Resolution No. 8048c 1 RESOLUTION NO. 8048 2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF 3 VERNON AMENDING RESOLUTION NO. 8007 BY AMENDING SECTION 23; SCHEDULE II (EXHIBIT "B") PAGES 12, 15 4 AND 16; SCHEDULE IV (EXHIBIT "D"); AND SCHEDULE V (EXHIBIT "E") OF SAID RESOLUTION WHICH FIXED THE 5 COMPENSATION FOR CERTAIN EMPLOYEES OF SAID CITY 6 AND AUTHORIZED CERTAIN EXPENSE ALLOWANCES 7 WHEREAS, on July 3, 2002, Resolution No. 8007 was adopted by 8 the City Council of the City of Vernon to be effective on July 1, 9 2002; and 10 WHEREAS, the City Council of the City of Vernon wishes to 11 amend pages 15 and 16 of Schedule II (Exhibit "B") to (i) establish 12 the classification and salary scale for Finance Support Analyst in the 13 City Administrator/City Clerk Department; and (ii) change the 14 classification titles of Information System Analyst and Information 15 System Specialist I and II to Information Technology Analyst and 16 Information Technology Specialist I and II; and 17 WHEREAS, on September 5, 2001, the City Council of the City 18 of Vernon approved a Fifth Side -Letter Agreement between the Municipal 19 Employees Relations Representative and the Vernon Police Officers' 20 Benefit Association, which amended the Memorandum of Understanding 21 ("MOU") previously adopted on March 15, 1988, as amended by a Side- 22 Letter Agreement adopted on January 21, 1992; a Second Side -Letter 23 Agreement adopted on October 5, 1993; a Third Side -Letter Agreement 24 adopted on July 11, 1995; and a Fourth Side -Letter Agreement adopted 25 on September 2, 1997; and 26 WHEREAS, the Fifth -Side Letter Agreement provides, in part, 27 for cost of living increases and court pay increases; and 28 WHEREAS, on March 6, 2002, the City Council of the City of 1 Vernon approved an amendment to the Fifth Side -Letter Agreement 2 between the Municipal Employees Relations Representative and the 3 Vernon Police Officers' Benefit Association, continuing the 3/12 work 4 schedule for Police Group 2 employees, subject to the terms and 5 conditions contained in the amendment; and 6 WHEREAS, Schedule II, Exhibit 11B,11 page 12 of Resolution No. 7 8007 provides for the positions and salary scales of police officers 8 and sergeants; and 9 WHEREAS, Schedule IV, Exhibit "D," of Resolution No. 8007 10 provides for the compensation for uniform allowances; and 11 WHEREAS, Schedule V, Exhibit "E," of Resolution No. 8007 12 provides for the compensation for court appearances and standby 13 status; and 14 WHEREAS, in accordance with Section 2.4 of the MOU, the City 15 Council of the City of Vernon intends to establish a new salary 16 schedule for the Group 2 employees; and 17 WHEREAS, certain schedules and sections of Resolution No. 18 8007 need to be modified in order to implement the provisions of the 19 Fifth Side -Letter Agreement; and 20 WHEREAS, the City Council of the City of Vernon desires to 21 reorganize Section 23 of Resolution No. 8007 for clarification 22 purposes. 23 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE 24 CITY OF VERNON AS FOLLOWS: 25 SECTION 1: The City Council of the City of Vernon hereby 26 finds and determines that the recitals contained hereinabove are true 27 and correct. 28 SECTION 2: Effective August 26, 2002, pages 15 and 16 of - 2 - 1 Schedule II, Exhibit "A" of Resolution No. 8007 are hereby amended to 2 reflect the salary scale as indicated on the amended Pages 15 and 16 3 which is attached hereto and made a part hereof as Exhibit "A." 4 SECTION 3: Effective September 1, 2002, Schedule II, 5 Exhibit "B," page 12 of Resolution No. 8007 is hereby amended to 6 establish new salary schedules for the positions of police officers 7 and sergeants as indicated in Exhibit "B" which is attached hereto 8 and made a part hereof by this reference. 9 SECTION 4: Effective September 1, 2002, Resolution No. 10 8025, which amended Schedule IV, Exhibit "D" of Resolution No. 8007, 11 is hereby corrected to establish the uniform allowances for police 12 officers and sergeants as indicated in Exhibit "C" which is attached 13 hereto and made a part hereof by this reference in accordance with 14 the Fifth Side -Letter Agreement. 