RESOLUTION NO. 8088
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF VERNON ACCEPTING THE BID OF CODY
ENGINEERING, INC. FOR THE SEVILLE AVENUE
SEWER MAIN REPLACEMENT IN ACCORDANCE WITH
CONTRACT NO. 565 OF THE CITY OF VERNON
AND APPROVING THE EXECUTION OF SAID CONTRACT
WHEREAS, Contract No. 565 of the City of Vernon was
approved by the City Council of the City of Vernon pursuant to
IlResolution No. 8059, and sealed bids were opened on October 1,
II2002; and
WHEREAS, said bids were referred to Samuel Kevin
Wilson, Director of Community Services & Water, who has reported
to the City Council under the date of October 16, 2002,
recommending that Contract No. 565 for the Seville Avenue Sewer
Main Replacement be executed with Cody Engineering, Inc. on the
basis of its bid in the sum of two hundred forty three thousand
four hundred and forty dollars and no cents ($243,440.00), being
the lowest responsible bid meeting the contract requirements.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF VERNON AS FOLLOWS:
SECTION 1:
The City Council of the City of Vernon
hereby finds and determines that the recitals contained
hereinabove are true and correct.
SECTION 2: The City Council of the City of Vernon
does hereby award Contract No. 565 to Cody Engineering, Inc. in
accordance with the recommendation of Samuel Kevin Wilson,
Director of Community Services & Water, and authorizes the Mayorl
land City Clerk to execute said Contract on behalf of the City.

SECTION 3: All other bids are rejected subject to
execution of the contract and the City Treasurer is hereby
directed to return unsuccessful bidders any cashier or certified
checks deposited with said bids upon the receipt of an executed
contract from Cody Engineering, Inc. accompanied by all required
bonds and certificates.
SECTION 4: The City Clerk of the City of Vernon
shall certify to the passage of this resolution and thereupon
and thereafter the same shall be in full force and effect.
APPROVED AND ADOPTED this 23rd day of October 2002.

The Seville Avenue Sewer Main Replacement is a part of the proposed Malburg Generating
Station Construction Project. The replacement of the existing sewer to a larger sewer pipe size along
Seville Avenue between 50th Street and Fruitland Avenue is required to accommodate the increased
wastewater discharge from the proposed Malburg Generating Station. This project was budgeted for
$220,000.00 in FY 2002/2003 in the Utilities Department budget. However, the lowest bid price is
$243,440.00, which is approximately 10% over the budgeted amount because of the small size of the
project, short length of sewer pipe to be installed and the rising costs of overhead, general liability
insurance, labor, material and equipment.

City staff has determined that of the eleven submitted bids, Cody Engineering Inc., is the
lowest responsible bidder. The bid submitted by Cody Engineering Inc. was complete and the
company's contractor license was verified to be in good standing with the State Contractor's License
Board. The contractor has completed three recent sewer projects for other cities and the references
investigated by City Staff were found to be positive and favorable. Therefore, City Staff
recommends the City Council award this contract to Cody Engineering Inc. on the basis of their bid
of $243,440.00.
