A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
VERNON AMENDING APPENDIX NO. 1 OF RESOLUTION NO.
4733, AS AMENDED BY RESOLUTION NOS. 5255, 5478,
5505, 5853, 5923 AND 6858, WHICH ADOPTED A CONFLICT
OF INTEREST CODE THAT INCORPORATED BY REFERENCE THE
STANDARD MODEL CONFLICT OF INTEREST CODE OF THE
FAIR POLITICAL PRACTICES COMMISSION
WHEREAS, on June 17, 1980, the City Council of the City of
Vernon adopted Resolution No. 4733, which provided for a Conflict of
Interest Code that incorporated by reference the standard model
Conflict of Interest Code of the Fair Political Practices Commission;
land
WHEREAS, Resolution Nos. 5255, 5478, 5505, 5853, 5923 and
6858 adopted on March 18, 1986, March 15, 1988, April 26, 1988,
November 20, 1990, May 7,.1991 and October 1, 1996, respectively,
amended Resolution No. 4733, including Appendix No. 1 thereof; and
WHEREAS, in accordance with Government Code Sections 87306
and 87306.5, the Conflict of Interest Code has been reviewed; and
WHEREAS, the City Council of the City of Vernon has deleted,
added and/or modified certain job titles and wishes to amend its
Conflict of Interest Code to reflect current positions for designated
employees required to report financial interests under designated
disclosure categories; and
WHEREAS, City staff have determined that for clarification
purposes Appendix No. 2 of Resolution No. 4733 should be combined with
Appendix No. l and, therefore, Appendix No. 2 should be deleted; and
WHEREAS, by letter dated September 25, 2002, Bruce V.
Malkenhorst, City Administrator/City Clerk, has recommended that the

1 Conflict of Interest Code be amended.
2 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
3 CITY OF VERNON AS FOLLOWS:
4 SECTION 1: The City Council of the City of Vernon hereby
5 finds and determines that the recitals contained hereinabove are true
6 and correct.
7 SECTION 2: The City Council of the City of Vernon hereby
8 amends Appendix No. l of Resolution No. 4733, as amended by Resolution
9 Nos. 5255, 5478, 5505, 5853, 5923 and 6858, as set forth in Appendix
10 No. l which is attached hereto as Exhibit "A" and made a part hereof.
11 SECTION 3: The City Council of the City of Vernon hereby
12 deletes Appendix No. 2 of Resolution No. 4733.
13 SECTION 4: In all other respects, Resolution Nos. 4733,
14 5255, 5478, 5505, 5853, 5923 and 6858 shall remain in full force and
15 effect and the provisions in Resolution Nos. 4733, 5255, 5478, 5505,
16 5853, 5923 and 6858 not consistent with or in conflict with this
17 resolution are hereby repealed.
18 SECTION 5: The City Clerk of the City of Vernon shall
19 certify to the passage of this resolution, and thereupon and
20 thereafter the same shall be in full force and effect.
21 APPROVED AND ADOPTED this 9th day of October, 2002.

1 Administrator and the City Attorney, disclosures shall be made to the
2 Fair Political Practices Commission in accordance with its procedures
3 and not with the City Clerk of the City of Vernon.
4 ** With respect to Consultants, the Department Head may
5 determine, in writing, that a particular Consultant is hiredto
6 perform a range of duties that are limited in scope and thus is not
7 required to comply with the disclosure requirements described in these
8 categories. Such determination shall include a description of the
9 Consultant's duties and, based upon that description, a statement of
10 the extent of disclosure requirements. The Department Head shall
11 forward a copy of this determination to the City Council. Nothing
12 contained herein excuses any such Consultant from any other provision
13 of this Conflict of Interest Code.
14 When a designated employee is required to disclose
15 investments and sources of income, he need only disclose investments
16 in business entities and sources of income which do business in the
17 jurisdiction, plan to do business in the jurisdiction or have done
18 business in the jurisdiction within the past two years. In addition
19 to other activities, a business entity is doing business within the
20 jurisdiction if it owns real property within the jurisdiction. When a
21 designated employee is required to disclose interests in real
22 property, he need only disclose real property which is located in
23 whole or in part within or not more than two miles outside the
24 boundaries of the jurisdiction or within two miles of any land owned
25 or used by the local government agency.
26 Designated employees shall disclose their financial
27 interests pursuant to the appropriate disclosure category as indicated
28 below.

SECTION 1: Appendix No. 1 of Resolution No. 4733, as
amended by Resolutions Nos. 5255, 5478, 5505, 5853 and 5923 shall
be amended as set forth in the Appendix No. 1 which is attached
hereto and made a part hereof as though fully set forth at length.
1 SECTION 2: In all other respects, Resolutions Nos. 4733,
2 5255, 5478, 5505, 5853 and 5923 shall remain in full force and
3 effect and the provisions in Resolutions Nos.. 4733, 5255, 5478
4 5505, 5853 and 5923 not consistent with or in conflict with this
5 resolution are hereby repealed.
6 SECTION 3: The City Clerk of the City of Vernon shall
7 certify to the passage of this resolution and thereupon and
