RESOLUTION NO. 8183
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
VERNON AUTHORIZING THE DESTRUCTION OF CERTAIN CITY
RECORDS, DOCUMENTS, INSTRUCTIONS, BOOKS AND PAPERS,
PURSUANT TO GOVERNMENT CODE SECTION 34090
WHEREAS, on August 22, 2000, the City Council of the City of
Vernon adopted Resolution No. 7605 approving and adopting a City of
Vernon Records Retention Schedule 2000 as a guide for department heads
in determining when to destroy obsolete records; and
WHEREAS, the City Clerk of the City of Vernon, by letter
dated April 9, 2003, has recommended that certain records, documents,
instruments, books and papers under his charge and under the charge of
one other department head be destroyed; and
WHEREAS, the City Council of the City of Vernon finds that
none of the records as set forth in Exhibit "A" attached hereto and
made a part hereof by reference (1) affect the title to real property,
or liens thereon; (2) are court records; (3) are records required to be
kept by statute; or (4) are original minutes, ordinances, or
resolutions of the legislative body of the City of Vernon; and
WHEREAS, the City Council of the City of Vernon finds that
all such records are more than two (2) years old; and
WHEREAS, the City Council of the City of Vernon finds that
all such records are no longer required for any purposes of the City of
Vernon and are properly destroyed pursuant to the City's Records
Retention Schedule; and
WHEREAS, the written consent of the City Attorney and the
heads of each appropriate City department to the destruction of such
records have been obtained.
1 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
2 CITY OF VERNON AS FOLLOWS:
3 SECTION 1: The City Council of the City of Vernon hereby
4 finds and determines that the recitals contained hereinabove are true
5 and correct.
6 SECTION 2: The City Council of the City of Vernon hereby
7 authorizes the destruction by the City Clerk's office of said records
8 without making a copy thereof.
9 SECTION 3: The City Council of the City of Vernon finds
10 that the City Attorney has given his written consent to the destruction
11 of the records described in Exhibit "A" and that said written consent
12 is attached hereto and made a part hereof.
13 SECTION 4: The City Clerk of the City of Vernon shall
14 certify to the passage of this resolution, and thereupon and thereafter'I
15 the same shall be in full force and effect.
16 APPROVED .AND ADOPTED this 16th day of April, 2003.
