FOR THE OPERATION OF A RECYCLED MATERIALS PROCESSING FACILITY AT 5991 ALCOA AVENUE IN CITY OF VERNON WHEREAS, PPP, LLC has applied for a conditional use permit to operate a recycled materials processing facility located at 5991 Alcoa Avenue in the City of Vernon; and WHEREAS, the City Council of the City of Vernon held a hearing on said application for a conditional use permit on April 16, 2003; and WHEREAS, PPP, LLC will purchase used plastic, which will then be shredded and processed into plastic pellets; and WHEREAS, the plastic pellets will be stored in Gaylord boxes to be resold and shipped to purchasers who will in turn, convert the plastic pellets into a finished product; and WHEREAS, given the nature of PPP, LLC business operation, it would be classified as a recycled materials processing facility pursuant to the Vernon City Code Section 26.2.14; and WHEREAS, the proposed site is in the M-Zone, General Industrial. Pursuant to Section 26.3.5-3(k) of the Comprehensive Zoning Ordinance, a recycled materials processing facility is allowed in the M-Zone, with approval of conditional use permit; and 1 1. 2 3 4 5 6 7 s 9. 10 11. 12 13 14 15 16 17 18 19. 20 21. 22 23 24 25 26 27 28 WHEREAS, the proposed site is adequate in size, shape and topography for the proposed operation, has adequate drainage, and landscaping, if required, will be installed pursuant to the Vernon City Code; and WHEREAS, the proposed site is surrounded by industrial uses compatible with the proposed use and adverse effects from traffic, parking, noise, odors, dust, smoke, light or glare, or risk of fire, infection or explosion is anticipated from the proposed operation; and WHEREAS, the site has access to Alcoa Avenue, a local roadway with a right-of-way of 60 feet. The streets and highways surrounding the proposed use are adequate in width and are improved so as to carry the traffic expected by this proposed operation; and WHEREAS, the Community Services Department has performed an Initial Study dated February 27, 2003, to determine whether the proposed project will have adverse impacts on the environment and has determined that the proposed project will not have a significant adverse effect on the environment, and the Director of Community Services & Water has recommended that a Negative Declaration be adopted in compliance with the California Environmental Quality Act ("CEQA"); and WHEREAS, the City of Vernon has provided notice of its intent to adopt a Negative Declaration for the proposed project and has provided a public review period of not less than 20 days, as required by the California Environmental Quality Act and the State CEQA Guidelines; and 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 III 17 18 19 20 21 22 23 24 25 26 27 28 WHEREAS, the conditions imposed on the conditional use permit will adequately protect the public health, safety and general welfare and the operation is consistent with all applicable rules and laws of the City of Vernon; and WHEREAS, the proposed use, as to location, operation and design is consistent with the General Plan and Zoning Ordinance of the City of Vernon with approval of a conditional use permit; and WHEREAS, the City Council has received a Staff Report dated April 9, 2003 upon which it has relied on making the foregoing recitals; and NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF VERNON AS FOLLOWS: SECTION 1: The City Council of the City of Vernon hereby finds and determines that the recitals contained herein above are true and correct. SECTION 2: Subject to the conditions set forth below, the conditional use permit is hereby granted to PPP, LLC for the operation of a recycled materials processing facility located at 5991 Alcoa Avenue. SECTION 3: In order to adequately protect the public health and general welfare the following conditions are required: a. The facility shall be operated in accordance with, and made to conform with all current codes, rules, regulations and subject to permit fees and taxes as adopted by the City of Vernon. 3 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 b. Any hazardous substances used, handled and/or stored shall have prior approval from the Vernon Fire and Health Departments. A Health Permit shall be obtained if there are reportable quantities of hazardous materials on the site. C. Servicing of vehicles including washing, steam cleaning and repairing shall not be performed on site. d. In accordance with National Pollutant Discharge Elimination System permit regulations, PPP, LLC shall submit a Notice of Intent to the State Water Resources Control Board and shall prepare a prevention plan and monitoring program within the Board's time limitations. e. All processing and storage operations shall take place within the existing building. No equipment or materials shall be placed or stored outside. Adequate written plans and materials must be available for cleaning up leaks or spills of plastic materials or other substances associated with PPP, LLC operation. f. The storage, staging and processing of materials inside the facility shall comply with the Uniform Fire Code at all times. All materials stored inside shall be stored in such a way as to facilitate inspections by the Vernon Fire and Health Departments at all times. g. Broken or cracked sidewalk, curb, gutter or driveway in Alcoa Avenue adjacent to the site