A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
VERNON GRANTING THE DISABILITY RETIREMENT OF LARRY
J. WEAVER, A LOCAL SAFETY MEMBER EMPLOYED BY THE
CITY OF VERNON (Government Code Sections 21154 and
21156)
WHEREAS, the City of Vernon (hereinafter referred to as
"Agency") is a contracting agency of the Public Employees' Retirement
System; and
WHEREAS, the Public Employees' Retirement Law requires that a
contracting agency determine whether an employee of such agency in
employment in which he/she is classified as a local safety member is
physically or mentally incapacitated to perform his/her duties for
purposes of the Public Employees' Retirement Law; and
WHEREAS, on or about August 2, 2002, Larry J. Weaver,
employed by the Agency in the position of Administrative Fire Captain
in the Vernon Fire Department, filed an application for industrial
disability retirement with the Public Employees' Retirement System
( PERS"); and
WHEREAS, on or about August 8, 2002, PERS requested the
Agency make a determination regarding whether Larry J. Weaver was
incapacitated for the performance of his duties and therefore eligible
to retire for disability; and
WHEREAS, by Minute Order on September 18, 2002, the Agency
approved advanced disability pension payments to Larry J. Weaver
employed by the Agency in the position of Administrative Fire Captain
in the Vernon Fire Department; and
-WHEREAS, by letter dated January 20, 2003, Bruce V.

Malkenhorst, City Administrator, notified Mr. Weaver that, based on the
findings contained in the medical reports, unless Mr. Weaver submitted
documentation to justify approval of his request for disability
retirement by the City Council, he would recommend.to the City Council
that the request be denied; and
WHEREAS, by letter dated February 4, 2003, the attorney for
Mr. Weaver, Donald M. Pekich, requested that the disability retirement
of Mr. Weaver be held in abeyance until such time as a supplemental
medical report was obtained substantiating Mr. Weaver's disability
retirement claim; and
WHEREAS, by letter dated March 31, 2003, Bruce V.
Malkenhorst, City Administrator/City Clerk, notified Mr. Weaver that
the matter of his disability retirement would be considered by the City
Council on April 2, 2003; and
WHEREAS, the City Council of the City of Vernon has reviewed
medical evidence and other evidence relevant to whether Mr. Weaver was
incapacitated.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF VERNON AS FOLLOWS:
SECTION 1: The City Council of the City of Vernon hereby
finds and determines that Larry J. Weaver is disabled within the
meaning of the Public Employees' Retirement Law from the performance
of his duties in the position of Administrative Fire Captain in the
Vernon Fire Department.
SECTION 2: The City Council of the City of Vernon hereby
finds and determines that such disabilities are industrial, in that they
are the result of injury or disease arising out of and in the course of
employment, that neither the City Council of the City of Vernon nor Mr.

SUBJECT: Application for Industrial Disability Retirement - Larry Weaver
Administration Fire Captain Larry Weaver applied for an Industrial Disability Retirement with
the Public Employees Retirement System (PERS) on August 2, 2002. PERS requested that the
City make a determination as to Captain Weaver's disability in a letter dated August 8, 2002 and
received by the City August 19, 2002. Larry Weaver submitted his intent to resign for purposes
of retirement in a letter dated August 14, 2002.
In accordance with Government Code Sections 21154 and 21156, the City is required to make a
determination as to Mr. Weaver's disability within six months of the request unless the local
safety member waives the requirements of this provision. (Government Code Section 21157).
The requirement was waived.
Mr. Weaver was hired by the City as a Firefighter on February 1, 1970. He became an
Administrative Fire Captain on April 16, 1995 and remained in that position until his retirement
effective October 5, 2002.
The medical report from Robert W. Hunt, M.D., substantiates Mr. Weaver's Industrial Disability
Retirement.
In this report, Dr. Hunt opines that Mr. Weaver does not retain the functional capacity to perform
his usual and customary duties as a Fireman and Fire Captain. He is unable to return to the job of
Administrative Captain, as the prolonged sitting at a desk and using a computer aggravates his
neck and bilateral upper extremity symptoms.
It is recommended that Council approve the Industrial Disability Retirement of Larry Weaver;
the disability is determined to be orthopedic; and the permanent and stationary date is December
11, 2001.