15 SECTION 5: Effective September 1, 2002, Schedule V, 16 Exhibit "E," of Resolution No. 8007 is hereby amended to establish new 17 compensation for court appearances and standby status for the 18 positions of police officers and sergeants as indicated in Exhibit "D" 19 which is attached hereto and made a part hereof by this reference. 20 SECTION 6: For clarification purposes only, Section 23 of 21 Resolution No. 8007 is hereby amended in its entirety to read as 22 follows: 23 SECTION 23: POLICE DEPARTMENT: 24 a. CLASSIFICATION OF EMPLOYEES IN GROUP 2. 25 (1) MOU. 26 For purposes of this resolution, all of the provisions in the 27 MOU dated March 1, 1988, adopted by the City Council of the City of 28 Vernon on March 15, 1988, pursuant to Resolution No. 5489, as extended - 3 - 1 by a Side -Letter Agreement effective October 6, 1991, approved by the 2 City Council of the City of Vernon on January 21, 1992, pursuant to 3 Resolution No. 6001, the Second Side -Letter Agreement approved by the 4 City Council of the City of Vernon on October 5, 1993, pursuant to 5 Resolution No. 6258, the Third Side -Letter Agreement approved by the 6 City Council of the City of Vernon on July 11, 1995, pursuant to 7 Resolution No. 6656, the Fourth Side -Letter Agreement, approved by the 8 City Council of the City of Vernon on September 2, 1997, pursuant to 9 Resolution 7009 and the Fifth Side -Letter Agreement, approved by the 10 City Council of the City of Vernon on September 5, 2001, pursuant to 11 Resolution No. 7825, are referenced herein as though fully set forth 12 at length. 13 (2) Overtime. 14 Police Department personnel, with the exception of the Police 15 Chief, the Police Captain and Lieutenants, shall be paid for overtime 16 work as certified to by the Police Chief and approved by the City 17 Administrator for the following reasons: 18 (a) Disasters. 19 Disasters such as major fires, civil disturbances, and other 20 emergency situations. 21 (b) Extraordinary Circumstances. 22 Extraordinary circumstances requiring more than ordinary law 23 enforcement or fire protection staffing. 24 (3) Court Appearances. 25 Employees in the classifications represented by the Police 26 Association in Group 2 shall be compensated for court appearances in 27 the line of duty outside regular scheduled duty hours as specified in 28 Schedule V, Exhibit "E." - 4 - 1 (a) Court Day Defined. 2 Any employee shall be deemed to have served a full court day 3 appearance if the employee is required to appear at the morning 4 session of the court and has to return on the same day after the noon 5 recess of the court. Otherwise, an appearance during the morning 6 session or the afternoon session only shall be considered a half court 7 day. 8 (4) Standby Status. 9 In addition, Police Sergeants and Police Officers shall be 10 compensated for standby status as specified in Schedule V, Exhibit 11 „E•11 12 (5) Payment of Incentive Compensation Peace 13 Officers' Standard Training Certificate 14 Employees in the classifications represented by the Police 15 Association in Group 2 who have completed their evaluation period 16 shall be entitled to peace officers' standard and training certificate 17 incentive pay as follows: 18 (a) POST Intermediate Certificate. 19 Three percent (30) of the employee's base monthly salary, 20 excluding all other compensation, for the employee earning and 21 possessing a POST intermediate certificate. 22 (b) POST Advanced Certificate. 23 Six percent (60) of the employee's base monthly salary, 24 excluding all other compensation, for the employee earning and 25 possessing a POST advanced certificate. 26 (c) Incentive Compensation. 27 Payment of the aforesaid incentive compensation shall not be 28 cumulative and only the highest applicable incentive pay shall be - 5 - 1 paid. Incentive pay shall be payable the month following the month 2 during which the certificate is received, or the month following 3 completion of the employee's evaluation period, whichever is latest. 4 (6) Field Training Officers. 5 Police officers assigned by the Chief of Police, or his 6 designee, as Field Training Officers shall receive a differential of 7 five percent (5%) of their base salary for the period so assigned. 8 Each officer assigned as a Field Training Officer shall complete a 9 P.O.S.T. approved Field Training Officer School prior to assignment. 