Resolution No. 81691 RESOLUTION NO. 8169 2 3 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON APPROVING AND AUTHORIZING THE EXECUTION OF A 4 GRANT APPLICATION UNDER THE CALIFORNIA BEVERAGE 5 CONTAINER RECYCLING AND LITTER REDUCTION ACT TO THE DEPARTMENT OF CONSERVATION'S DIVISION OF RECYCLING 6 7 WHEREAS, the State of California has enacted the California 8 Beverage Container Recycling and Litter Reduction Act that provides 9 funds to the cities and counties for beverage container recycling and 10 litter cleanup activities; and 11 WHEREAS, the California Department of Conservation's 12 Division of Recycling has been delegated the responsibility for the 13 administration of the program within the State and setting up 14 necessary procedures for cities and counties or their designees under 15 the program; and 16 WHEREAS, the City of Vernon has applied for grant funds 17 under the program since May of 2000; and 18 WHEREAS, the California Department of Conservation has 19 announced that the City of Vernon is eligible for Five Thousand 20 Dollars and No Cents ($5,000.00) in grant funds over fiscal year 2003- 21 2004; and 22 WHEREAS, pursuant to Section 14581(a)(4)(E) of the 23 California Beverage Container Recycling and Litter Reduction Act, the 24 eligible participant must submit a Funding Request Form by a certain `. 25 due date in order to request funds from the Department of 26 Conservation's Division of Recycling; and 27 WHEREAS, by letter dated March 13, 2003, Bruce V. 28 Malkenhorst, City Administrator/City Clerk, has recommended that the 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 application for the Beverage Container Recycling and Litter Reduction grant funds be approved and executed. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF VERNON AS FOLLOWS: SECTION 1: The City Council of the City of Vernon hereby finds and determines that the recitals contained hereinabove are true and correct. SECTION 2: The City Council of the City of Vernon hereby approves and authorizes the submittal of the "City/County Funding Request Form FY 2003/2004," ("Form") a copy of which is attached hereto as Exhibit "A" and made a part hereof, to the Department of Conservation's Division of Recycling for all available grant funds under the California Beverage Container Recycling and Litter Reduction Act for the period governing the grant program. SECTION 3: The City Council of the City of Vernon hereby authorizes the Director of Environmental Health to execute said Form for, and on behalf of the City of Vernon. SECTION 4: The Director of Environmental Health is hereby authorized and empowered to execute all forms necessary to secure, implement and carry out the purposes specified in Section 14581(a)(4)(A) of the California Beverage Container Recycling and Litter Reduction Act and to provide information regarding this program to the Department of Conservation's Division of Recycling, upon request. (Example: 1) By implementing beverage container recycling at all city parks, we hope to divert 10 percent more recyclable material from our landfill than last year.) The City of Vernon is exclusively industrial. The City has a resident population of about one hundred, however the daytime work force is over 40,000. The City will concentrate on providing beverage container recycling opportunities for that daytime workforce. The City will install recycling containers at its Civic Center and other public buildings. In addition, the City will work with local businesses and the Chamber of Commerce to expand recycling opportunities at local businesses. The City will also develop a "cleanup day" event, which, using volunteers from the City and local businesses will identify and cleanup an area of the City that is highly littered. The City will work with the local school to bring recycling awareness assemblies to its students and to setup a can and bottling recycling program that will be used as a school fund raiser. Explain how effectiveness of the projectlactivities will be evaluated, including the data that will be collected and analyzed. (Example: We will track our volume monthly, by material type and measure our progress by comparing the totals to last year.) The City will monitor and measure the amounts of recyclables recovered through its City facility and business recycling programs. Additionally, as part of the proposed litter cleanup event, City staff will attempt to measure what percentage of litter collected is made up of easily recycled cans, bottles and other materials. This data will be used to develop strategies for further expanding recycling opportunities in the City. 2000/2001 Evaluation: Briefly describe the measurable outcomes achieved after implementing funded activities in fiscal year 200012001. Due to an ongoing litter problem within the City and neighboring communities, staff is requesting approval to apply for the grant funds and utilize them to develop and distribute public information items to promote recycling. If the grant is approved, the Environmental Health Department is proposing to retain the services of KJ Services, their current Used Oil Recycling consultant, using grant funds. The application requires a city representative to certify that the information contained in the application is true and correct under penalty of perjury. We believe that the Director of Environmental Health should execute the application certifying that the information contained therein is true and correct. As a result of that application and subsequent applications, the California Department of Conservation has annually approved $5,000 in grant monies to the City of Vernon. We have used the grants to print and distribute recycling and litter reduction information to businesses in the City and at the Vernon Elementary School. The California Department of Conservation has announced that, pursuant to Section 14581(a)(4)(A) of the California Beverage Container Recycling and Litter Reduction Act, the City of Vernon is eligible again for $5,000 in grant funds for fiscal year 2003-2004. Bgcause litter is an ongoing problem in our city as well as in neighboring .communities, we are proposing to apply for the grant funds and utilize them to develop and distribute public information items as well as to purchase products to promote recycling. The public information efforts would be similar to those used in the Used Oil Recycling Program that have been successful for the past several years. With your concurrence, I am recommending that the City Council authorize the application for the Beverage Container Recycling and Litter Reduction grant funds. For your consideration, I am attaching the completed application, which will need your signature, and a partially edited copy of the previous resolution for reference.
