TO EXPAND ITS EXISTING HAZARDOUS WASTE TREATMENT FACILITY AT 2448 25TH STREET AND RESCINDING RESOLUTION NO. 7970 WHEREAS, P. Kay Metal Supply, Inc. had applied for a conditional use permit to expand its existing hazardous waste treatment facility located at 2448 25th Street in the City of Vernon; land WHEREAS, the City Council of the City of Vernon held a hearing on said application for a conditional use permit on May 22, 2002; and WHEREAS, during the hearing a Staff Report was received by the City Council and relied upon by the City Council in making its determination on the conditional use permit; and WHEREAS, the City Council adopted Resolution No. 7970 which granted P. Kay Metal Supply, Inc. a conditional use permit to expand its existing hazardous waste treatment facility; and WHEREAS, subsequent to granting the conditional use permit, the California Department of Toxic Substance Control ("DTSC") suggested that further environmental review was necessary in order to determine if there would be any significant change in the facility's operational capacity; and WHEREAS, the Community Services Department performed an Initial Study dated August 22, 2002, to determine whether the proposed project will have adverse impacts on the environment and has determined that the proposed project will not have a significant -1- 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 adverse effect on the environment, and the Director of Community Services & Water has recommended that a Negative Declaration be adopted in compliance with the California Environmental Quality Act ("CEQA"); and WHEREAS, the City of Vernon has provided notice if its intent to adopt a Negative Declaration for the proposed project and has provided a public review period of not less than 30 days, as required by the CEQA and the State CEQA Guidelines; and WHEREAS, the P. Kay Metal Supply, Inc.'s proposed use is allowed in the M-Zone, General Industrial with the approval of a conditional use permit; and WHEREAS, the building was fire damaged and P. Kay Metal Supply, Inc. proposes to replace the existing 10,650 square feet structure with a 17,850 square feet structure that will be situated in a parcel of 31,000 square feet; and WHEREAS, the proposed site is adequate in size, shape and topography for the proposed operation and has adequate drainage, landscaping, if required, will be installed pursuant to the Vernon City Code; and WHEREAS, the proposed site is surrounded by industrial uses compatible with the proposed use and no adverse effects from traffic, parking, noise, odors, dust, smoke, light or glare is anticipated from the proposed operation; and WHEREAS, P. Kay Metal Supply, Inc. has been operating since 1978 and the volume of traffic and patterns will not change with the proposed use, therefore, the streets and highways surrounding the site are adequate in width and will be improved, as necessary, to carry the traffic expected by this proposed operation; and -2- � o s 1 2 3 5! 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 WHEREAS, the site has access to 25th Street in the City of Los Angeles and Minerva Street in the City of Vernon. Traffic will generally travel on 25th Street, west to Santa Fe Avenue and north to the freeway access. Santa Fe Avenue is of an adequate size and Pavement -type to handle the traffic generated from the proposed operations; and WHEREAS, the development plans indicate that the proposed expansion will included an estimated twenty-two automobile parking spaces, three truck spaces, which are of adequate size, width and capacity to handle the traffic generated from the proposed use and will enhance the on -site maneuvering of automobiles and trucks; and WHEREAS, the project will not have an effect on off-street parking and loading facilities and will increase the on -site maneuvering; and WHEREAS, the site has adequate on -site parking and loading facilities in accordance with the Zoning Ordinance; and WHEREAS, the proposed use, as to location, operation and design is consistent with the General Plan and Zoning Ordinance of the City of Vernon; and WHEREAS, the conditions imposed on the conditional use permit as set forth herein will adequately protect the public health, safety and general warfare and the operation is consistent with all applicable rules and laws of the City of Vernon; and WHEREAS, the City Council held a hearing on said application on October 2, 2002 and has received a Staff Report, dated September 25, 2002 upon which it has relied in making the foregoing recitals; and -3- 1 2 3 4 5 6 7 8 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY 1OF VERNON AS FOLLOWS: SECTION 1: The City Council of the City of Vernon hereby finds and determines that the recitals contained hereinabove are true and lcorrect. SECTION 2: The City Council of the City of Vernon hereby rescinds Resolution No. 7970 SECTION 3: Subject to the conditions set forth below, the conditional use permit is hereby granted to P. Kay Metal Supply, Inc. for the operation of a hazardous waste treatment facility at 2448 25th Street located in the City of Vernon. SECTION 4: In order to adequately protect the public health and general welfare the following conditions are required: a. The facility shall be operated in accordance with, and made to conform with all current codes, rules, and regulations including any required fees or taxes as adopted by the City of Vernon and all Federal, State, or local control agencies. b. All required federal, state, local and regulatory agency permits shall be obtained and maintained, including but not limited to the Los Angeles County Sanitation Districts, Regional Water Quality Control Board, the Department of Toxic Substances Control, and the City of Vernon Environmental Health Department ("Health Department"). C. All parking and loading areas necessary for P. Kay Metal Supply, Inc. operations shall be striped in an acceptable manner to the Director of Community Services & Water and shall be paved with a hard durable surface material and shall be adequately drained, and kept free of dust, mud, -4- 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 trash and weeds. Where parking or maneuvering areas adjoin the public street, a barrier wall or landscaping shall be maintained to meet City standards. Adequate on -site parking shall be maintained so that off-street parking will not occur. d. All existing cracked sidewalk; curb and