A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF VERNON GRANTING A CONDITIONAL USE PERMIT
TO A-AMERICAN SELF STORAGE FOR THE OPERATION
OF A PUBLIC SELF STORAGE MINI -WAREHOUSE AT
4250 ALAMEDA STREET IN CITY OF VERNON
WHEREAS, A -American Self Storage has applied for a
conditional use permit to operate an existing self storage
facility located at 4250 Alameda Street in the City of Vernon;
and
WHEREAS, the City Council of the City of Vernon held a
hearing on said application for a conditional use permit on
April 2, 2003; and
WHEREAS, A -American Self Storage's pattern of
operation will remain predominantly the same as that of the
previous occupant and is not proposing any structural
alterations or modifications to the existing building; and
WHEREAS, the proposed site size is approximately 0.81
of an acre and is adequate in size, shape, topography, including
drainage and landscaping; and
WHEREAS, the proposed site is surrounded by industrial
distribution type uses compatible with the proposed use and no
adverse effect from traffic, parking, noise, odors, smoke, light
or glare, or risk of fire, infection, explosion or effects on
wildlife resources are anticipated from the proposed operation;
and
WHEREAS, the proposed site is a conforming use in the
General Industrial (M) Zone, which requires a conditional use
permit under the Comprehensive Zoning Ordinance; and

1. WHEREAS, the site presently does not comply with the
2 current parking and loading requirements, but is not required to
3 bring it into conformity at this time, because no structural
4 alteration is occurring; and
5 WHEREAS, the proposed use as to location, operation,
6 and design is consistent with the General Plan and the Zoning
7 Ordinance of the City of Vernon; and
8 WHEREAS, the conditions imposed on the conditional use
9' permit will adequately protect the public health, safety and
10 general welfare and the operation is consistent with all
11applicable rules and laws of the City of Vernon; and
12 WHEREAS, the site has access to Alameda Street and
13 Vernon Avenue, and the streets have adequate capacity and
14 pavement type for the proposed operation; and
15 WHEREAS, Pursuant to Section 15301 of the California
16 Environmental Quality Act ("CEQA"), this project is exempt from
17 CEQA, because it is an existing structure.
18 WHEREAS, the City Council has received a Staff Report
19' dated March 26, 2003 upon which it has relied on making the
20 foregoing recitals; and
21 NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
22 THE CITY OF VERNON AS FOLLOWS:
23 SECTION l: The City Council of the City of Vernon
24 hereby finds and determines that the recitals contained herein
25 above are true and correct.

SECTION 2: Subject to the conditions set forth below,
the conditional use permit is hereby granted to A -American Self
Storage for the operation of an existing Public Self Storage
mini -warehouse located at 4250 Alameda Street.
SECTION 3: In order to adequately protect public
health and general welfare the following conditions are
required:
a. The facility shall be operated in accordance with, and
made to conform with all current codes, rules, and regulations
and subject to permit fees and taxes as adopted by the City of
Vernon not otherwise addressed by this grant of a conditional
use permit.
b. All parking and loading facilities shall be paved with
a hard durable surface material and shall be adequately
drained, and kept free of dust, mud, trash weeds. Where
parking or maneuvering areas adjoin the public street, a
barrier wall or landscaping shall be installed and maintained
to meet City standards. Adequate on -site parking shall be
maintained so that off-street parking will not occur.
C. All required federal, state, local and regulatory
agency permits shall be obtained prior to operation. Prior to
occupancy, a business license and occupancy permit shall be
obtained.
d. The facility shall be operated in a manner that will
not impede traffic on Alameda Street.

e. All required frontage improvements shall be
constructed and all existing cracked sidewalk, curb and gutter
adjacent to the site on Alameda Street shall be repaired and
maintained to meet City Standards.
f. The project site shall be maintained substantially in
compliance with the site plans submitted as part of this
conditional use permit application.
g. Adequate trash receptacles shall be provided on site
to keep litter to a minimum. A collection service shall be by
a City of Vernon Franchised Solid Waste Hauler. Trash area
shall be maintained in effort to divert rainfall around
enclosure. All litter blown or dropped on adjacent properties
shall be retrieved and disposed of on a daily basis by A-
American Self Storage or an employee of the building located
at 4250 Alameda Street.
h. Any extension, expansion, change in use, change in
ownership interest, and/or the issuance of a new occupancy
permit shall require a new conditional use permit.
i. The parking, driveway access and landscaping shall be
maintained in accordance with the site plan, which was
submitted with this application. No changes shall be made in
the site development except with the prior approval of the
Director of Community Services & Water.
j. The building shall be maintained so as to prevent the
entrance of rodents.
k. No hazardous materials, including without limitation,
explosives, corrosives, ammunition, flammable liquids,
solvents, gasoline, chemicals or combustibles, or compressed