shall be repaired as directed by the Director of Community Services and Water. h. The entire site shall have a neat and clean appearance and shall be kept free of dust, mud, weeds and trash. Wastewater generated by the plant operations shall be contained for proper disposal and shall not be discharged onto the ground surface. The facility shall document how all wastewater generated will be properly discharged or disposed. j. The facility shall meet the requirements of any regulations adopted pursuant to Public Resources Code, Section 43209 and the requirements of any other applicable sections of the California Integrated Waste Management Act of 1989 (Public Resources Code, Section 40000, et sec..). k. PPP, LLC shall obtain all required federal, state, local and regulatory agency permits prior to operation. Prior to occupancy a business license and occupancy permit shall be obtained. 1. The facility shall maintain a valid City of Vernon Health Permit for a Waste Processing Facility. M. The facility shall provide the City of Vernon Health Department with an annual report on the quantity of plastic materials from other jurisdictions, and the volume of residual materials taken to solid,waste disposal facilities. The report shall be submitted by June 1st of each year. n. All parking and loading facilities shall remain paved with a hard durable surface material in good repair and shall remain adequately drained, and kept free of dust, mud, trash and weeds. Adequate on - site parking shall be maintained so that off-street parking will not occur. o. The building shall be repaired so as to prevent the entrance of rodents. p. The facility shall conduct a noise study within the first two months of operation to assure compliance with City of Vernon and CalOSHA requirements. The facility shall comply with all City of Vernon and CalOSHA noise requirements at all times. q. The facility shall be operated in such a manner that noise and vibration shall not be a nuisance to neighborhood properties. At no time shall noise exceed 65db or vibration exceeds four hundredths of an inch per second particle velocity when measured at the property line. r. PPP, LLC shall hire a license C-16 Fire Sprinkler Contractor to provide the City of Vernon with a letter with the following information; kind of commodity being stored (raw materials and finished materials), method of storage (such as rack, floor stack, solid pile), maximum storage height (based on sprinkler system), dimensions of storage arrangement, flue spaces, aisles, draft curtains, smoke vents, hose stations, calculation of sprinkler system. S. Any extension, expansion, change in use, change in ownership interest, and/or the issuance of a new occupancy permit shall require a new conditional use permit. 6 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 SECTION 4: Noncompliance with the conditions set forth in the conditional use permit shall be grounds for voiding the permit pursuant to Section 26.5.2-10 of the Comprehensive Zoning ordinance. SECTION 5: PPP, LLC and any successors in interest shall indemnify, hold harmless, and defend the City of Vernon, its officers, agents, and employees from and against any and all claims, complaints, or petitions for: (1) damages, losses, expanses resulting from bodily injury, sickness, disease, disability or death arising from the operation of the facility excluding therefrom any such claim resulting from the gross negligence or intentional wrongdoing of the City of Vernon, its officers, agents or employees; (2) a peremptory writ or other relief by way of injunction, mandamus, or administrative mandamus; or (3) legal expenses and attorney's fees incurred by the City of Vernon on behalf of any party in such actions or proceedings. The City of Vernon does not waive its right to participate in the defense of any such action. SECTION 6: Not later than sixty (60) days from the date of this Resolution, PPP, LLC shall indicate, in writing, its acceptance of and agreement with the conditions contained in Section 3 of this Resolution and the indemnification provision contained in Section 5 of the Resolution. 7 SECTION 7: The City Clerk of the City of Vernon shall certify to the passage of this resolution and thereupon and thereafter the same shall be in full force and effect. MALKENHORST, City Clerk e1 SUPPORTING DOCUMENTS P CITY OF VERNON COMMUNITY SERVICES DEPARTMENT STAFF REPORT ON PPP, LLC CONDITIONAL USE PERMIT TO OPERATE A RECYCLED MATERIALS PROCESSING FACILITY AT 5991 ALCOA AVENUE APRIL 9, 2003 PPP, LLC has submitted an application for a conditional use permit to operate a recycled materials processing facility located at 5991 Alcoa Avenue. Juco, Inc., a warehousing facility, previously occupied the site. The proposed use will be recycling and processing scrap plastic materials and will operate 24 hours 7 days per week. 1. GENERAL PLAN The proposed use is consistent with the Zoning Ordinance and General Plan. The site is located in the M- Zone, General Industrial. PPP, LLC is considered a recycled materials processing facility. A recycled materials processing facility is defined in Section 26.2.14 of the Comprehensive Zoning Ordinance as a facility that processes recycled materials in order to convert and redistribute them as raw materials for recycled products or in order to convert them and manufacture a product made wholly or partly from recycled materials. A recycled material processing facility does not include a use ancillary to an industrial use. A recycled materials processing facility is an allowed use in the M-Zone with approval of a conditional use permit. 