3 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
4 VERNON APPROVING AND AUTHORIZING THE EXECUTION OF
AN AMENDMENT NO. ONE TO THE AGREEMENT FOR
5 CONSULTING SERVICES BY AND BETWEEN THE CITY OF
VERNON AND'MELVYN GREEN AND ASSOCIATES, INC.

7 WHEREAS, on March 24, 1998, the City Council of the City of
8 Vernon adopted Resolution No. 7104 approving pproving and authorizing the
9 execution of an Agreement for Consulting Services (the "Agreement")
10 with Melvyn Green and Associates, Inc. ("Melvyn Green") for plan
11 checking services; and
12 WHEREAS, in accordance with Section 14.2 of the Agreement,
13 the City of Vernon and Melvyn Green desire to amend the Agreement to
14 increase the hourly rate for special consulting services; and
15 WHEREAS, the Finance Committee on July 23, 2002, approved
16 the recommendation of Bruce V. Malkenhorst, Director of Finance, dated
17 July 18, 2002, that an amendment to the Agreement with Melvyn Green be

approved and executed.
19 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
20 CITY OF VERNON AS FOLLOWS:
21 SECTION l: The City Council of the City of Vernon hereby
22 finds and determines that the recitals contained hereinabove are true
23 and correct.
24 SECTION 2: The City Council of the City of Vernon hereby
25 approves the Amendment No. One to the Agreement for Consulting
26 Services with Melvyn Green, a cop
y py of which is attached hereto as
27 Exhibit "A" and made a part hereof.
28 SECTION 3: The City Council of the City of Vernon hereby
1 authorizes the Mayor and the City Clerk to execute said Amendment for,
2 and on behalf of, the City of Vernon.
3 SECTION 4: The City Council of the City of Vernon hereby
4 directs the City Clerk, or his designee, to send one fully executed
5 Amendment to:

9 SECTION 5: The City Clerk of the City of Vernon shall

THIS AMENDMENT NO. ONE TO THE CONSULTING SERVICES AGREEMENT

of which may be considered and used as the original hereof for all
purposes, as of this day of July, 2002.

RECITALS
WHEREAS, the City and Consultant are parties to an Agreement
for Consulting Services that was entered on or about April 2, 1998
(hereinafter referred to as the "Agreement") under which Consultant
provides the City with plan review consulting services, as set forth in!
more detail therein; and
WHEREAS, Section 14.2 of the Agreement provides that any
modifications to the Agreement, including any increase or decrease in
the amount of the Consultant's compensation, which are mutually agreed
upon by and between the City and Consultant, shall be in the form of a
Written amendment to the Agreement; and
WHEREAS, the Consultant has been providing services to the
City under a fee schedule and has also been providing special
consulting services on a set hourly rate; and

WHEREAS, Consultant has requested an increase in its hourly
rate for providing special consulting services; and
WHEREAS, the City and Consultant desire to amend the
Agreement to provide for an increase in Consultant's hourly rate for
special consulting services; and
WHEREAS, the other services provided by Consultant will be
performed according to the existing fee schedule, without change.
NOW, THEREFORE, IN CONSIDERATION OF THESE MUTUAL COVENANTS,
THE PARTIES HERETO AGREE AS FOLLOWS:
SECTION 1: Section 3 of the Agreement entitled
"COMPENSATION" is hereby amended by deleting the text and replacing it
as set forth below:
The City agrees to pay the Consultant for its services
hereunder and the Consultant agrees to work for 50% of
the City charged plan check fee where the fee exceeds
$2.00.00 and 80% of the plan check fee where the fee is
$200.00 or less. The plan review fee will be 80% of
the City charge when performing both structural and
non-structural plan review. Fee includes shipping
plans from Consultant to City. For special consulting
the fee shall be $140.00 per hour including travel
time where applicable.

1 SECTION 2: In all other respects, the terms and conditions
2 of the Agreement shall be renewed in its entirety.

4 IN WITNESS WHEREOF, City and Consultant have executed this
5 Amendment as of the date first hereinabove set forth.

The Community Services and Water Department is requesting that an
amendment be made to the existing Melvyn Green & Associates Agreement
for Consulting Services for Structural Plan Review to provide an
hourly increase from $125.00 to $140.00; the plan review charges will
remain the same and are listed below:
• Structural Plan Review less than $200 Plan Check Fee - 80% of
city charges
• Structural Plan Review $200 or more Plan Check Fee - 50% of
city charges
• Structural and non-structural plan review - 80% of city charges
Staff has conducted a survey to ensure rate compatibility and the
results were adequate. This has been reviewed by the City Attorney
and it is hereby recommended that Amendment No. One to Melvyn Green &
Associates Agreement be approved and executed.

Melvyn Green & Associates Inc. has been performing structural plan checking for the
City for nearly 30 years. During this time period we have built a good working relationship. In
the past the City conducted a survey to ensure that the rates that the City was being charged were
found to be competitive.
They are requesting an increase in their hourly rate for special consulting from $125 an
hour to $140 an hour. The remainder of their fee schedule remains the same. Mel Green &
Associates Inc. does very little special consulting for the City. The majority of their special
consulting work is for the review of City structures upon my request. Currently the structural
plan review of the Malburg Generating Station would fall under this category. The vast majority
of their work consist of structural and non-structural plan review for building permits.
It is recommended that the hourly rate of special consulting services be increased from
$125 an hour to $140 an hour. Additionally the structural plan check services will remain at 80%
of the City charges when the plan check fee is less than $200 and 50% of the City charges when
the plan check fee is $200 ore more. The plan review fee will be 80% of the City charge when
performing both structural and non-structural plan review.
If you concur I will request that the City Attorney draft an amendment to the City's
agreement.

Dear Mr. Wilson:
Our special consulting rates for the City have not been revised for almost five years, While the actual
number of hours per year has been few, our operating costs have increased to a point that it would be fair
to adjust the rates.
Our hourly charges for governmental agencies are based on an assigned overhead rate defined by an audit
for FHWA and CalTrans.
The hourly rate should be adjusted to S 140.00 per hour for special consulting. This is the same rate, or
less, than that charged to other governmental agencies.
Our other plan review charges remain the same as in previous years.
Structural Plan Review less than $200 Plan Check Fee 800/0 of city charges
Structural Plan Review $200 or more Plan Check Fee 50% of city charge
Structural and non-structural plan review 80% of city charge