1 gasses may be stored in the storage units, nor may any tenant
2 engage in any spray painting or sanding in the storage
3 facility.
4 1. A -American Self Storage shall post signs on each floor
5 that read "No Hazardous Materials Permitted" and "No Food
6 Storage is Permitted".
7 M. All storage units shall be equipped with landlord's
8 lock.
9 n. The landlord shall keep at all times a master list of
10 tenants and access to the units shall be granted only to the
11 tenant or his agent when a signature of one so authorized is
12 on file.
13 0. All leases submitted by the public storage facility to
14 the tenants shall include the requirement for periodic safety
15 inspections by the City of Vernon.
16 P. A landlord's representative shall be on the premises
17 at all times during normal business hours and a list of all
18 persons entering the building shall be maintained and made
19 available to the City of Vernon inspectors.
20 q. Whenever a public storage facility is discontinued for
21 a period of two hundred seventy (270) days or not maintained
22 in a suitable condition, the permit may be voided.
23 r. All other police, fire, health and community services
24 department requirements not listed herein shall be complied
25 with.
26 S. Upon any expansion or structural alteration of the
27 building, or the advent of August 19, 2009, whichever occurs
28 first, the entire site shall be made to conform to all truck

1 and automobile parking requirements and all truck loading
2 requirements, pursuant to section 26.4.E-4(b) of the
3 Comprehensive Zoning Ordinance, unless a variance is granted
4 by the Vernon City Council.
5 SECTION 4: Noncompliance with the conditions set forth
6 in the conditional use permit shall be grounds for voiding the
7 permit pursuant to Section 26.5.2-10 of the Comprehensive Zoning
8 Ordinance.
9 SECTION 5: A -American Self Storage and any successors
10 in interest shall indemnify, hold harmless, and defend the City
11 of Vernon, its officers, agents, and employees from and against
12 any and all claims, complaints, or petitions for: (1) damages,
13 losses, expanses resulting from bodily injury, sickness,
14 disease, disability or death arising from the operation of the
15 facility excluding therefrom any such claim resulting from the
16 gross negligence or intentional wrongdoing of the City of
17 Vernon, its officers, agents or employees; (2) a peremptory writ
18 or other relief by way of injunction, mandamus, or
19 administrative mandamus; or (3) legal expenses and attorney's
20 fees incurred by the City of Vernon on behalf of any party in
21 such actions or proceedings. The City of Vernon does not waive
22 its right to Participate in the defense of any such action

SECTION 6: The City Clerk of the City of Vernon shall
certify to the passage of this resolution and thereupon and
thereafter the same shall be in full force and effect.

This facility is an existing self storage facility that ha been
in operation for over fifteen years. The structure was converted
from an existing five story industrial building of an obsolete
type, which is no longer efficient for use as regular warehouse
or manufacturing space.
This facility stores only personal property. The standard rental
agreement specifically prohibits storage of hazardous materials,
foodstuffs, animals(living or dead), or items of total value
exceeding $2500.00. It further prohibits use of space for
residential or manufacturing purposes as well as any illegal
activity. See Sec.12 of attached rental agreement.
The employees on site, control access to the facility, lease
the units, take care of regular building maintenance, and ensure
compliance with the lease agreements. Note that sec. 10 of the
attached rental agreement provides that the owner may enter
and inspect at any time if he believes any nuisance or hazardous
condition is occuring.
Due to the nature of the facility the daily traffic can vary
significantly, however a daily average of 20 tenants accessing
their unit would be typical.

This facility is an existing self storage facility that has
been in operation for over fifteen years. The structure was
converted from an obsolete five story industrial building.
Goods stored at this facility are delivered by light truck or
passenger vehicle. Vehicles enter the site from Alameda St.
and park either in the parking lot or at the loading dock.
Materials are then taken into the structure or removed from
the structure and hand loaded into the vehicles. Once loading
or unloading is complete the vehicles exit the site via Alameda
St.
Approximately 20 tenant vehicles per day access the site. 2
employees operate the facility anmd their cars are also on site.
This gives a total generation of 22 daily trips.
Arrival and departure "times of the tenants obviously vary
considerably, but the employees arrive at 8 AM and leave at.
6PM except for Sunday when they arrive at 1OAM and leave at
4PM.
Due to the nature of the facility the daily traffic can vary
significantly, however a daily average of 20 tenants accessing
their unit would be typical.