gutter adjacent to the site on Minerva Street shall be repaired and maintained to meet City Standards. Frontage improvements along 25tn Street shall be constructed to City standards. e. All waste haulers shall be State certified and use Department of Transportation (DOT) -approved transporters. f. The facility shall be operated in compliance with the final Tiered Permit as a Treatment, Storage, or Disposal Facility as issued by the Department of Toxic Substances Control on January 20, 1998 or as modified in the future. g. Any hazardous substances used, handled or stored shall have prior approval from the Vernon Fire Department and Vernon Health Department. A Health Permit shall be obtained if there are reportable quantities of hazardous materials on the site. h. Servicing of vehicles including washing, steam cleaning and repairing shall be performed in facilities in compliance with appropriate codes. -5- 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 i. All processing, recycling and storage operations shall take place within the proposed site. No equipment or materials shall be placed or stored outside. Adequate written plans and materials must be available for cleaning up of leaks or spills of recycling materials or other substances associated with P. Kay Metal Supply, Inc. operation. j. The entire site shall have a neat and clean appearance and shall be kept free of dust, mud, weeds and trash. The site and surrounding area shall be kept free of all recycling materials associated with P. Kay Metal Supply, Inc. operations including but not limited to raw materials, recycled materials, finished product, and waste material. k. The facility shall be operated in a manner that will prevent unsanitary conditions, odors or other nuisances. 1. P. Kay Metal Supply, Inc. shall maintain a National Pollutant Discharge Elimination System (NPDES) Permit with the State Water Resources Control Board, unless otherwise exempted. M. The facility's building shall be structurally maintained to exclude rodents and the property shall be maintained rodent free. n. The facility shall be operated in such a manner that noise and vibration shall not be a nuisance to neighborhood properties. At no time shall noise exceed 65db or vibration exceeds four hundredths of an inch per second particle velocity when measured at the property line. Kay Metal Supply, Inc. shall have onsite spill response resources. p. P. Kay Metal Supply, Inc. shall submit for approval by the Health Department an Emergency Response Action Plan and a facility Response Plan. These plans shall be updated as necessary. q. A hazardous materials inventory and business/contingency plan shall be submitted and a hazardous materials permit shall be obtained from the Vernon Health Department. Only those substances approved by the Vernon Health Department and Vernon Fire Department shall be stored, used or handled at the site. Hazardous materials/wastes shall be handled and managed in compliance with all appropriate federal, state and local laws. r. All tank installations shall comply with Article (79) and Article (80) of the Uniform Fire Code and applicable standards. S. Prior to tank installation P. Kay Metal Supply, Inc. shall provide a technical assistance opinion and report pursuant to Article 1 section 1031.1 of the Uniform Fire Code (U.F.C). The report shall be submitted to the City of Vernon for review. The report shall analyze the fire safety properties of the design, operation or use of the building or premises and the facilities and appurtenances situated thereon. t. P. Kay Metal Supply, Inc. shall provide engineered confirmation of secondary containment within the building in -7- 1 the new manufacturing areas. Prior to construction of the 2 new tanks. 3 U. P. Kay Metal Supply, Inc. shall provide National Fire 4 Protection Association (NFPA) (or equivalent) labeling to 5 all new vessels. 6 V. P. Kay Metal Supply, Inc. shall provide adequate ventilation 7 and lighting in the new manufacturing areas. 8 W. P. Kay Metal Supply, Inc. shall submit required diagrams and 9 drawings of the proposed piping, pumps, and control 10 equipment prior to the issuance of construction permits. 11 X. Within the City of Vernon no building or structure shall be 12 located within ten feet of any property line abutting a 13 street. All such required yards shall be landscaped and 14 sprinklered in accordance with a plan approved by the 15 Director of Community Services & Water Department. 16 SECTION 5: P. Kay Metal Supply, Inc. and any successors in 17 interest shall indemnify, hold harmless, and defend the City of 18 Vernon, its officers, agents, and employees from and against any and 19 all claims, complaints, or petitions for: (1) damages, losses, 20 expanses resulting from bodily injury, sickness, disease, disability 21 or death arising from the operation of the facility excluding 22 therefrom any such claim resulting from the sole negligence or 23 intentional wrongdoing of the City of Vernon, its officers, agents 24 or employees;-(2) a peremptory writ or other relief by way of 25 injunction, mandamus, or administrative mandamus; or (3) legal 26 expenses and attorney's fees incurred by the City of Vernon on 27 behalf of any party in such actions or proceedings. The City of 28 Vernon does not waive its right to participate in the defense of any -8- I 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 such action SECTION 6: Noncompliance with the conditions set forth in the conditional use permit shall be grounds for voiding the permit pursuant to Section 26.5.2-10 of the Comprehensive Zoning Ordinance. SECTION 7: Not later than sixty (60) days from the date of this Resolution, P. Kay Metal Supply, Inc. shall indicate, in writing, its acceptance of and agreement with the conditions contained in Section 4 of this Resolution and the indemnification provision contained in Section 5 of the Resolution. SECTION 8: The City Clerk of the City of Vernon shall certify to the passage of this resolution and thereupon and thereafter the same shall be in full force and effect. CONDITIONAL USE PERMIT TO EXPAND ITS EXISTING HAZARDOUS WASTE TREATMENT FACILITY AT 2448 25T11_ STREET September 25, 2002 P. Kay Metal Supply, Inc. has submitted an application for a conditional use permit to expand its existing hazardous waste treatment facility located at 2448 25th Street in the City of Vernon. On August 8, 2001 P. Kay Metal