Resolution No. 81544 i 1 RESOLUTION NO. 8154 2 3 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON ACCEPTING THE BID OF DON KOTT FORD ON BID 4 NO. 1425 FOR THE PURCHASE OF A 2003 FORD RANGER XLT SUPER CAB PICKUP TRUCK FOR THE COMMUNITYSERVICES & 5 WATER DEPARTMENT AND APPROVING AND AUTHORIZING THE 6 EXECUTION OF A VEHICLE PURCHASE CONTRACT AND THE ISSUANCE OF A PURCHASE ORDER RESPECTING SAID BID 7 8 WHEREAS, the Community Services & Water Department requires a 9 replacement vehicle for its water section staff when their normally 10 assigned trucks are unavailable because they are being serviced; and 11 WHEREAS, pursuant to Resolutign No. 8123 adopted by the City 12 Council of the City of Vernon on December 18, 2002, the City Clerk was 13 directed to give notice inviting sealed proposals or bids for the 14 purchase of a 2003 Ford Ranger XLT Super Cab Pickup Truck ("Ford 15 Ranger") in accordance with a bid specification provided by the 16 Community Services & Water Department; and 17 WHEREAS, based upon the bid specification, the Purchasing 18 Department prepared Bid No. 1425 dated January 7, 2003, and proceeded 19 to solicit bids for the purchase of the Ford Ranger; and 20 WHEREAS, sealed bids for Bid No. 1425 were opened on 21 January 28, 2003, and reviewed by the Community Services & Water 22 Department; and 23 WHEREAS, by letter dated February 11, 2003, Bruce V. 24 Malkenhorst, City Administrator/City Clerk, recommended that Bid No. 25 1425 be awarded to Don Kott Ford, the lowest responsible bidder meeting 26 the requirements of Bid No. 1425. 27 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE 28 CITY OF VERNON AS FOLLOWS: 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 0 PAW SECTION 1: The City Council of the City of Vernon hereby finds and determines that the recitals contained hereinabove are true (land correct. SECTION 2: The City Council of the City of Vernon hereby awards Bid No. 1425 to Don Kott Ford and accepts and approves the Vehicle Purchase Contract, a copy of which is attached hereto as Exhibit "A" and made a part hereof. SECTION 3: The City Council of the City of Vernon hereby authorizes the Mayor and the City Clerk to execute the Vehicle Purchase Contract on behalf of the City and authorizes the issuance of a purchase order for the purchase.of the Ford Ranger pursuant to Bid No. 1425. SECTION 4: The City Council of the City of Vernon hereby directs the City Clerk, or his designee, to send one fully executed Contract to: Don Kott Ford Attn: Don McCain 21212 South Avalon Boulevard Carson, CA 90745 SECTION 5: All other bids in connection with Bid No. 1425 are rejected, subject to execution of the aforesaid contract documents from Don Kott Ford accompanied by all required certificates. Purchase. Don Kott agrees to sell to the City one new 2003 Ford Ranger XLT Super Cab Pickup Truck, together with equipment options, that meets the specifications contained in City of Vernon Bid No. 1425, dated January 7, 2003, and that is consistent with Don Kott's Bid of January 9, 2003 (collectively referred to as the "Bid Documents"). A copy of the Bid Documents are attached hereto as Exhibit"A" and incorporated herein by reference 2. Price. Consistent with its Bid, Don Kott agrees to sell and deliver, subject to final inspection by the City, one new 2003 Ford Ranger XLT Super Cab Pickup Truck for the sum of Sixteen Thousand One Hundred Ninety -Eight Dollars and Ninety -Seven Cents ($16,198.97), plus the options described in the Bid Documents in the sum of Four Hundred Forty -Three Dollars ($443.00) and sales tax of One Thousand Three Hundred Seventy -Two Dollars and Ninety -Seven Cents ($1, 372.97) . 3. FORD RANGER XLT SUPER CAB PICKUP TRUCK INTENT It is the intent of this specification to provide for the purchase of one (1) new and unused Ford Ranger XL Super Cab Pickup Truck with a 4.OL SOHC V-6 and automatic 5-speed tCansudsslon. The City of Vernon has evaluated different types of trucks and has determined that this product is best suited for the department's needs in safety, quality, performance, and standardization. In comparing proposals, consideration will not be confined to price only. The successful bidder will be one whose product is judged shall best serve the interests of the City of Vernon when price, product, safety, quality and delivery are considered. The City of Vernon reserves the right to reject any or all bids or any part thereof, and to waive any minor technicalities. A contract will be awarded to the bidder submitting the lowest responsible bid meeting the requirements of this specification. The City requires the successful bidder to provide proof of insurance, including a standard certificate of insurance, in at least the amounts and coverage indicated on the insurance schedule_ In addition to the standard certificate of insurance, proof of general and umbrella liability coverage shall also be furnished in the form indicated on the attached insurance schedule (Exhibit 'W). EQUIVALENT PRODUCT Bids will be accepted for consideration on any make or model that is equal or superior to the truck specified. Decisions of equivalency will be at the sole interpretation of the City. Purchase. Don Kott agrees to sell to the City one new 2003 Ford Ranger XLT Super Cab Pickup Truck, together with equipment options, that meets the specifications contained in City of Vernon Bid No. 1425, dated January 7, 2003, and that is consistent with Don Kott's Bid of January 9, 2003 (collectively referred to as the "Bid Documents"). A copy of the Bid Documents are attached hereto as Exhibit "A" and incorporated herein by reference 2. Price. FORD RANGER XLT SUPER CAB PICKUP TRUCK INTENT It is the intent of this specification to provide for the purchase of one (1) new and unused Ford Ranger XL Super Cab Pickup Truck with a 4.OL SOHC V-6 and automatic 5-speed transudssion. The City of Vernon has evaluated different types of trucks and has determined that this product is best suited for the department's needs in safety, quality, performance, and standardization. In comparing proposals, consideration will not be confined to price only. The successful bidder will be one whose product is judged shall best serve the interests of the City of Vernon when price, product, safety, quality and delivery,are considered. The City of Vernon reserves the right to reject any or all bids or any part thereof and to waive any minor technicalities. A contract will be awarded to the bidder submittiug the lowest responsible bid meeting the requirements of this specification. The City requires the successful bidder to provide proof of insurance, including a standard certificate of insurance, in at least the amounts and coverage indicated an the insurance schedule. In addition to the standard certificate of insurance, proof of general and umbrella liability coverage shall also be furnished in the forth indicated on the attached insurance schedule (Exhibit "A'). EQUIVALENT PRODUCE' Bids will be accepted for consideration on any make or model that is equal or superior to the truck specified. Decisions of equivalency will be at the sole interpretation of the City. A blanket statement that equipment proposed will meet all requirements will not be sufficient to establish equivalence. Original manufacturer's brochures of the proposed unit are to be submitted with the proposal. All modifications made to the standard production unit described in the manufacturer's brochures must be certified by the manufacturer and submitted with the bid, or the bid will be deemed "non -responsive" and rejected without further review. Bidder must be prepared to demonstrate a unit similar to the one proposed, if requested. INTERPRETATIONS In order to be fair to all bidders, no oral interpretations will be given to any bidder as to the meaning of the specification documents or any part thereof. Every request for such a consideration shall be made in writing to the City of Vernon. Based upon such inquiry, the City may choose to issue an Addendum.
