Resolution No. 8107RESOLUTION NO. 8107 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON ACCEPTING THE BID OF SOPP CHEVROLET ON BID NO. 1417 FOR THE PURCHASE OF ONE 2003 CHEVROLET TAHOE LT VEHICLE FOR THE POLICE DEPARTMENT AND APPROVING AND AUTHORIZING THE EXECUTION OF A VEHICLE PURCHASE CONTRACT AND THE ISSUANCE OF A PURCHASE ORDER RESPECTING SAID BID WHEREAS, the Police Department requires an additional vehicle to be used in a Cargo Theft Intervention Program being developed with other law enforcement agencies for the purpose of investigating and recovering stolen cargo; and WHEREAS, pursuant to Resolution No. 8069 adopted by the City Council of the City of Vernon on October 9, 2002, the City Clerk was directed to give notice inviting sealed proposals or bids for the purchase of a new 2003 Chevrolet Tahoe vehicle in accordance with a bid specification provided by the Police Department; and WHEREAS, based upon the bid specification, the Purchasing Department prepared Bid No. 1417 dated October 22, 2002, and proceeded to solicit bids for the purchase of the Chevrolet Tahoe vehicle; and WHEREAS, sealed bids for Bid No. 1417 were opened on November 6, 2002 and reviewed by the Police Department; and WHEREAS, by letter dated November 12, 2002, Bruce V. Malkenhorst, City Administrator/City Clerk, recommended that Bid No. 1417 be awarded to Sopp Chevrolet, the lowest responsible bidder meeting the requirements of Bid No. 1417. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF VERNON AS FOLLOWS: SECTION 1: The City Council of the City of Vernon hereby 1 finds and determines that the recitals contained hereinabove are true 2 and correct. 3 SECTION 2: The City Council of the City of Vernon hereby 4 awards Bid No. 1417 to Sopp Chevrolet and accepts and approves the 5 Vehicle Purchase Contract, a copy of which is attached hereto as 6 Exhibit "A" and made a part hereof. 7 SECTION 3: The City Council of the City of Vernon hereby 8 authorizes the Mayor and the City Clerk to execute the Vehicle Purchase 9 Contract on behalf of the City and authorizes the issuance of a 10 purchase order for the purchase of a 2003 4-door Chevrolet Tahoe LT 11 vehicle pursuant to Bid No. 1417. 12 SECTION 4: The City Council of the City of Vernon hereby 13 directs the City Clerk, or his designee, to send one fully executed 14 Contract to: 15 Sopp Chevrolet 16 Attn: Steve Ferraro 6400 South Atlantic Avenue 17 Bell, CA 90201 18 SECTION 5 All other bids in connection with Bid No. 1417 19 are rejected, subject to execution of the aforesaid contract documents 20 from Sopp Chevrolet accompanied by all required certificates. 21 SECTION 6: The City Clerk of the City of Vernon shall 22 certify to the passage of this resolution, and thereupon and thereafter 23 the same shall be in full force and effect. 24 APPROVED AND ADOPTED this 20th day of November, 2002. 25 'ter G � -ZEONI S C. . Sopp & Son dba A SOPP CHEVROLET (hereinafter referred to as "Sopp Chevrolet") 6400 South Atlantic Avenue Bell, CA 90201 WHEREAS, the City of Vernon Police Department requires an additional vehicle to be used in a new law enforcement program; and WHEREAS, the City requires a 2003 4-door Chevrolet Tahoe LT vehicle for its use; and WHEREAS, on October 22, 2002, the City issued Bid No. 1417 which set forth specifications for the new 2003 4-door Chevrolet Tahoe LT vehicle required by the City including the City's "CTIP" specifications; and WHEREAS, on November 5, 2002, Sopp Chevrolet responded to Bid No. 1417; and WHEREAS, the City has accepted Sopp Chevrolet's bid and desires to purchase the new 2003 4-door Chevrolet Tahoe LT vehicle from Sopp Chevrolet. ,1 NOW, THEREFORE, THE PARTIES HERETO DO MUTUALLY AGREE AS SET 2 FORTH HEREIN: 3 1. Purchase. Sopp Chevrolet agrees to sell to the City 4 one new 2003 4-door Chevrolet Tahoe LT vehicle, that meets the 5 specifications contained in City of Vernon Bid No. 1417, dated October 6 22, 2002, and that is consistent with Sopp Chevrolet's Bid of 7 November 5, 2002 (collectively referred to as the "Bid Documents"). A 8 copy of the Bid Documents are attached hereto as Exhibit "A" and 9 incorporated herein by reference 10 2. Price. Consistent with its Bid, Sopp Chevrolet 11 agrees to sell and deliver, subject to final inspection by the City, 12 one new 2003 4-door Chevrolet Tahoe LT vehicle for the total sum of 13 Thirty Thousand Three Hundred Fifty Dollars and No Cents ($30,350.00), 14 plus sales tax of Two Thousand Five Hundred Three Dollars and Eighty- 15 seven Cents ($2,503.87). 16 3. Payment Terms. The City agrees to pay Sopp Chevrolet 17 a total $30,350.00, plus sales tax of $2,503.87, for the purchase of 18 the vehicle. Payment will be made within thirty (30) days net of 19 receipt of the vehicle. 20 4. Warranties. All manufacturers' warranties, and any 21 other warranties made applicable by law, shall apply to the City's 22 purchase of the above -referenced vehicles. 23 5. General Provisions. 24 A. Governing Law. The laws of the State of 25 California shall govern the rights, obligations, duties and 26 liabilities of the parties to this Contract and shall also govern the 27 interpretation of this Contract. 28 B. Notices.