Please recall that Dr. Hunt was applicant's evaluating physjoian and that he was
utilized by applicant most recently to obtain a medical reporting to substantiate the
determination of applicant's entitlement to industrial disability retirement. Please
recall that that retirement is a condition of the overall disposition c)f this case_
I have received the Compromise and Release and Stipulated Findings f, Award
which I have signed and returned to applicant's counsel. It is my understam ling that
he will hand process that document at the Workers" Compensation Appeal:: Board,
This report of Dr. Hunt dated March 27, 2003 at page 12 indicates that apl-licant'is
not capable to return to work as a fire fighter or as a fire captain eve n in an

With that in mind, I believe this report substantiates the preliminary discussi ins with
Ms. Francone of the City at which time we discussed issuarn;e of deter -nit ation of
entitlement to industrial disability retirement.
It is my understanding that this matter is on the agenda for the City Council during

Dear Ms. Francone:
Please allow this letter to memorialize our telephone conversation of this date
reference current status of resolution of the workers' compensation claims and my
recommendation to you reference the issue of industrial disability retirement.
STATUS OF CLAIMS: As I indicated to you I confirmed with applicant's attorney's
office that applicant has indeed signed the Compromise and Release agreement and
has also signed the Stipulations with Request for Award.
Additionally, as you know applicant needed to be seen again in order to obtain a
medical report to substantiate your issuance of a determination of entitlement to
industrial disability retirement. I am advised that that evaluation took place on the
morning of March 3 and that the doctor has promised to have the report available to
Mr. Weaver's attorneys by the end of this week or early next week at the latest.
They will thereafter return the settlement documentation as well as the medical
report to me which I will then provide to you. The settlement documents will be
forwarded to the Workers' Compensation Appeals Board for action by the Judge.
RECOMMENDATION: It is my understanding that this matter is currently on your
City Council agenda for action on applicant's Application for Industrial Disability
Retirement. That it is scheduled as an agenda item for March 5.
It is my recommendation to you and to your Council that the matter be continued to
April 2, 2003. This will allow us to obtain the appropriate documentation and to

John Cardenas from the City Attorney's office contacted Martin Vega at Colen and Lee this
morning wanting to contact Larry's attorney, Donald M. Pekich of Cantrell, Green, Pekich, Cruz &
McCort. Why he wants to contact applicant's attorney at this late date I don't know but I am
concerned that he will complicate the settlement negotiations.
Pekich has demanded $135,355. to settle Larry's case. Our position is that we have already paid
what we owe and will pay nothing.
We know Larry wants an Industrial Disability Retirement and we are trying to use it as a
negotiating tool. Bruce, I have worked hard on this case to avoid paying that high demand. If
Cardenas wants any information he should contact John Tharp, our workers comp attorney, and
not Pekich. John Tharp has worked wonders for this City as workers comp law is his area of
expertise. That is all he does.

The City has reviewed your personnel file and any available workers'
compensation proceedings involving you. This review does not appear
to justify a determination by the City Council that you qualify for
disability retirement in accordance with Government Code Sections
21154 and 21156. At this time, based upon information we have in our
files, I will be recommending that the City Council deny your request.
The hearing before the City Council with respect to your request for
disability retirement has been scheduled on February 5, 2003. If you
desire to submit any additional evidence regarding medical
examinations or records, such information must be received by my
office no later than five days prior to the hearing date.
At the hearing, you will have the burden of proving that you are
substantially unable to perform your usual duties because of physical
or mental incapacity and that such incapacity is industrial. You may
be represented by counsel. Within thirty (30) days after conclusion
of the formal hearing, the City Council will make written findings of
fact and conclusions of law and render its determinations.
Pursuant to Government Code Section 21157, final determination by the
City with regard to your request for disability retirement must be
concluded within six (6) months of the City's receipt of your
application for disability retirement.