Supply's manufacturing building and equipment were damaged in a fire. The proposed project consists of replacing the fire damaged building and equipment lost in the fire. The total square footage -of building on site prior to the fire was approximately 10,650 square feet. The new facility will be approximately 17,850 square feet when completed. The improvements to the proposed site will include an increase in manufacturing capacity, an increase in building size, and improved environmental controls and material handling practices. There will be a slight increase in the permitted hazardous waste storage capacity and no increase in hazardous waste treatment capacity. The increase in building size includes the replacement of outside hazardous waste storage facilities with inside storage, increased manufacturing area, and an increase in office space. These improvements will be constructed _ 1 _ STAFF REPORT in two different phases. All production and processing will remain the same and will be consistent with P. Kay Metal Supply, Inc. original permit issued in 1997 by the Sate of California, Department of Toxic Substance Control ("DTSC"). Solder has been manufactured on the site since 1938. In 1938, United Metal Corporation of California started operating the solid solder manufacturing facility. In 1978, P. Kay Metal Supply, Inc. took over the operation and the site as a tenant and continued the same process. In 1988, P. Kay Metal Supply, Inc. purchased the site and continued to operate the site as before. Until 1993, the facility recycled solid solder from their customers. Solid solder is not considered a hazardous waste by the California DTSC or the Federal Resource Conservation and Recovery Act (RCRA) permitting regulations. In 1993, P. Kay Metal Supply, Inc. changed their use to include the recycling of solder dross, which is a State hazardous waste. P. Kay Metal Supply, Inc. thus changed their use and became a hazardous waste treatment facility as defined by the City of Vernon Comprehensive Zoning Ordinance Section 26.2.7. Definitions (H). The process of recovering solder dross and re - manufacturing the dross into new solder will remain the same as before. Nevertheless, P. Kay Metal Supply, Inc. is required to obtain a conditional use permit to continue operating its existing hazardous waste treatment in an expanded facility per _ 2 _ STAFF REPORT Sections 26.3.5-3 and 26.5.2-11 of the Comprehensive Zoning Ordinance. 1. GENERAL PLAN The proposed use conforms to the Zoning Ordinance and the General Plan. The site is located in the M- Zone, General Industrial. A hazardous waste treatment facility is allowed in this zone if it obtains a conditional use permit. 2. SITE As previously mentioned, the proposed facility is 17,850 square feet and is situated in a parcel that is 31,000 square feet. The site straddles the City of Los Angeles and the City of Vernon boundary. Approximately 40% of the property lies within the City of Vernon while the remaining 60% lies within the City of Los Angeles. The majority of the building and hazardous waste storage areas located near the building are on the Vernon side. The parking lot is located on the Los Angeles Side. The site of the proposed use is adequate in size, topography, including drainage and landscaping. 3. ADVERSE EFFECT The proposed use is surrounded by properties with industrial uses that are compatible. No adverse impacts from traffic, parking, noise, odor, dust, smoke, light or glare are expected to occur to the adjacent or abutting properties. An initial study has been conducted for the project in compliance with the California Environmental Quality Act (CEQA). No potentially significant impacts are expected to result from the project. The Director of Community Services & Water has _ 3 - STAFF REPORT recommended that a Notice of Intent be filed, and a Negative Declaration be adopted in compliance with the California Environmental Quality Act ("CEQA"), which identifies potentially significant impacts on the environment from the project. 4. ACCESS The facility has two driveways, one on Minerva in the City of Vernon and one on 25th Street in the City of Los Angeles. Trucks enter the site from 25th Street and exit the site from Minerva Street. 25th Street is 60 feet wide and is of adequate size to handle the traffic generated from the proposed operation. Minerva Street is also 60 feet wide and is of adequate size to handle the traffic generated from the proposed operation. Approximately 5 trucks and 15 employee automobiles enter and exit the site per day. 5. VEHICLE MOVEMENTS P. Kay Metal Supply, Inc. has operated at the same location in the City of Vernon since 1978 recycling tin/lead solder. The traffic pattern will remain predominantly the same. P. Kay Metal Supply, Inc. generates approximately 5 daily truck trips, Monday through Friday. P. Kay Metal Supply, Inc. uses one tractor/trailer on a daily basis to pick-up and deliver solder to their local customers. Other customers who are located further away use other trucking companies. The proposed site will have access to (22) automobile parking stalls and (3) truck stalls, which are of adequate in size, width and capacity to handle the traffic generated for the - 4 - STAFF REPORT proposed use. Therefore, the proposed project has off-street parking and loading facilities. The truck traffic to the site will start by exiting the freeway system on to Santa Fe Avenue. Trucks will then travel south on Santa Fe Avenue to East 25th Street. Leaving the site, traffic will exit on Minerva Street traveling north to 25th Street. From 25th Street they will travel west to Santa Fe Avenue, then north to the freeway system. There is no substantial change in traffic caused by these improvements. Therefore, the routes the vehicles will travel are adequate to handle the volume of traffic generated from the proposed use. 6. OPERATIONS In 1993, when P. Kay Metal Supply, Inc. began to recycle solder dross; the State required them to obtain a Treatment, Storage or Disposal Facility ("TSDF") permit from DTSC. In 1993, P. Kay Metal Supply, Inc. was issued their interim permit and began recycling the solder dross in addition to solid solder. The DISC completed P. Kay Metal Supply, Inc. final TSDF permit in January of 1998. At that time P. Kay Metal Supply, Inc. was licensed by DTSC to handle solder dross until January 2008. The standardized permit authorizes P. Kay Metal