10 The number of field training officers, qualifications, and training 11 for such assignment shall be determined by the Chief of Police. Such 12 assignment shall be revoked at any time without recourse to the 13 disciplinary procedure. 14 (7) Uniform Allowance. 15 Vernon shall provide a uniform allowance as specified in 16 Schedule IV, Exhibit "D," for the 2002-2003 fiscal year of Vernon, for 17 the purchase of Uniform and related equipment. 18 (8) Merit Steps. 19 Promotions or salary increases to higher grades are merit 20 steps only and shall be available to employees as recognition and 21 reward for satisfactory service after one (1) year in service at 22 present grade. The promotion or salary increase to said higher grade 23 shall remain in the sole discretion of the City Council. 24 (9) Anniversary Date. 25 Notwithstanding the above provisions, any person employed in 26 a position of Police Officer, Step 6, shall be appointed to Step 5 27 upon his/her successful completion in an assigned training academy and 28 any person employed in a position of Police Officer, Step 5, shall be - 6 - 1 appointed to Step 4 after serving at least six (6) months in the field 2 and upon receiving a merit evaluation of high competent. Any person 3 who qualifies for said increase shall have his/her anniversary date 4 for future merit increases established as of the date said officer is 5 first appointed to said grade. 6 (10) Detective Assignment. 7 In the event a Police Officer or a Sergeant is assigned to 8 the detective division, he/she shall receive premium pay equal to One 9 Hundred Seventy -Five Dollars ($175.00) per month and the premium pay 10 shall not be considered to be part of the employee's base monthly 11 salary when computing peace officers standards and training 12 certificate incentives. However, only one (1) Detective Sergeant, 13 whose duties are to investigate criminal activity, shall be eligible 14 for said One Hundred Seventy -Five Dollars ($175.00) premium pay. 15 (11) Patrol Personnel. 16 Patrol personnel shall work a ten (10) hour shift. The first 17 one-half hour shall be used for briefing and training purposes. Lunch 18 time equal to one-half hour (Code 7) shall be part of the shift and is 19 only compensable if actually interrupted for purposes of an emergency 20 service call or not allowed. If Code 7 is interrupted for an 21 emergency service call or Code 7 is not allowed, the officer will be 22 compensated for one-half hour straight time or be granted one-half 23 hour Code 7 time at a later part of his/her shift. An officer who 24 elects additional compensation shall not be granted additional Code 7 25 time during his/her shift. The current method of scheduling and 26 utilizing Code 7 time, with the exceptions stated above shall 27 continue. 28 - 7 - 1 (12) 4/10 Plan. 2 The City Council hereby continues the 4/10 Plan for approved 3 employees which was established by minute order on October 6, 1991, 4 and further authorized by Resolution No. 6001 adopted on January 21, 5 1992, as amended by the Second Side Letter Agreement adopted by 6 Resolution No. 6258 on October 5, 1993, in accordance with the 7 provisions specified therein. 8 (13) 3/12 Plan. 9 The City continues the 3/12 Plan for approved employees 10 assigned to patrol in accordance with the provisions specified in the 11 Amendment to Fifth Side -Letter Agreement. 12 (14) Tuition Reimbursement. 13 All employees in the classification represented by the Police 14 Association in Group 2 shall be entitled to receive at the City 15 Council's sole discretion the same benefit under the educational 16 assistance program as is provided for miscellaneous city employees. 17 The receipt by one employee of such reimbursement is not to be 18 considered a precedent and shall not require the approval by the City 19 Council of a different employee's request for similar reimbursement. 20 b. POLICE MANAGEMENT EMPLOYEES. 21 (1) Payment of Incentive Compensation'Peace 22 Officers' Standard Training Certificate 23 Police management employees (Police Chief, Police Captain and 24 Lieutenants) shall be eligible to receive peace officers' standard 25 training certificate incentive pay as follows: 26 (a) POST Intermediate Certificate. 