Gentlemen:
A -American Self Storage has submitted an application for a
conditional use permit. A -American Self Storage proposes to operate
an existing public self -storage facility located at 4250 Alameda
Street, which was previously operated by Alameda Self Storage. The
proposed use will consist of a self -storage facility for storage of
personal materials that will operate from 8:00 a.m. to 6:00 p.m.
Monday through Saturday and Sunday from 10:00 a.m. to 4:00 p.m. The
proposed site is located in the M-Zone, General Industrial. The
applicant has not proposed any changes to the size, shape or
topography of the existing site.
After review of the application by the Community Services
Department, it is recommended that the conditional use permit be
granted.
Herewith for your consideration are the following supporting
documents:
1. Staff Report.
2. Request for conditional use permit and information
supporting the application.
3. Notice of Public Hearing, copies of notification letters
to owners and tenants in the area and affidavits of
posting and mailing.

The project is categorically exempt from CEQA because it is an
existing facility as described in Section 15301. A Notice of
Exemption will be prepared. In my opinion the proposed operation
will pose no adverse effects to the City of Vernon and will have no
significant effects on the environment. The project is consistent
with the General Plan as Adopted by the City of Vernon.
Therefore, it is recommended that the City Council determine:
1. That the project is consistent with the General Plan as
adopted by the City of Vernon.
2. That the project will not have a significant effect on
the environment.
3. That the project will not individually or cumulatively
have an adverse effect on wildlife resources.
Further, it is recommended that the conditional use permit be
granted subject to the following conditions:
a) The facility shall be operated in accordance with, and
made to conform with all current codes, rules, and
regulations and subject to permit fees and taxes as
adopted by the City of Vernon not otherwise addressed by
this grant of a conditional use permit.
b) All parking and loading facilities shall be paved with a
hard durable surface material and shall be adequately
drained, and kept free of dust, mud, trash weeds. Where
parking or maneuvering areas adjoin the public street, a
barrier wall or landscaping shall be installed and
maintained to meet City standards. Adequate on -site
parking shall be maintained so that off-street parking
will not occur.
c) All required federal, state, local and regulatory agency
permits shall be obtained prior to operation. Prior to
occupancy, a business license and occupancy permit shall
be obtained.
d) The facility shall be operated in a manner that will not
impede traffic on Alameda Street.
e) All required frontage improvements shall be constructed
and all existing cracked sidewalk, curb and gutter
adjacent to the site on Alameda Street shall be repaired
and maintained to meet City Standards.

fl The project site shall be maintained substantially in
compliance with the site plans submitted as part of this
conditional use permit application.
g) Adequate trash receptacles shall be provided on site to
keep litter to a minimum. A collection service shall be
by a City of Vernon Franchised Solid Waste Hauler. Trash
area shall be maintained in effort to divert rainfall
around enclosure. All litter blown or dropped on adjacent
properties shall be retrieved and disposed of on a daily
basis by A -American Self Storage or an employee of the
building located at 4250 Alameda Street.
h) Any extension, expansion, change in use, change in
ownership interest, and/or the issuance of a new
occupancy permit shall require a new conditional use
permit.
i) The parking, driveway access and landscaping shall be
maintained in accordance with the site plan, which was
submitted with this application. No changes shall be made
in the site development except with the prior approval of
the Director of Community Services & Water.
j) The building shall be maintained so as to prevent the
entrance of rodents.
k) No hazardous materials, including without limitation,
explosives, corrosives, ammunition, flammable liquids,
solvents, gasoline, chemicals or combustibles, or
compressed gasses may be stored in the storage units, nor
may any tenant engage in any spray painting or sanding in
the storage facility.
1) A -American Self Storage shall post signs on each floor
that read "No Hazardous Materials Permitted" and "No Food
Storage is Permitted".
m) All storage units shall be equipped with landlord's lock.
n) The landlord shall keep at all times a master list of
tenants and access to the units shall be granted only to
the tenant or his agent when a signature of one so
authorized is on file.
o) All leases submitted by the public storage facility to
the tenants shall include the requirement for periodic
safety inspections by the City of Vernon.

p) A landlord's representative shall be on the premises at
all times during normal business hours and a list of all
persons entering the building shall be maintained and
made available to the City of Vernon inspectors.
q) Whenever a public storage facility is discontinued for a
period of two hundred seventy (270) days or not
maintained in a suitable condition, the permit may be
voided.
r) All other police, fire, health and community services
department requirements not listed herein shall be
complied with.
s) Upon any expansion or structural alteration of the
building, or the advent of August 19, 2009, whichever
occurs first, the entire site shall be made to conform to
all truck and automobile parking requirements and all
truck loading requirements, pursuant to section 26.4.6-
4(b) of the Comprehensive Zoning Ordinance, unless a
variance is granted by the Vernon City Council.
