' references; and WHEREAS, Pacific Asphalt Services withdrew its bid because of a miscalculation that resulted in an underbid; and WHEREAS, E.G.N. Construction Inc. was the next lowest bidder; and WHEREAS, the Director of Community Services & Water has reported to the City Council under the date of July 17, 2002, recommending that Contract No. 561 for Resurfacing of Fire Station No. 3 and New Paving & Fencing of Booster Plant No. 3 be executed with E.G.N. Construction Inc. on the basis of its bid in the sum of one hundred sixty four thousand six hundred ninety four dollars and no cents ($164,694.00), being the most qualified lowest responsible bid meeting the contract 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 requirements. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF VERNON AS FOLLOWS: SECTION 1: The City Council of the City of Vernon hereby finds and determines that the recitals contained hereinabove are true and correct. SECTION 2: The City Council of the City of Vernon does hereby award Contract No. 561 to E.G.N. Construction Inc. in accordance with the recommendation of Samuel Kevin Wilson, Director of Community Services & Water, and authorizes the Mayor and City Clerk to execute said Contract on behalf of the City. SECTION 3: All other bids are rejected subject to execution of the contract and the City Treasurer is hereby directed to return unsuccessful bidders any cashier or certified checks deposited with said bids upon the receipt of an executed contract from E.G.N. Construction Inc. accompanied by all required bonds and certificates. SECTION 4: The City Clerk of the City of Vernon shall certify to the passage of this resolution and thereupon and thereafter the same shall be in full force and effect. OLSON Police Chief FAX: (323) 826-1481 Contract No. 561 The bids according to Contract No. 561, Resurfacing of Fire Station No.3 and New Paving & Fencing of Booster Plant No.3 were received and opened June 5, 2002, and the result are as follows: Pacific Asphalt Services $135,335.00 E.G.N. Construction Inc. $164,694.00 Commercial Paving & Coating $169,500.00 Fleming Environmental Inc. $177,190.74 Excel Paving Company $182,885.85 Pacific Construction Company $188,709.00 E.A. Mendoza Contracting $216,100.00 The bids have been reviewed and Pacific Asphalt Services was the apparent low bidder. City staff attempted to verify the references provided by Pacific Asphalt Services in their bid package and found the first reference, Diamond Construction from Apple Valley, did not recognize the firm and the second reference, La Quinta Unified School District, Indio, was not listed in the telephone directory. Although staff contacted Pacific Asphalt Services about this problem by telephone on June 6, 10, and 11, 2002, Pacific Asphalt Services declined to provide more information and references. Moreover, on June 12, 2002, Pacific Asphalt Services requested, in writing, to withdraw their bid because their subcontractor had provided a miscalculated price quote in bid Item No. 7, "Construction of 8' high wrought iron fence" around the perimeter of Booster Plant No.3. For the above reasons, City staff recommends the apparent low bidder, Pacific asphalt Services be determined as a "Non Responsive Bidder" and not awarded the contract. Honorable City Council -2- My17,2002 City staff subsequently investigated the apparent second low bidder and found that E.G.N. Construction Inc. has been in the construction field for many years and has a long list of successfully completed projects with excellent references. E.G.N. Construction Inc. also has sufficient bonding resources. In order to ensure a well -constructed and expeditious project, City staff recommends this contract be awarded to the responsible second low bidder, E.G.N.
