RESOLUTION NO. 8125
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
VERNON RATIFYING THE ISSUANCE OF BID NO. 1419,
REJECTING THE BID RECEIVED FOR SAID BID AND
APPROVING AND AUTHORIZING NOTICE INVITING SEALED
PROPOSALS OR BIDS FOR THE PURCHASE OF A BACKUP
GENERATION SYSTEM AT BOOSTER PLANT 3 FOR THE
COMMUNITY SERVICES & WATER DEPARTMENT
WHEREAS, on October 9, 2002, the City Council of the City of
Vernon approved Resolution No. 8086 authorizing the issuance of a
Request for Proposal for the purchase of a backup power generation
system at Booster Plant 3 located at 3381 Fruitland Avenue; and
WHEREAS, subsequently, City staff issued Bid No. 1419 on
October 24, 2002; and
WHEREAS, only one bid was received in response to the
advertisement and City staff desires to solicit bids a second time to
obtain the best competitive price possible; and
WHEREAS, by letter dated December 9, 2002, Bruce V.
Malkenhorst, City Administrator/City Clerk, recommended that Bid No.
1419 be ratified, the bid of Duthie Power Services be rejected and
that authority be granted for the Purchasing Agent, or his designee,
to seek formal bids for the purchase of a backup power generation
system at Booster Plant 3; and
WHEREAS, the City Council of the City of Vernon desires to
ratify the Purchasing Department's issuance of Bid No. 1419 and to
reject the bid by Duthie Power Services; and
WHEREAS, the bid specification for the backup power
generation system at Booster Plant 3 with a new bid number is
submitted herewith for reconsideration; and

WHEREAS, pursuant to Section 2.27 of the Code of the City of
Vernon, the City Council of the City of Vernon finds and determines
that it is in the public interest and necessity that the bid received
for Bid No. 1419 be rejected and new bids or proposals be solicited in
accordance with applicable State law and the Vernon City Code.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF VERNON AS FOLLOWS:
SECTION 1: The City Council of the City of Vernon hereby
finds and determines that the recitals contained hereinabove are true
and correct.
SECTION 2: The City Council of the City of Vernon hereby
ratifies the Purchasing Department's issuance of Bid No. 1419.
SECTION 3: The City Council of the City of Vernon hereby
rejects the bid received for Bid No. 1419.
SECTION 4: The bid specification, which is attached hereto
as Exhibit "A" and made a part hereof, is hereby approved by the City
Council of the City of Vernon.
SECTION 5: The City Clerk of the City of Vernon is hereby
directed to give notice, in writing, inviting sealed proposals or bids
for the purchase of the backup power generation system at Booster
Plant 3, in accordance with the bid specification, and in accordance
with this resolution.
SECTION 6: There being no newspaper of general circulation
printed, published or circulated in the City of Vernon, the City Clerk
is hereby directed to post said notice, or cause the same to be
posted, in three of the most public places in the City of Vernon, to
wit: the northwest corner of 38t" Street and Santa Fe Avenue, the
northeast corner of Leonis Boulevard and Pacific Boulevard, and on the

bulletin board in the lobby of the City Hall of the City of Vernon,
located at 4305 Santa Fe Avenue, in said City.
SECTION 7: The City Clerk of the City of Vernon is hereby
directed to post said notice forthwith and the first posting of said
notice shall be at least ten (10) days before the opening of the bids
for the proposed contract. Said notice shall provide that sealed
proposals or bids will be received by the City of Vernon at the office
of the City Clerk, or his designee, at the City Hall, 4305 Santa Fe
Avenue, Vernon, CA 90058-0805.
SECTION 8: The City Clerk of the City of Vernon shall
certify to the passage of this resolution, and thereupon and
thereafter the same shall be in full force and effect.

The City of Vernon Water Department hereby solicits proposals for the installation of a
backup power generation system. This system will serve Booster Plant 3 located at 3381
Fruitland Avenue. The generation, unit will be used to run five booster motors in addition
to auxiliary equipment related equipment.
The City has calculated the approximate required capacity of the generator to meet the
load from the booster motors. If your calculations indicate that a different size is needed,
please indicate as such on the bid and provide details on how the sizing was performed.
In addition, provide complete details on installation requirements, such as access
clearance, and height restrictions.
Before the contract is awarded, the City of Vernon requires the contractor to provide
proof of insurance, including a standard certificate of insurance, in at least the amounts
and coverage indicated on the insurance schedule. In addition to the standard certificate
of insurance, proof of general and umbrella liability coverage shall also be furnished in
the form indicated on the attached insurance schedule (Exhibit A).
BID ITEMS
ITEM 1: Provide and install a new Generic 30OKW diesel generator and 1,750 fuel
tank per attached specifications.

• Factory Test Procedures and Requirements
1. Factory test shall be witnessed by a City of Vernon representative during City of
Vernon normal business hours (Mon — Thurs. 7.00 — 5:30 p.m.). Test shall consist of
manufactures normal factory test, which should simulate all shutdowns. Also a
demonstration of the 0 to full load pickup test of voltage and frequency regulation
using a resistive load bank and recorded by a strip chart recorder. A City of Vernon
representative shall witness the calibration of the strip chart recorder before the test.
The test shall also consist of a l-hour full load run.
2. Field test to be performed by manufacturer and witnessed by a City of Vernon
representative during City of Vernon normal working hours (Mon — Thurs. 7:00 a.m.
— 5:30 p.m.).
3. Permits: Engine is to be pre -approved by the South Coast Air Quality Management
District (SCAQMD) for operation within the area of jurisdiction. The City will
secure all permits and licenses pertaining to SCAQMD and local ruling agency for
the installation of the equipment. Provide information on the compliance of the
equipment with SCAQMD standards.
4. Delivery of unit after receipt of approval submittal to be a maximum of 12 weeks.

On October 9, 2002, this legislative body approved Resolution No.
8086, authorizing the issuance of Request for Proposal for the
purchase of a Backup Generation System at Booster Plant 3. Three
requests were mailed out. By November 21, 2002, only one proposal was
received from Duthie Power Services at a cost of $99,383.00. At this
time, the Purchasing Section is requesting authorization to seek
formal bids to ensure that the City obtains the best competitive price
available.
It is hereby recommended that the Purchasing Section be authorized to
seek formal bids for the purchase of a Backup Generation System for
Booster Plant 3.

As per Resolution #8086, the Purchasing Department sought formal bids for the
purchase of a Backup Power Generation System at Booster Plant 3 for the
Community Services Department. On October 24, 2002, three bids were mailed out.
On November 21 2002 only one bid from Duthie Power Services was received.
In order to ensure that the City is getting the best competitive price possible,
Purchasing requests authorization to solicit bids a second time. A new roster of
vendors will be selected, in addition to the sole respondent Duthie Power Services.