Supply, Inc. to process less than 100,000 pounds of waste solder dross per month and up to 1.2 Million pounds per calendar year. This was based on an average of 20 business days per month with the average incoming waste per day of 5,000 pounds of solder dross. P. Kay - 5 - STAFF REPORT Metal Supply, Inc. can re -process the solder dross and recover the valuable products of lead and tin. The recycled metals decrease the waste that is sent to landfills and reduces the need to mine these metals. Since 1978 when P. Kay Metal Supply, Inc. started recycling solid solder the process has remained predominantly unchanged. The recycling of the solder dross begins by P. Kay Metal Supply, Inc. accepting solder dross in Department of Transportation (DOT) -approved containers from known off -site generators. Many of these off -site generators are regular customers that purchase new solder material. This allows P. Kay Metal Supply, Inc. to control the type of waste it receives, enhance the recovery process, and reduce the amount of waste generated. Locally generated hazardous wastes are picked up by P. Kay Metal Supply, Inc. in their own enclosed vehicles. P. Kay Metal Supply, Inc. is a State registered hazardous waste transporter. P. Kay Metal Supply, Inc. receives out-of-state wastes from various registered hazardous waste transporters. All hazardous waste generated at the facility is sent off -site to a permitted TSDF, by a registered transporter, for further treatment or disposal. During pickup of material by P. Kay Metal Supply, Inc. the outsides of the containers are inspected for defects and the manifest is checked. Once the waste arrives at the facility, the solder dross is visually inspected by the plant manager for - 6 - STAFF REPORT impurities. If the waste passes, it is unloaded into the hazardous waste storage area. If it does not pass it is sent back to the generator. All incoming solder dross is matched and verified against its manifest and weighed. The waste shipment is assigned a tracking number. This tracking number follows the hazardous waste throughout the process to the final solder material that is packaged and sold to a customer. A sample from each container is analyzed by an on -site laboratory, before the solder dross is treated. After testing, the solder dross is ready to be processed in one of the four melting furnaces. All the solder dross from a single generator is processed in one melting furnace and mixed until homogenized. A second sample of the solder dross is analyzed to determine if any refining will be required to produce the required solder alloy. A third and final analysis determines if the solder meets minimum national standards. The treatment consists of melting the solder dross in one of the four melting furnace pots. The fine powder oxide that forms is skimmed from the molten metal and placed into 55-gallon DOT - approved locktop drums. All the oxide powder is exported as required by the California Code of Regulations. If the solder dross requires refining, flux materials are added to the batch and a mechanical mixer stirs the contents until the flux with the impurities rises to the surface of the - 7 - STAFF REPORT pot. The fluxes, with the impurities, are skimmed off, placed in containers and stored in one of the on -site temporary hazardous waste storage areas. The flux waste is kept in the container until the container is full or until the end of the workweek when the waste is transferred to the DOT -approved roll -off bin. Before the newly alloyed solder is poured from the pot, surface oxides are again skimmed and placed in the oxide container. P. Kay Metal Supply, Inc. treatment process is carried out in an enclosed building. The fumes and particulates from the furnace pots are drawn by vacuum to the South Coast Air Quality Management District approved bag house hopper. The new improvements to the facility will include three hazardous waste storage areas located near the furnaces, used to store facility -generated hazardous wastes and incoming solder. All storage areas will be located indoors. A DOT -approved roll - off bin is used to transport hazardous waste to off -site permitted Treatment Storage Disposal Facilities. The contents captured by the bag house are tested to insure that the system is operating efficiently. These tests have been conducted since December 9, 1997 and are submitted to DTSC. 7. STATE OR FEDERAL CONDITIONS All Federal, State, and local regulatory permits shall be obtained as required for the operation. - 8 - STAFF REPORT 8. CONDITIONS It is recommended that the following conditions be set on the permit. These conditions are deemed necessary to protect the public health, safety and general welfare: a. The facility shall be operated in accordance with, and made to conform with all current codes, rules, and regulations including any required fees or taxes as adopted by the City of Vernon and all Federal, State, or local control agencies. b. All required federal, state, local and regulatory agency permits shall be obtained and maintained, including but not limited to the Los Angeles County Sanitation Districts, Regional Water Quality Control Board, the DTSC and the City of Vernon Environmental Health Department ("Health Department"). c. All parking and loading areas necessary for P. Kay Metal Supply, Inc. operations shall be striped in an acceptable manner to the Director of Community Services & Water- and shall be paved with a hard durable surface material and shall be adequately drained, and kept free of dust, mud, trash and weeds. Where parking or maneuvering areas adjoin the public street, a barrier wall or landscaping shall be maintained to meet City standards. Adequate on -site parking shall be maintained so that off-street parking will not occur. d. All existing cracked sidewalk; curb and gutter adjacent to the site on Minerva Street shall be repaired and maintained to meet City Standards. Frontage improvements along 25th Street shall be constructed to City standards. - 9 - STAFF REPORT e. All waste haulers shall be State certified and use Department of Transportation (DOT) -approved transporters. f. The facility shall be operated in compliance with the final Tiered Permit as a TSDF as issued by the DTSC on January 20, 1998 or as modified in the future. g. Any hazardous substances used, handled or stored shall have prior approval from the Vernon Fire Department and Health