27 Three percent (3%) of the employee's base monthly salary, 28 excluding all other compensation, for the employee earning and - 8 - 1 possessing a POST intermediate certificate. 2 (b) POST Advanced Certificate. 3 Six percent (6%) of the employee's base monthly salary, 4 excluding all other compensation, for the employee earning and 5 possessing a POST advanced certificate. 6 (c) Incentive Compensation. 7 Payment of the aforesaid incentive compensation shall not be 8 cumulative and only the highest applicable incentive pay shall be 9 paid. Incentive pay shall be payable the month following the month 10 during which the certificate is received, or the month following 11 completion of the employee's evaluation period, whichever is latest. 12 (2) Personal Vehicle Allowance. 13 In addition to said salaries as set forth in Schedule II, 14 Exhibit "B," certain individuals serving in specified classifications 15 shall receive, when using their own motor vehicle in the service of 16 the City, an additional sum per month as provided for in Schedule III, 17 Exhibit "C." 18 (a) Responsibility for Upkeep of Vehicle. 19 The City shall not be responsible for repairs or any 20 additional costs for upkeep, fuel, lubrication, replacement in whole 21 or in part, or other expenses in connection with any such vehicle 22 beyond the respective amounts set forth in Schedule III, Exhibit "C." 23 (3) Merit Steps. 24 Promotions or salary increases to higher grades are merit 25 steps only and shall be available to employees as recognition and 26 reward for satisfactory service after one (1) year in service at 27 present grade. The promotion or salary increase to said higher grade 28 shall remain in the sole discretion of the City Council. - 9 - 1 (4) 4/10 Plan. 2 The City Council hereby continues the 4/10 Plan for approved 3 employees which was established by minute order on October 6, 1991, 4 and further authorized by Resolution No. 6001 adopted on January 21, 5 1992, as amended by the Second Side Letter Agreement adopted by 6 Resolution No. 6258 on October 5, 1993, in accordance with the 7 provisions specified therein. 8 (5) Tuition Reimbursement. 9 All employees in the classification represented 10 by the Police Association in Group 2 shall be entitled to receive at 11 the City Council's sole discretion the same benefit under the 12 educational assistance program as is provided for miscellaneous city 13 employees. Gentlemen: Attached is a copy of the above referenced resolution approved at the Vernon City Council meeting held September 4, 2002, amending certain sections of Salary Resolution No. 8007. :ng CC: Martha Valenzuela Sharon Johnson Joan Francone Gloria Orosco Marisol Trujillo Hilda Rodriguez Nelly Giron Resolution No. 8048 r l 2 3 4 5 6 7 8 9 10 11' 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 8048 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON AMENDING RESOLUTION NO. 8007 BY AMENDING SECTION 23; SCHEDULE II (EXHIBIT "B") PAGES 12, 15 AND 16; SCHEDULE IV (EXHIBIT "D"); AND SCHEDULE V (EXHIBIT "E") OF SAID RESOLUTION WHICH FIXED THE COMPENSATION FOR CERTAIN EMPLOYEES OF SAID CITY AND AUTHORIZED CERTAIN EXPENSE ALLOWANCES WHEREAS, on July 3, 2002, Resolution No. 8007 was adopted by I the City Council of the City of Vernon to be effective on July 1, 1 2002; and WHEREAS, the City Council of the City of Vernon wishes to amend pages 15 and 16 of Schedule II (Exhibit "B") to (i) establish the classification and salary scale for Finance Support Analyst in the City Administrator/City Clerk Department; and (ii) change the classification titles of Information System Analyst and Information System Specialist I and II to Information Technology Analyst and Information Technology Specialist I and II; and WHEREAS, on September 5, 2001, the City Council of the City of Vernon approved a Fifth Side -Letter Agreement between the Municipal Employees Relations Representative and the Vernon Police Officers' Benefit Association, which amended the Memorandum of Understanding ("MOU") previously adopted on March 15, 1988, as amended by a Side - Letter Agreement adopted on January 21, 1992; a Second Side -Letter Agreement adopted on October 5, 1993; a Third Side -Letter Agreement adopted on July 11, 1995; and a Fourth Side -Letter Agreement adopted on September 2, 1997; and WHEREAS, the