A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
VERNON FINDING AND DETERMINING THAT THE PUBLIC
INTEREST,,AND NECESSITY REQUIRE THE ACQUISITION OF
CERTAIN REAL PROPERTY FOR THE EXTENSION OF 26T"
STREET IN THE CITY OF VERNON
WHEREAS, the City has given written notice at least fifteen
(15) days prior to the date of this resolution to those persons whose
property is to be acquired by eminent domain; and
WHEREAS, the City's notice was sent to those persons by
facsimile and first class mail; and
WHEREAS, the City's notice to those persons sets forth the
intent of the City Council to adopt the resolution, and further
provides that such persons shall have the right to appear and be heard
on the matters referred to in Code of Civil Procedure Section 1240.030.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF VERNON AS FOLLOWS:
SECTION 1: The City Council of the City of Vernon hereby
finds and determines that he recitals contained hereinabove are true
and correct.
SECTION 2: That the public interest and necessity require
the acquisition of the real property legally described in Exhibit "A,"
which is attached hereto and incorporated herein by this reference, for
a public use and improvement, to wit: for the extension of 26th Street
in connection with the I-710 Bandini Interchange Project and all uses
appurtenant thereto.
SECTION 3: The City finds and determines that:
1 (a) The public interest and necessity require the project;
2 and
3 (b) The project is planned or located in the manner that
4 will be most compatible with the greatest public good and the least
5 private injury; and
6 (c) The property sought to be acquired is necessary for the
7 project; and
8 (d) The offer required by Section 7267.2 of the Government
9 Code has been made to the owner or owners of record.
10 SECTION 4: The City is authorized and empowered to acquire
11 by condemnation in its name in accordance with Section 19 of Article I
12 of the California Constitution, Section 37350.5 of the California
13 Government Code, and Sections 1240.010 through 1240.050 and 1240.610
14 of the California Code of Civil Procedure.
15 SECTION 5: With respect to any of the real property
16 described on Exhibit "A`, or interest in real property, which is or
17 may be appropriated to a public use, the use for which the City seeks
18 to acquire said property or interest therein is a more necessary
19 public use than the use to which said property interest is or may be
20 appropriated. Reference is made to Code of Civil Procedure Section
21 1240 610.
22 SECTION 6: That the City Attorney is hereby authorized and
23 directed to prepare, institute and prosecute in the name of the City
24 in such proceedings, in the proper court having jurisdiction thereof,
25 as may be necessary for the acquisition of the interests to said
26 property. Said attorney is specifically authorized to take whatever
27 steps and/or procedures are available to him under the Eminent Domain
28 Law of the State of California (Code of Civil Procedure, Title VII,
Chapters 1-12, Sections 1230.010-1273.050).
SECTION 7: The City Clerk of the City of Vernon shall
certify to the passage of this resolution and thereupon and thereafter
the same shall be in full force and effect.

With regard to the $323,222.00 check for the relocation costsl26t" street, Kevin should be signing
the acknowledgement. The Amendment to the Agreement, which obligated the City to pay these
costs, was approved on 10-23-02. The relocation costs were then approved on 11-6-02 (1 am not
sure of the date, but I know it was approved). The acknowledgment is simply a request by SCE
that the city verify that it has been made aware of the process. Since it is addressed to Kevin and
he is overseeing this process, it is appropriate for him to respond. You can send the check with
the acknowledgement/RW File Copy of the letter.

IN THE CITY OF VERNON
The City of Vernon will conduct a Public Hearing which
you may attend.

DATE AND TIME: Wednesday, December 4, 2002, at 5:00
p.m., or as soon thereafter as the
matter may be heard
PURPOSE: To consider a resolution of necessity
to acquire certain real property for
the extension of 26th Street in the City
of Vernon.
Any interested person may attend and may make an oral
presentation to the City Council at the time of the
hearing, or may present written comments prior to the
hearing on matters referred to in Section 1240.030 of the
Code of Civil Procedure.
If you challenge the approval of the resolution of
necessity or any provision thereof in court, you may be
limited to raising only those issues you or someone else
raised at the hearing described in this notice or in
written correspondence delivered to the City of Vernon at,
or prior to, the meeting.