1 2. SITE The total property area of the proposed project is approximately 91,911 square feet in size. The applicant proposes to occupy a 46,635 square foot building that is situated on the property. The applicant has not proposed any changes to the size, shape or topography of the existing site. The site plans for the proposed operation indicates the site is adequate in size, shape, topography, including drainage and landscaping. 3. ADVERSE EFFECT The proposed use is surrounded by properties with industrial uses that are compatible. No adverse impacts from traffic, parking, noise, odor, dust, smoke, light or glare, or risk of fire, infection or explosion are expected to occur to the adjacent of abutting properties. An initial study has been conducted for the project in compliance with the California Environmental Quality Act (CEQA). No potentially significant impacts are expected to result from the project. The Director of Community Services & Water has recommended that a Notice of Intent be filed, and a Negative Declaration be adopted in compliance with the California Environmental Quality Act ("CEQA"), which identifies potentially significant impacts on the environment from the project. 4. ACCESS The proposed site has one driveway on Alcoa Avenue located on the south side of the building, which provides ingress and egress from Alcoa Avenue. The streets and highways surrounding the proposed use are adequate in width and are 2 improved as necessary to carry the traffic expected by this proposed use. The subject site is served by Alcoa Avenue, a local roadway with a right-of-way of 60 feet. 5. VEHICLE MOVEMENTS The number of truck trips for the purpose of ingress/egress combined will consist of 2 to 4 entering the premises during a typical 24-hour period. The number of personal vehicle trips will consist of 5 to 7 employees spread over 3 shifts (2-3 employees per shift). Vehicles traveling to the site will generally exit the I-710 and travel westbound on Bandini Boulevard to Downey Road, then southbound on Downey Road to Slauson Avenue, and then westbound on Slauson Avenue to Alcoa Avenue, and then southbound on Alcoa Avenue to the site. Vehicles exiting the site will utilize the same streets in the opposite direction. The normal hours of operation will be 24 hours 7 days per week (arrival and departure hours 6:00 a.m. to 6:00 p.m.). 6. OPERATIONS PPP, LLC proposes to operate a business that will purchase used plastic. They intend to store, bale, sort and process plastic scraps. The scrap material is run through size reducing equipment (a shredder) that prepares the material for entry via a conveyor into an extruder. The extruder melts the plastic material and forces the melt through a die into a pelletizer, making pellets. The color of die can vary depending on the purchaser or vendor of the product. The finished pellets are then dried and conveyed into Gaylord boxes where they await 3 shipment. The operation is expected to produce approximately 1,500,000 to 2,000,000 pounds of pellets each month. The pellets will then be sold to various customers for further processing to create a finished product. The number of employees on site will consist of 5 to 7 employees spread over 3 shifts (2-3 employees per shift), and the hours of operation will be 24 hours 7 days per week. 7. Honorable .City Council Page 2 April 9, 2003 The project is consistent with the City of Vernon Comprehensive Zoning Ordinance and the City of Vernon General Plan as adopted by the City of Vernon. Therefore, it is recommended that the City Council determine: 1. That the project is consistent with the General Plan as adopted by the City of Vernon. 2.That the project will not have a significant effect on the environment. 3. That the project will not individually or cumulatively have an adverse effect on wildlife resources. Further, it is recommended that the conditional use permit be granted subject to the following conditions set forth below: a. The facility shall be operated in accordance with, and made to conform with all current codes, rules, and regulations and subject to permit fees and taxes as adopted by the City of Vernon. b.Any hazardous substances used, handled and/or stored shall have prior approval from the Vernon Fire and Health Departments. A Health Permit shall be obtained if there are reportable quantities of hazardous materials on the site. c.Servicing of vehicles including washing, steam cleaning and repairing shall not be performed on site. d. In accordance with National Pollutant Discharge Elimination System permit regulations, PPP, LLC shall submit a Notice of Intent to the State Water Resources Control Board and shall prepare a prevention plan and monitoring program within the Board's time limitations. e. All processing and storage operations shall take place within the existing building. No equipment or materials shall be placed or stored outside. Adequate written plans and materials must be available for cleaning up of leaks or spills of plastic materials or other substances associated with PPP, LLC operation. f. The storage, staging and