Fifth -Side Letter Agreement provides, in part, for cost of living increases and court pay increases; and WHEREAS, on March 6, 2002, the City Council of the City of f 5 ' 1 Vernon approved an amendment to the Fifth Side -Letter Agreement 2 between the Municipal Employees Relations Representative and the 3 Vernon Police Officers' Benefit Association, continuing the 3/12 work 4 schedule for Police Group 2 employees, subject to the terms and 5 conditions contained in the amendment; and 6 WHEREAS, Schedule II, Exhibit "B," page 12 of Resolution No. 7 8007 provides for the positions and salary scales of police officers 8 and sergeants; and 9 WHEREAS, Schedule IV, Exhibit "D," of Resolution No. 8007 10 provides for the compensation for uniform allowances; and 11 WHEREAS, Schedule V, Exhibit "E," of Resolution No. 8007 12 provides for the compensation for court appearances and standby 13 status; and 14 WHEREAS, in accordance with Section 2.4 of the MOU, the City 15 Council of the City of Vernon intends to establish a new salary 16 schedule for the Group 2 employees; and 17WHEREAS, certain schedules and sections of Resolution No. 18 8007 need to be modified in order to implement the provisions of the 19 Fifth Side -Letter Agreement; and 20 WHEREAS, the City Council of the City of Vernon desires to 21 reorganize Section 23 of Resolution No. 8007 for clarification 22 purposes. 23 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE 24 CITY OF VERNON AS FOLLOWS: 25 SECTION 1: The City Council of the City of Vernon hereby 26 finds and determines that the recitals contained hereinabove are true 27:J and correct. 28 SECTION 2: Effective August 26, 2002, pages 15 and 16 of - 2 - . F 1 Schedule II, Exhibit "A" of Resolution No. 8007 are hereby amended to 2 reflect the salary scale as indicated on the amended Pages 15 and 16 3 which is attached hereto and made a part hereof as Exhibit "A." 4 SECTION 3: Effective September 1, 2002, Schedule II, 5 Exhibit "B," page 12 of Resolution No. 8007 is hereby amended to 6 establish new salary schedules for the positions of police officers 7 and sergeants as indicated in Exhibit "B" which is attached hereto 8 and made a part hereof by this reference. 9 SECTION 4: Effective September 1, 2002, Resolution No. 10 8025, which amended Schedule IV, Exhibit "D" of Resolution No. 8007, 11 is hereby corrected to establish the uniform allowances for police 12 officers and sergeants as indicated in Exhibit "C" which is attached 13 hereto and made a part hereof by this reference in accordance with 14 the Fifth Side -Letter Agreement. 15 SECTION 5: Effective September 1, 2002, Schedule V, 16 Exhibit "E," of Resolution No. 8007 is hereby amended to establish new 17 compensation for court appearances and standby status for the 18 positions of police officers and sergeants as indicated in Exhibit "D" 19 which is attached hereto and made a part hereof by this reference. 20 SECTION 6: For clarification purposes only, Section 23 of 211 Resolution No. 8007 is hereby amended in its entirety to read as 22 follows: 23 SECTION 23: POLICE DEPARTMENT: 24 a. CLASSIFICATION OF EMPLOYEES IN GROUP 2. 25 (1) MOU. 26 For purposes of this resolution, all of the provisions in the 27 MOU dated March 1, 1988, adopted by the City Council of the City of 28 Vernon on March 15, 1988, pursuant to Resolution No. 5489, as extended - 3 - ■ 1 by a Side -Letter Agreement effective October 6, 1991, approved by the 2 City Council of the City of Vernon on January 21, 1992, pursuant to 3 Resolution No. 6001, the Second Side -Letter Agreement approved by the 4 City Council of the City of Vernon on October 5, 1993, pursuant to 5 Resolution No. 6258, the Third Side -Letter Agreement approved by the 6 City Council of the City of Vernon on July 11, 1995, pursuant to 7 Resolution No. 6656, the Fourth Side -Letter Agreement, approved by the 8 City Council of the City of Vernon on September 2, 1997, pursuant to 9 Resolution 7009 and the Fifth Side -Letter Agreement, approved by the 10 City Council of the City of Vernon on September 5, 2001, pursuant to 11 Resolution No. 7825, are referenced herein as though fully set forth 12 at length. 13 (2) Overtime. 