Department. A Health Permit shall be obtained if there are reportable quantities of hazardous materials on the site. h. Servicing of vehicles including washing, steam cleaning and repairing shall be performed in facilities in compliance with appropriate codes. i. All processing, recycling and storage operations shall take place within the proposed site. No equipment or materials shall be placed or stored outside. Adequate written plans and materials must be available for cleaning up of leaks or spills of recycling materials or other substances associated with P. Kay Metal Supply, Inc. operation. j. The entire site shall have a neat and clean appearance and shall be kept free of dust, mud, weeds and trash. The site and surrounding area shall be kept free of all recycling materials associated with P. Kay Metal Supply, Inc. operations including but not limited to raw materials, recycled materials, finished product, and waste material. k. The facility shall be operated in a manner that will prevent unsanitary conditions, odors or other nuisances. - 10 - STAFF REPORT 1. P. Kay Metal Supply, Inc. shall maintain a National Pollutant Discharge Elimination System (NPDES) Permit with the State Water Resources Control Board, unless otherwise exempted. M. The facility's building shall be structurally maintained to exclude rodents and the property shall be maintained rodent f ree . n. The facility shall be operated in such a manner that noise and vibration shall not be a nuisance to neighborhood properties. At no time shall noise exceed 65db or vibration exceeds four hundredths of an inch per second particle velocity when measured at the property line. o. P. Kay Metal Supply, Inc. shall provide secondary containment for all stored hazardous materials. P. Kay Metal Supply, Inc. shall have onsite spill response resources. p. P. Kay Metal Supply, Inc. shall provide a technical assistance opinion and report pursuant to Article 1 section 1031.1 of the Uniform Fire Code (U.F.C). This is a re -building project to replace a building and equipment lost in the fire. Improvements to the site will include an up -graded storage, handling, processing, and shipping/receiving facilities. The process of recovering solder dross and re -manufacturing the dross into new solder will remain the same. There are no increases to production or processing from the original permit issued in 1997 by the State of California, Department of Toxic Substance Control. DTSC issued a Negative Declaration of environmental impacts for this site based on the same conditions that was destroyed by the fire. Improvements to the site will include storage areas that will be inside the new building, increased parking, and better access to truck traffic. Traffic — Trucks/automobiles There will not be an increase to vehicular traffic to the site. Manufacturing Capabilities There will not be an increase in process through -put or production out -put. Processing/manufacturing hours to remain the same as well as current employment levels. Utilities There are no projected consumption increases to any of the utilities that currently serve the site; water, sewer, electricity, natural gas. Environmental Emissions All emissions from the process will be reduced through permitted air pollution control devices. There will be an actual decrease in potential emissions because of better storage and handling systems. Adjacent Properties This project will not have an adverse impact on adjacent properties. The site operations have been in use for more than 20 years and is located in an industrial area. There are no emissions, odors, or noise created by the process that would have an adverse impact on any adjacent businesses. The site will recover lead and tin from solder dross and be re -manufactured into new solder for the customers. The facility has a state permit to accept waste from off -site and recover the metals as part of the solder process. TRAFFIC REPORT P. K. Metal Supply, Inc. has operated at this site for more than twenty years manufacturing and shipping tin/lead solder. The traffic pattern has not substantially changed during those years. P. K. Metal Supply, Inc. is also a licensed Hazardous Waste Hauler. P. K. Metal Supply has now applied to DTSC for an interim permit to become a TSDF. Treatment, Storage, and Disposal Facility. This is to allow P. K. Metal Supply to transport and treat on -site, waste solder dross. Most solder dross is sent to a land fill for disposal. P. K. Metal Supply can re -process the solder dross and recover the valuable products of lead and tin. The recovered metals are re -alloyed into new solder. The normal truck traffic in and out of P. K. Metals is 1 to 3 trucks daily, Monday to Friday, except holidays. P. K. Metals has one tractor/trailer rig that is used on a daily basis. The truck ships to local customers delivers new solder and picks up the solder dross on a manifest. The truck returns to the plant and unloads the solder dross. A normal traffic day is one round trip for the company owned truck. Other customers that are long distances use other trucking companies. The normal pick-ups are 1 to 2 pick-ups per day. The site has enough parking space to accommodate all of the employees and the tractor - trailer. The traffic pattern'is: From Santa Fe Ave - left on 25th street and through the entrance gate, Leaving the plant the trucks exit onto Minerva, south to 26th street, right onto 26th street to Santa Fe, right turn onto Santa Fe north to the freeway system. Solder Dross is the top skimmings from a solder pot. It will contain some oxides that have formed by the surface of the molten solder in contact with the ambient air. The dross is skimmed to prevent air borne contaminents from altering the soldering properties of the solder. The skimmings of molten solder solidfy and become a solid. Some loose granuals ( approximately like course sand) are part of the dross. The dross is collected and shipped in closed 5-gallon or 55-gallon steel drums. Spills In the event of a spill, the solder dross will remain in a confined area. The spills are easily and quickly cleaned up without the need for special tools or equipment. Personnal Protective equipment that is recommended for clean- up personnel are; Tyvec coveralls, full face respirators, cotton or leather gloves. Tools required for clean-up are: broom(s), shovel(s), and a container, if the original container (drum) is damaged. The