processing of materials inside the facility shall comply with the Uniform Fire Code at all times. Broken or cracked sidewalk, curb, gutter or driveway in Alcoa Avenue adjacent to the site shall be repaired as directed by the Director of Community Services and Water. h. The entire site shall have a neat and clean appearance and shall be kept free of dust, mud, weeds and trash. The site and surrounding area shall be kept free of all plastic materials associated with PPP, LLC operations including but not limited to raw materials, recycled materials, finished product and waste material. i. Wastewater generated by the plant operations must be contained for proper disposal and shall not be discharged onto the ground surface. The facility shall document how all wastewater generated will be properly discharged or disposed. j. The facility shall meet the requirements of any regulations adopted pursuant to Public Resources Code, Section 43209 and the requirements of any other applicable sections of the California Integrated Waste Management Act of 1989 (Public Resources Code, Section 40000, et seq.). k. PPP, LLC shall obtain all required federal, state, local and regulatory agency permits prior to operation. Prior to occupancy a business license and occupancy permit shall be obtained. 1. The facility shall maintain a valid City of Vernon Health Permit for a Waste Processing Facility. m. The facility shall provide the City of Vernon Health Department with an annual report on the quantity of plastic materials from other jurisdictions, and the volume of residual materials taken to solid waste disposal facilities. The report shall be submitted by June lst of each year. n. All parking and loading facilities shall remain paved with a hard durable surface material in good repair and shall remain adequately drained, and kept free of dust, mud, trash and weeds. Where parking or maneuvering areas adjoin the public street a barrier wall or landscaping shall be installed and maintained to meet City standards. The building shall be repaired so as to prevent the entrance of rodents. p. The facility shall conduct a noise study within the first two months of operation to assure compliance with City of Vernon and CalOSHA requirements. The facility shall comply with all City of Vernon and CalOSHA noise requirements at all times. q. The facility shall be operated in such a manner that noise and vibration shall not be a nuisance to neighborhood properties. At no time shall noise exceed 65db or vibration exceeds four hundredths of an inch per second particle velocity when measured at the property line. r. PPP, LLC shall hire a license C-16 Fire Sprinkler Contractor to provide the City of Vernon with a letter with the following information; kind of commodity being stored (raw materials and finished materials), method of storage (such as rack, floor stack, solid pile), maximum storage height (based on sprinkler system), dimensions of storage arrangement, flue spaces, aisles, draft curtains, smoke vents, hose stations, calculation of sprinkler system. s. Environmental Setting The purpose of obtaining a Conditional Use Permit for this site is to satisfy the zoning requirements to operate a recycled materials processing facility at an M zoned location. The City of Vernon zoning ordinance 26.3.5-3(k) clearly states that this will be a permitted use, provided we obtain the CUP. With regard to the environmental setting, there will be no changes to the site from its current condition as a 46,635 square foot industrial building situated on 91,911 square feet of land. The general area will not be affected by the activities of the new owner and the use is consistent with the other occupants in the area (steel manufacturing, food processing, equipment manufacturing, uniform storage & processing, garment manufacturing & a foundry). Operations Report PPP Plastics purchases plastic scrap on a wholesale basis from commercial and industrial customers (no walk-in consumer business). The plastic scrap is stored in large Gaylord Boxes, which will be stacked up to 12 feet in the warehouse area. The scrap material is run through size reducing equipment that prepares the material for entry into an extruder. The extruder melts the material and forces the melt through a die into a pelletizer, making pellets. The finished pellets are dried and conveyed to a Gaylord Box where they await shipping. The extruder uses conveyor belts to transport material and the operation should produce approximately 1,500,000 to 2,000,000 lbs of pellets per month. The extruder has a feeding apparatus that forces the small scrap pieces into the extruder using a hydraulic pump. Traffic Report The new operation will have minimal traffic from a total of just 5 to 7 employees spread over 3 shifts (2 — 3 employees per shift). The operation will run 24 hours per day 7 days per week. The building has 4 truck high loading positions with two truck parking positions. Truck traffic entering and leaving the property will also be substantially less than previous occupants, with approximately 1 to 2 trucks entering the premises during a typical 24 hour period. As indicated in the attached site plan, trucks will enter and leave using the driveway on the south side of the building, which provides ingress and egress from Alcoa Ave. Employees will use the same driveway and use one