14 Police Department personnel, with the exception of the Police 15 Chief, the Police Captain and Lieutenants, shall be paid for overtime 16 work as certified to by the Police Chief and approved by the City 17 Administrator for the following reasons: 18 (a) Disasters. 19 Disasters such as major fires, civil disturbances, and other 20 emergency situations. 21 (b) Extraordinary Circumstances. 22 Extraordinary circumstances requiring more than ordinary law 23 enforcement or fire protection staffing. 24 (3) Court Appearances. 25 Employees in the classifications represented by the Police 26 Association.in Group 2 shall be compensated for court appearances in 27 the line of duty outside regular scheduled duty hours as specified in 28 Schedule V, Exhibit "E." - 4 - 1 (a) Court Day Defined. 2 Any employee shall be deemed to have served a full court day 3 appearance if the employee is required to appear at the morning 4 session of the court and has to return on the same day after the noon 5 recess of the court. Otherwise, an appearance during the morning 6 session or the afternoon session only shall be considered a half court 7 day. 8 (4) Standby Status. 9 In addition, Police Sergeants and Police Officers shall be 10 compensated for standby status as specified in Schedule V, Exhibit 11 "E_„ 12 (5) Payment of Incentive Compensation Peace 13 Officers' Standard Training Certificate 14 Employees in the classifications represented by the Police 15 Association in Group 2 who have completed their evaluation period 16 shall be entitled to peace officers' standard and training certificate 17 incentive pay as follows: 18 (a) POST Intermediate Certificate. 19 Three percent (3%) of the employee's base monthly salary, 20 excluding all other compensation, for the employee earning and 21 possessing a POST intermediate certificate. 22 (b) POST Advanced Certificate. 23 Six percent (6%) of the employee's base monthly salary, 24 excluding all other compensation, for the employee earning and 25 possessing a POST advanced certificate. 26 (c) Incentive Compensation. 27 Payment of the aforesaid incentive compensation shall not be 28 cumulative and only the highest applicable incentive pay shall be - 5 - f 1 paid. Incentive pay shall be payable the month following the month 2 during which the certificate is received, or the month following 3 completion of the employee's evaluation period, whichever is latest. 4 (6) Field Training Officers. 5 Police officers assigned by the Chief of Police, or his 6 designee, as Field Training Officers shall receive a differential of 71 five percent (5%) of their base salary for the period so assigned. 8 Each officer assigned as a Field Training Officer shall complete a 9 P.O.S.T. approved Field Training Officer School prior to assignment. 10 The number of field training officers, qualifications, and training it for such assignment shall be determined by the Chief of Police. Such 12 assignment shall be revoked at any time without recourse to the 13 disciplinary procedure. 14 (7) Uniform Allowance. 151 Vernon shall provide a uniform allowance as specified in 16 Schedule IV, Exhibit "D," for the 2002-2003 fiscal year of Vernon, for 17 the purchase of Uniform and related equipment. 18 (8) Merit Steps. 19 Promotions or salary increases to higher grades are merit 20 steps only and shall be available to employees as recognition and 21 reward for satisfactory service after one (1) year in service at 22 present grade. The promotion or salary increase to said higher grade 23 shall remain in the sole discretion of the City Council. 24 (9) Anniversary Date. 25 Notwithstanding the above provisions, any person employed in 26 a position of Police Officer, Step 6, shall be appointed to Step 5 27 upon his/her successful completion in an assigned training academy and 28 any person employed in a position of Police Officer, Step 5, shall be - 6 - 1 2 3 4 5 6 7 8 9 10 11' 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 appointed to Step 4 after serving at least six (6) months in the field and upon receiving a merit evaluation of high competent. Any person who qualifies for said increase shall have his/her anniversary date for future merit increases established as of the date said officer is first appointed to said grade. (10) Detective Assignment. In the event a Police Officer or a Sergeant is assigned to the detective