average weight of a 55- gallon drum is 1500 - 2200 lbs. There is no need for evacuation, people not involved in the clean-up should remain 10 feet away from the spill area. Quantities Transported - Traffic Flow (see Traffic Report) Normal traffic patterns do not pass through the City of Vernon. However, most loads of waste solder dross is about 10,000 pounds. Exceptions are some shippments from P. K. Metal Supply to off -site disposal facility may be as much as 40,000 lbs per shippment, this could occur once per quarter. The drums are transported in closed 20 or 40 foot vans, or smalled trucks. P.Kay commenced recycle of lead solder dross in 1993 and was issued a Conditional Use Permit from the city of Vernon and a Standardized Hazardous Waste Facility Permit on January 20, 1998 from the Cal EPA Department of Toxic Substances Control (DTSC). P. Kay suffered afire on Wednesday, August 8, 2001, during scheduled non -work hours, which destroyed most of the facility. This project is to reconstruct the facility and will include improvements, including an increase in manufacturing capacity, an increase in building size from 10, 650 square feet to 17,850 square feet, and improved environmental controls and material handling practices. There will be a slight increase in the permitted hazardous waste storage capacity and no increase in hazardous waste treatment capacity. The increase in building size includes the replacement of outside hazardous waste storage facilities with inside storage, increased manufacturing area, and an increase in office space to accommodate four additional employees formerly located at offsite offices. The Conditional Use Permit issued by the City of Vernon and the Standardized Permit issued by the CalEPA Department of Toxic Substance Control must be modified to reflect the facility improvements. -1- 9. Although there are no known earthquake faults in the City, Vernon is in a seismically active region and several faults in the area are likely to cause moderate ground shaking in Vernon. To ensure life safety, all construction shall be required to be in compliance with (Zone 4) seismicity requirements of the Uniform Building Code. There will not be any significant changes to the geologic substructure or topography. A soils survey conducted at the site to evaluate geophysical characteristics determined that development of the site was feasible. (Reference 4 p.S and Reference 8) IV. WATER. Would the proposal result in: a) Changes in absorption rates, drainage patterns, Or the rate and amount of surface runoff. ❑ ❑ X b) Exposure of people or property to water related Hazards such as flooding? a. and b. The site for the proposed conditional use is adequate in size and shape including drainage and landscaping to accommodate development features as required by zoning code. The site has historically been 100% impervious to water infiltration, and the expanded site will be 100% impervious to water infiltration. There will be no significant alteration to site drainage patterns or quantity of surface runoff: The site is located above the 100 year flood plain. The facility employs Best Management Practices for storm water pollution prevention in compliance with the General Permit for Discharges of Storm Water Associated with Industrial Activities (WDID# 4B19S011463). There are two active drinking water wells within % mile of the facility (at 2643 E. 25`h Street and at 2625 E. 25rh Street). After almost 60 years of operation of the P. Kay Metal facility (including 20 years of waste recovery), there is no evidence of well contamination associated with P. Kay Metal's activities. (References 2 p. 7) AIR QUALITY: Would the proposal: a) Violate any air quality standard or contribute to an existing or projected air quality violation? ❑ ❑ X ❑ a. The City of Vernon is located within the South Coast Air Basin of California. The basin covers a 6, 600- square mile area within Orange County, non -desert portions of Los Angeles County, Riverside County, and San Bernardino County. Anticipated construction emissions for theproposedproject do notpresent apotentially significant air quality impact. This determination is based on the qualitative information contained in the SCAQMD CEQA Air Quality Analysis Handbook, Table 6-3. Screening Table for Construction — Quarterly Thresholds of Potential Significance for Air Quality. Table 6-3 presents a `screening threshold" of 1,102, 520 square feet of Gross Floor Area (GFA) for a project to present a potentially significant air quality impact. The proposed project has a GFA of 17,850 square feet, which is considerably less than the "screening threshold. " The applicant understands that SCAQMD considers Table 6-3 to be outdated because of EMFAC7F mobile source emission factor use (as opposed to CMFAC2001 factors). However, no new "screening threshold" has been established and the project GFA does not approach the "screening threshold, " therefore Table 6-3 is a sufficient screening tool for construction emissions. Anticipated operational emissions for the proposed project do not present a potentially significant air quality impact. This determination was based off emission calculations included in SCAQMD permit to construct applications submitted to the SCAQMD for the project. The emission calculations indicate that operational emissions for the project will not approach significance thresholds in Chapter 6 of the SCAQMD CEQA Air Quality Analysis Handbook, including thresholds for chronic and acute Hazard Index. The facility will require no emission offsets pursuant to SCAQMD Rule 1303, and will be in compliance with SCAQMD Rules 1401, 1407 and 1420. Compliance with these rules will be verified with an air emission source test once construction is complete and operations commence. (Reference 2, p.11) c) Alter air movement, moisture, or temperature, or cause any change in climate? ❑ ❑ O X d) Create objectionable odors? ❑ ❑ ❑ X c. and d. Air emissions from the project will be very similar and potentially less than historic air emissions at the facility. Thus it is not anticipated that the project will result in altered air movement, moisture, or temperature, or cause any change in climate, or generate objectionable odors. (Reference 2, p. 6-7) VI. TRANSPORTATION/CIRCULATION. Would the proposal result in: a) Increased vehicle trips or traffic congestion? ❑ ❑ ❑ X a. The project is not anticipated to generate