A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
3 VERNON AMENDING RESOLUTION NO. 8007 BY AMENDING
SECTION 22, PAGE 7 OF SCHEDULE II (EXHIBIT "B")
4 AND SCHEDULE III (EXHIBIT "C")'OF SAID RESOLUTION
WHICH FIXED THE COMPENSATION FOR CERTAIN EMPLOYEES
5 OF SAID CITY AND AUTHORIZED CERTAIN EXPENSE
6 ALLOWANCES
7 WHEREAS, on July 3, 2002, Resolution No. 8007 wAs adopted by
8 the City Council of the City of Vernon to be effective on July 1,
9 2002; and
10 WHEREAS, on November 12, 2002, the Finance Committee
11 recommended that the City Council approve the recommendation of Bruce
12 V. Malkenhorst, Director of Finance, dated November 6, 2002, that
13 Resolution No. 8007 be amended to reflect a monthly incentive pay for
14 the positions of Battalion Chief (Training Officer) and Administrative
15 Captain in the Fire Department and the elimination of an auto
16 allowance for the position of Battalion Chief (Training Officer); and
17 WHEREAS, on November 12, 2002, the Finance Committee
18 recommended that the City Council approve the recommendation of Bruce
19 V. Malkenhorst,-Director of Finance, dated November 7, 2002, that
20 Resolution No. 8007 be amended to create the position of Electric
21 Service Planner Trainee in the Utilities Department with the
22 appropriate one-step salary scale; and
23 WHEREAS, the City Council of the City of Vernon wishes to
24 amend Resolution No. 8007 by (i) amending Section 22 to provide for
25 incentive pay for certain positions in the Fire Department; (ii)
26 amending page 7 of Schedule II (Exhibit "B") to establish the
27 classification and one-step salary scale for Electric Service Planner
28 Trainee in the Utilities Department; and (iii) amending Schedule III
1 ("C") to eliminate the automobile allowance for the position of
2 Battalion Chief (Training Officer).
3 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
4 CITY OF VERNON AS FOLLOWS:
5 SECTION 1: The City Council of the City of Vernon hereby
6 finds and determines that the recitals contained hereinabove are true
7 and correct.
8 SECTION 2: Effective December 1, 2002, page 7 of Schedule
9 TI, Exhibit "B" of Resolution No. 8007 is hereby amended to create the

10 position and salary scale for the position of Electric Service Planner
11 Trainee as indicated on the amended page 7 which is attached hereto
12 and made apart hereof as Exhibit "A."
13 SECTION 3: Effective December 1, 2002, Schedule III,
14 Exhibit "C" of Resolution No. 8007 is hereby amended to eliminate the
15 automobile allowance of the Battalion Chief (Training Officer)
16 position as indicated on the amended Schedule III which is attached
17 hereto and made a part hereof as Exhibit "B."
18 SECTION 4: Effective December 1, 2002, subsection (i) is
19 hereby added to Section 22 of Resolution No. 8007 to read as follows:
20 (i) Incentive Compensation.
21 Battalion Chief (Training Officer) and Administrative
22 Captain shall receive incentive pay of five percent (5%) of the
23 employee's base monthly salary, excluding all other compensation.
24 SECTION 5: The provisions of Resolution No. 8007, 8025,
25 8034 and 8048 not consistent with or in conflict with this resolution
26 are hereby repealed; in all other respects, Resolution Nos. 8007, as
27 amended by Resolution Nos. 8025, 8034 and 8048 shall remain in full
28 force and effect.

1 SECTION 6: The City Clerk of the City of Vernon shall
2 certify to the passage of this resolution, and thereupon and
3 thereafter the same shall be in full force and effect.

The Fire Chief is requesting that a five (5) percent incentive pay per
month of their base salary for both the Battalion Chief Training
Officer and the Administrative Captain be approved to offset the loss
of Fair Labor Standard Act (FLSA) pay and the increased commuting cost
associated with the change from fifty-six (56) hours to forty (40).
The Fire Chief is also requesting to eliminate the current $125.00 per
month auto -allowance for the Battalion Chief Training Officer. This
has been reviewed by staff and it is hereby recommended that
Resolution No. 8007 be amended to reflect the above mentioned changes.

The Utilities Department has advertised to hire for the Electric

is requesting that a new position be created, Electric Service Planner
Trainee, and establish a one-step salary scale, Step 1 $3,442.00, to
allow the department to train a potential candidate. This has been
reviewed by staff and it is hereby recommended that an amendment to
Resolution No. 8007 be approved to incorporate the new position and
establish a one-step salary of $3,442.00.

Per our conversation, following is a discussion concerning the open Electric Service
Planner position.
We have advertised for this position for a period of time and have been unable to find a
well -qualified candidate to fill the position. Therefore, I believe the organization will be
better served by training an existing employee. I also believe that Jose Ortiz Villa,
Information Technology Specialist II, is very capable of performing all of the
requirements of this position with the proper training, which should take approximately
one year, and will likely be a valuable long-time Vernon employee.
To accomplish this, I recommend the following effective December 1, 2002:
• create an Electric Service Planner Trainee position and
• reclassify Jose Ortiz Villa, Information Technology Specialist II, Step 9 to
Electric Service Planner Trainee, Step 1 (See attachment).

This memo is in reference to our conversation earlier this date regarding the
implementation of a five (5) percent monthly stipend for both the Battalion Chief -
Training and the Administrative Captain positions in the Fire Department.
This stipend will offset the loss of FL�SAay and increased commuting costs
associated with the change from 56-h urur week.
ACTION: Implement a monthly stipend in the amount of 5% of base salary for the
Battalion Chief -Training (Andrew Guth) and the Administrative Captain (Rory Moore)
