Resolution No. 81581 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 8158 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON APPROVING AND AUTHORIZING NOTICE INVITING SEALED PROPOSALS OR BIDS FOR THE PURCHASE OF ONE 2003 FORD EXPLORER XLT FOR THE HEALTH DEPARTMENT WHEREAS, the Health Department is in need of a new vehicle to be used to transport the environmental health specialist and related equipment to field locations; and WHEREAS, on February 11, 2003, the Finance Committee approved the recommendation of Bruce V. Malkenhorst, Director of Finance, dated February 5, 2003, that authority be granted for the Purchasing Agent, or his designee, to seek formal bids for the purchase of a 2003 Ford Explorer XLT; and WHEREAS, a bid specification for the purchase of the 2003 Ford Explorer XLT has been presented to the City Council of the City of Vernon; and WHEREAS, the City Council of the City of Vernon has determined that it is in the best interests of the City of Vernon that bids be solicited in accordance with applicable State law and the Vernon City Code. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF VERNON AS FOLLOWS: SECTION 1: The City Council of the City of Vernon hereby finds and determines that the recitals contained hereinabove are true and correct. SECTION 2: The bid specification, which is attached hereto as Exhibit "A" and made a part hereof, is hereby approved by the City Council of the City of Vernon. 2 3 4 5 6 7 8 ., 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 SECTION 3: The City Clerk of the City of Vernon is hereby directed to give notice, in writing, inviting sealed proposals or bids for the purchase of one 2003 Ford Explorer XLT vehicle, in accordance with the bid specification, and in accordance with this resolution. SECTION 4: There being no newspaper of general circulation printed, published or circulated in the City of Vernon, the City Clerk is hereby directed to post said notice, or cause the same to be posted, in three of the most public places in the City of Vernon, to wit: the northwest corner of 38th Street and Santa Fe Avenue, the northeast corner of Leonis Boulevard and Pacific Boulevard, and on the bulletin board in the lobby of the City Hall of the City of Vernon, located at 4305 Santa Fe Avenue, in said City. SECTION 5: The City Clerk of the City of Vernon is hereby directed to post said notice forthwith and the first posting of said notice shall be at least ten (10) days before the opening of the bids for the proposed contract. Said notice shall provide that sealed proposals or bids will be received by the City of Vernon at the office of the City Clerk, or his designee, at the City Hall, 4305 Santa Fe Avenue, Vernon, CA 90058-0805. SECTION 6: The City Clerk of the City of Vernon shall certify to the passage of this resolution, and thereupon and thereafter the same shall be in full force and effect. MALKENHORST, City Clerk - 3 - EXHIBIT 0 January 22, 2003 City of Vernon TECHNICAL SPECIFICATIONS FOR A 2003 FORD EXPLORER 5 DOORALT 4 X 4 INTENT It is the intent of this specification to provide for the purchase of one (1) new and unused 2003 Ford Explorer 5 Door XLT 4 X d with a 4.6L SOHC V8 and automatic 5-speed transmission. The City of Vernon has evaluated different types of vehicles and has determined that this product is best suited for the department's needs in safety, quality, performance, and standardization. In comparing proposals, consideration will not be confined to price only. The successful bidder will be one whose product is judged shall best serve the interests of the City of Vernon when price, product, safety, quality and delivery are considered. The City of Vernon reserves the right to .reject any or all bids or any part thereof, and to waive any minor technicalities. A contract will be awarded to the bidder submitting the lowest qualified and responsible bid meeting the requirements of this specification. The City requires the successful bidder to provide proof of insurance, including a standard certificate of insurance, in at least the amounts and coverage indicated on the insurance schedule. In addition to the standard certificate of insurance, proof of general and umbrella liability coverage shall also be furnished in the form indicated on the attached insurance schedule (Exhibit "A,,). E UIVILENT PRODUCT Bids will be accepted for the consideration on any make or model that is equal or superior to the vehicle specified. Decisions of equivalency will be at the sole interpretation of the City. A blanket statement that equipment proposed will meet all requirements will not be sufficient to establish equivalency. Original manufacturer's brochures of the proposed unit are to be submitted with the proposal All modifications made to the standard production unit described in the manufacturer's brochures must be certified by the manufacturer and submitted with the bid, or the bid will be deemed "Flan -responsive" and rejected without further review. Bidder must be prepared to demonstrate a unit similar to the one proposed, if requested. INTF.RPRIPTATIONS In order to be fair to all bidders, no oral interpretations will be given to any bidder as to the meaning of the specification documents or any part thereof. Every request for such a consideration shall be made in writing to the City of Vernon. Based on such inquiry, the City may choose to issue an Addendum. GENERAL The specification herein states the minimum requirements of the City. All bids must be regular in every respect. Unauthorized conditions, limitations, or provisions shall be cause for rejection, The City of Vernon will consider as "itregular" or "non -responsive" any bid not prepared and submitted in accordance with the document and specification, or any bid lacking sufficient technical literature to enable the Department to make a reasonable determination of compliance to the specification. It shall be the bidder's responsibility to carefully exanune each item of the specification. Failure to offer a completed bid or failure to respond to each section of the technical specification will cause the proposal to be rejected without review as "non -responsive". All variances, exceptions and/or deviations shall be fully described in the appropriate section. The department currently has a staff of five environmental specialists and has been utilizing a vehicle from the Utilities Department's fleet as necessary. The department will be utilizing California Integrated Waste Management Board (CIWMB) grant funds in the amount of $15,530.31, which must be used by June 30, 2003, in addition to the funds budgeted for the purchase of this vehicle. The Health Department is requesting to purchase (1) 2003 FORD EXPLORER XLT. This vehicle will be used to transport the environmental health specialist and related equipment to field locations. This vehicle will be added to the current fleet of vehicles used by the Health Department personnel. The department has a total of (5) environmental health specialists but only (4) designated pool vehicles for the health specialists. Currently, Jerrick Torres (Environmental Specialist) has been sharing a pool vehicle (Unit #L218 - 1991 Ford Tempo, mileage as of 12/05/02 was 23,565) with Abraham Alemu (Associate Engineer, Utilities). With the acquisition of this vehicle the devartment's vehicle needs will be served. The Purchasing Section requests authorization to seek bids for the requested vehicle. The department has received grant funds in the amount of $15,530.13 from the California Integrated Waste Management Board, which must be used by June 30, 2003. The department intends on using these funds in addition to budgeted funds appropriated for the purchase of this vehicle. 1