increased vehicle trips or traffic congestion. Several freeways serve Vernon. To the north is the Santa Ana (I-5), Santa Monica (7-10) and the Hollywood (I-101) freeways, to the west is the Harbor Freeway (1-110), and to the east is the Long Beach Freeway (1--710). City of Vernon has several arterials, which bisect the City. The streets surrounding the proposed use are adequate in width and are improved as necessary to carry the traffic expected by this proposed use. 25`h Street serves the subject site with a right-of-way of 60 feet and is of adequate size to handle the traffic generated from the proposed operation. (Reference 2 —p. 13-14; Reference 3) b) Hazards to safety from design features (e.g. sharp curves or dangerous intersections) or incompatible uses (e.g. farm equipment)? ❑ ❑ ❑ X b. The proposed site is located in an existing industrial area, and the project is compatible with surrounding uses. No safety hazard resulting from incompatible uses are expected. P.Kay is a licensed Hazardous Waste Transporter and all drivers are trained in safe transportation procedures. (Reference 2, p. 14 and Reference 3) c) Inadequate emergency access or access to nearby uses? ❑ ❑ ❑ X c. The proposed site will include emergency access and access to nearby uses, as required by the City. (Reference 3) d) Insufficient parking capacity on -site or off -site? ❑ ❑ ❑ X d. According to the Comprehensive Zoning Ordinance the proposed site will exceed the parking requirements defined in the zoning code. A total of twenty two (22) automobile parking spaces, and three (3) truck parking stalls are provided within the site. (Reference I - §26.4.2-6 and Reference 3) e) Hazards or barriers for pedestrians or bicyclists? ❑ ❑ ❑ X f) Conflicts with adopted policies supporting alternative transportation (e.g. bus turnouts, bicycle racks)? ❑ ❑ ❑ X g) Rail, waterborne or air traffic impacts? ❑ ❑ ❑ X e through g. The proposed project area is surrounded by industrial uses with virtually no pedestrian traffic. The activity at the site does not involve waterborne or air traffic. (Reference 3) VII. BIOLOGICAL RESOURCES. Would the proposal. a) Conflict with adopted energy conservation plans? ❑ ❑ ❑ X a. The proposed building shall comply with all appropriate local and state energy conservation regulations. b) Use non-renewable resources in a wasteful and inefficient manner? ❑ ❑ ❑ X -7- b. Metal melting pots have the potential to use 4.5 MMBTU/hr natural gas for all pots. The burners were specifically sized to provide heat to the melting pots. Thus natural gas will not be used in a wasteful and inefficient manner. It is in the facilities economic interest to minimize energy consumption to the maximum extent possible. IX. HAZARDS. Would the proposal involve: a) A risk of accidental explosion or release of hazardous substances (including, but not limited to oil, Pesticides, chemicals or radiation)? ❑ ❑ X ❑ a. Lead solder dross is a toxic solid that is compatible with most materials and has no explosive or flammable properties. Due to the physical characteristics of waste handled at the facility, the potential for accidental release is very low. Hazardous waste management practices required by California Code of Regulations, Title 22, Division 4.5, Chapter 14, §66264 are employed by the facility. (Reference 9) b) Possible interference with an emergency response plan or emergency evacuation plan? ❑ ❑ ❑ X b. The facility must have approval of the Vernon Fire Department and Health Department far all hazardous materials used at the facility, and must maintain an Emergency Response Action Plan, and a Facility Response Plan to implement in the event of any emergency scenario. The facility also must maintain a hazardous materials inventory and business/contingency plan with the City of Vernon Health Department. These plans are in conformance with City of Vernon standards, and ensure that emergency response actions at the facility will not interfere with other emergency plans. c) The creation of any health hazard or potential health hazard? ❑ ❑ X El c. The project will not create any potential for health hazard. Similar operations have occurred the facility for 80 years, and have resulted in no cases of health impact. Compliance with California Code of Regulations, Title 22, §66264 ensures that hazardous waste is properly managed, compliance with SCAQMD Rules and Regulations ensures that health hazards from air emissions are insignificant, employee exposure to health hazards is minimized by compliance CalOSHA regulations contained in California Code of Regulations, Title 8, §5216. (Reference 6 and Reference 9) d) Exposure of people to existing sources of potential health hazards? ❑ ❑ X ❑ d. The project will not expose the public to existing sources ofpotential health hazards. At the request of the City of Vernon, soil sampling and analysis was conducted on August 22, 2001 at eleven locations one foot below ground surface at the facility to determine the presence of contaminated soil at the site due to historic operations. The sample analysis indicated the presence of small quantities of lead above the regulatory thresholds in one area underneath former Melting Pot 2 and all other sample analyses indicated lead in quantities consistent with background concentrations of lead in native soil. Soil in the affected area was removed prior to any grading activities. Confirmatory sampling at two feet below ground surface indicated lead concentrations far below the Preliminary Remediation Goal of 750 mglkg established by the U.S. EPA Region IX. The analytical results were submitted to City of Vernon Department of Health and it was determined that no further action was necessary. The entire site will be covered with concrete or asphalt, therefore, there will be no complete exposure pathway related to any residual soil impacts. (Reference 10 and Reference H) -8- i e) Increased fire hazard in areas with flammable brush, grass, or tees? ❑ ❑ ❑ X e. The proposed site is located in a completely built -out urbanized area that does not contain flammable grass, brush, or trees. X. NOISE. Would the proposal result in: a) Increases in existing noise levels? ❑ ❑ ❑ X b) Exposure of people to severe noise levels? ❑ ❑ ❑ X a and b. The project is within an industrial area and the surrounding manufacturing and warehousing uses are not noise sensitive. The facility operations subsequent to the reconstruction will be consistent with historic operations, thus there is no potential for increased noise from the project. Normal operations within the facility include tractors exiting and entering the facility, and the use of an electric fan to provide sufficient airflow to operate the air pollution control system. These operations are not expected to cause any significant noise impacts. (Reference 2 — p. 16) M. PUBLIC SERVICES. Would the proposal have an effect upon, or result in a need for new or altered government services in any of the following areas: a) Fire protection? 