division, he/she shall receive premium pay equal to One Hundred Seventy -Five Dollars ($175.00) per month and the premium pay shall not be considered to be part of the employee's base monthly salary when computing peace officers standards and training certificate incentives. However, only one (1) Detective Sergeant, whose duties are to investigate criminal activity, shall be eligible for said One Hundred Seventy -Five Dollars ($175.00) premium pay. (11) Patrol Personnel. Patrol personnel shall work a ten (10) hour shift. The first one-half hour shall be used for briefing and training purposes. Lunch time equal to one-half hour (Code 7) shall be part of the shift and is only compensable if actually interrupted for purposes of an emergency service call or not allowed. If Code 7 is interrupted for an emergency service call or Code 7 is not allowed, the officer will be compensated for one-half hour straight time or be granted one-half hour Code 7 time at a later part of his/her shift. An officer who elects additional compensation shall not be granted additional Code 7 time during his/her shift. The current method of scheduling and utilizing Code 7 time, with the exceptions stated above shall continue. - 7 - r 1 (12) 4/10 Plan. 2 The City Council hereby continues the 4/10 Plan for approved 3 employees which was established by minute order on October 6, 1991, 4 and further authorized by Resolution No. 6001 adopted on January 21, 5 1992, as amended by the Second Side Letter Agreement adopted by 6 Resolution No. 6258 on October 5, 1993, in accordance with the 7 provisions specified therein. 8 (13) 3/12 Plan. 9 The City continues the 3/12 Plan for approved employees 10 assigned to patrol in accordance with the provisions specified in the 11 Amendment to Fifth Side -Letter Agreement. 12 (14) Tuition Reimbursement. 13 All employees in the classification represented by the Police 14 Association in Group 2 shall be entitled to receive at the City 15 Council's sole discretion the same benefit under the educational 16 assistance program as is provided for miscellaneous city employees. 17 The receipt by one employee of such reimbursement is not to be 18 considered a precedent and shall not require the approval by the City 19 Council of a different employee's request for similar reimbursement. 20 b. POLICE MANAGEMENT EMPLOYEES. 21 (1) Payment of Incentive Compensation Peace 22 Officers' Standard Training Certificate 23 Police management employees (Police Chief, Police Captain and 24 Lieutenants) shall be eligible to receive peace officers' standard 25 training certificate incentive pay as follows: 26 (a) POST Intermediate Certificate. 27 Three percent (3%) of the employee's base monthly salary, 28 excluding all other compensation, for the employee earning and M:m 1 possessing a POST intermediate certificate. 2 (b) POST Advanced Certificate. 3 Six percent (60) of the employee's base monthly salary, 4 excluding all other compensation, for the employee earning and 51 possessing a POST advanced certificate. ` 6 (c) Incentive Compensation. 7 Payment of the aforesaid incentive compensation shall not be 8 cumulative and only the highest applicable incentive pay shall be 9 paid. Incentive pay shall be payable the month following the month 10 during which the certificate is received, or the month following 11 completion of the employee's evaluation period, whichever is latest. 12 (2) Personal Vehicle Allowance. 13 In addition to said salaries as set forth in Schedule II, 14 Exhibit "B," certain individuals serving in specified classifications 15 shall receive, when using their own motor vehicle in the service of 16 the City, an additional sum per month as provided for in Schedule III, 17 1 Exhibit "C." 18 (a) Responsibility for Upkeep of Vehicle. 19 The City shall not be responsible for repairs or any 20 additional costs for upkeep, fuel, lubrication, replacement in whole 21 or in part, or other expenses in connection with any such vehicle 22 beyond the respective amounts set forth in Schedule III, Exhibit "C.° 23 (3) Merit Steps. 24 Promotions or salary increases to higher grades are merit 25 steps only and shall be available to employees as recognition and 26 reward for satisfactory service after one (1) year in service at 27 present grade.