of the 50 parking spaces identified in the site plan. Hazardous Materials Report The entire operation will use the following hazardous substances in its operations: • One barrel of waste lubricating oil. • One or two cylinders of welding gasses (argon). • One or two propane tanks for forklifts. We do not have any special emergency procedures or contingency plans in place to accommodate for the use of these substances, and have not filled out the Hazardous Materials Establishment Reporting Form. An initial study was preformed as part of this project, which studied the affects of water quality impacts. Alteration of surface water quality is unlikely. All businesses will be required to obtain a National Pollution Discharge Elimination System (NPDES) permit, if required. There are no surface water bodies within the vicinity of the project. No changes in water currents or water movements will occur. There will be no impacts on the direction or rate of flow of groundwater and no impact on its quality. The City of Vernon is the primary water service provider in Vernon. Therefore, there will be no substantial increase in public water demand and no reduction in the demand for groundwater. V AIR QUALITY: Would the proposal: a) Violate any air quality standard or contribute to an existing or projected air quality violation? ❑ 0 X 0 a. The City of Vernon is located within the South Coast Air Basin of California. The basin covers a 6,600-square mile area within Orange County, non -desert portions of Los Angeles County, Riverside County, and San Bernardino County. Air quality in the basin is monitored -5- by the South Coast Air Quality Management District ("AQMD") at 35 monitoring stations throughout the area. The monitoring station nearest to the City of Vernon is the Pico Rivera station. Readings at the station are used to characterize air quality in the City of Vernon. Therefore, the proposed use will not have any impact on air quality. b) Expose sensitive receptors to pollutants? ❑ ❑ ❑ X b. Several freeways serve Vernon. To the north is the Santa Ana (I-5), Santa Monica (I-10) and the Hollywood (I-101) freeways, to the west is the Harbor Freeway (I-110), and to the east is the Long Beach Freeway (I-710). Vernon has several arterials, which bisect the City. The streets surrounding the proposed use are adequate in width and are improved as necessary to carry the traffic expected by this proposed use. The subject site is served by Alcoa Avenue, a local roadway with a right-of-way of 60 feet. The propose use shall reduce local vehicle trips and traffic congestion with only 5-7 employees spread over 3 shifts (2-3 employees per shift). Therefore, there will be no impact on transportation during operation due to increased traffic trips. b) Hazards to safety from design features (e.g. sharp curves or dangerous intersections) or incompatible uses (e.g. farm equipment)? ❑ ❑ ❑ X b. The proposed site is located in an existing industrial area, and the project is compatible with surrounding uses. The local Certified Unified Program Agency (CUPA) regulates use and storage of hazardous materials at any facility within the City of Vernon, which is the City of Vernon Environmental Health Department. All facilities within the City are regularly inspected by the Vernon Fire and Environmental Health Departments for code violations. The inspections are made to reduce the potential for urban fires and chemical releases. The Vernon Fire Department has a fully manned hazardous materials unit. All personnel are trained in hazardous material response. The proposed existing regulations and permitting requirements will be adhered to by the facility and this compliance will reduce potential hazards to less than significant levels. If required, a Hazardous Materials Establishment Permit, as required of all facilities within the City, must be submitted to and approved by the City of Vernon Environmental Health and Fire Departments. A Hazardous Materials Establishment Permit shall include, but not be limited to, instruction and on-the-job training of employees to identify and handle hazardous materials and shall be conducted by an individual knowledgeable in hazardous materials management. These requirements are standard requirements of facilities located within the City of Vernon to regulate the handling and storage of hazardous materials involved in the everyday function of non -hazardous businesses. Therefore, this impact will be less than significant. e) Increased fire hazard in areas with flammable brush, grass, or tees? ❑ ❑ ❑ X e. The proposed site is located in a completely built -out urbanized area that does not contain flammable grass, brush, or trees. No additional landscaping will be done on the site X. NOISE. Would the proposal result in: a) Increases in existing noise levels? ❑ ❑ ❑ X b) Exposure of people to severe noise levels? ❑ ❑ ❑ X a and b. The project is within an industrial area and the surrounding manufacturing and warehousing uses are not noise sensitive. Normal operations within the facility include trucks entering the facility, transferring freight, processing of scrap plastic and an extruder machine that will be operated indoors to reduce noise levels from the neighboring businesses. These operations are not expected to cause any significant noise impacts to neighboring businesses. XI. PUBLIC SERVICES.