0 ❑ ❑ X b) Police protection? 0 0 ❑ X c) Schools? ❑ 0 ❑ X a through c. The project will be located in a highly industrialized and developed area. The proposed project will not pose a need for new or altered fire, police or school services within the City of Vernon. d) Maintenance of public facilities, including roads? ❑ ❑ ❑ X d. The facility shall be required to maintain all materials on -site and prevent any of -site migration of trash or materials, unless hauled off by a refuse company. During operation, the site shall be maintained to prevent any impacts to the maintenance of public facilities. Therefore, there will be no significant impact to public facilities. e) Other governmental services? 0 1❑ ❑ X e. No impact on governmental services will result. XII. UTILITIES AND SERVICE SYSTEMS. Would the proposal result in a need for new systems, or substantial alterations to the following utilities: a) Power or, natural gas ❑ ❑ X ❑ a. The gas use at the facility has historically averaged approximately 3,880 therms per month, and electricity use has averaged approximately 10, 000 Kilowatts of electricity per month. No significant increase in energy demand is anticipated from the project. Sufficient infrastructure is in place in the City of Vernon to afford a la s slight increase in power consumption at the facility. There will be no impact to the City of Vernon Utilities Department. (Reference 3) b) Communications systems? ❑ ❑ ❑ X b. The proposed site will be served by existing communication systems. The telephone, cable, and other communication systems are adequate and available to serve the proposed site. No need for new communication systems are required to serve the proposed site. (Reference 3) c) Local or regional water treatment or distribution facilities? d) Sewer or septic tanks? e) Storm water drainage? f) Solid waste disposal? ❑ a ❑ X ❑ ❑ ❑ X ❑ ❑ ❑ X ❑ ❑ ❑ X c. through E The site was previously served with water, sewer, and storm water drainage utilities and service will continue with the proposed site. All mainlines are in place and the proposed operation will not require any additional services beyond those presently offered The proponent will provide their own refuse pickup. Therefore, there will be no impact. (Reference 3) XIII. AESTHETICS. Would the proposal: a) Affect a scenic vista or scenic highway? ❑ 0 ❑ X b) Have a demonstrable negative aesthetic effect? ❑ ❑ ❑ X a and b. The project is in an area that is extensively urbanized with industrial buildings and accessory structures, and does not provide any scenic vista open to the public. Therefore, the proposed project will create no impact. c) Create light or glare? ❑ ❑ ❑ X c. The site is located in an industrial area and lighting of facilities is common, therefore no impacts from light are anticipated. The facility is not expected to create any impact from glare. Therefore, the proposed project will create no impact. XIV. CULTURAL RESOURCES. Would the proposal: a) Disturb paleontological resources? ❑ ❑ ❑ X b) Disturb archaeological resources? ❑ ❑ ❑ X a and b. The project is on a site that has been developed for many years. The project will not involve extensive excavation beyond grading to the foundation, so the potential for disturbing previously unencountered archaeological resources is remote. Therefore, the project will create no impact. (Reference 2, p. 20) c) Affect historical resources? ❑ ❑ ❑ X c. The extent of excavation for the project is limited to a foundation with no extensive underground features, so the chance of unearthing any historical resource is remote. Therefore, the proposed project will create no impact. The project area is highly industrialized; no known unique ethnic cultural resources, or religious or sacred uses exist in the project area. Therefore, there will be no impact. The project will not result in an increase in residential population in Vernon. No impact on the demand for recreation opportunities is anticipated. No parks or recreation facilities exist on the project site nor is one planned on the site. XVI. MANDATORY FINDINGS OF SIGNIFICANCE. a) Does the project have the potential to degrade the quality of the environment, substantially reduce the habitat of a fish or wildlife species, cause a fish or wildlife population to drop below self-sustaining levels, threaten to eliminate a plant or animal community, reduce the number or restrict the range of a rare or endangered plant or animal or eliminate important examples of the major periods of California history or prehistory? ❑ ❑ ❑ X a. The City of Vernon is primarily made up of industrial and distribution type facilities with limited plant life. Plant life is limited to non-native and ornamental species which are used for landscaping. Animal life in Vernon and nearby urban communities consists of bird, reptile and mammal species that live in close proximity to man. There are no endangered species in Vernon. The site is an existing facility and there is no potential for fording important examples of major periods of California history. Therefore, the proposed project will create no impact. (Reference 2, p.8-10) b) Does the project have the potential to achieve short -tern, to the disadvantage of long-term, environmental goals? ❑ ❑ ❑ X b. There will be no impact on long-term environmental goals. c) Does the project have impacts that are individually limited, but cumulatively considerable? On August 8, 2001 P. Kay Metal's manufacturing building and equipment was damaged in a fire. The project consists of replacing the fire damaged building and equipment lost in the fire. The proposed project is consistent with the City of Vernon Comprehensive Zoning Ordinance and the City of Vernon General Plan. FINDINGS: The City Council of the City of Vernon has determined that this project will not have a significant effect on the environment.
