Resolution No. 82011 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 RM 19 20 21 22 PAR 24 25 26 27 28 RESOLUTION NO. 8201 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON APPROVING AND RATIFYING THE EXECUTION OF A WAIVER FOR YEAR FIVE OF THE JUVENILE ACCOUNTABILITY INCENTIVE BLOCK GRANT PROGRAM WHEREAS, the City Council of the City of Vernon has authorized the reallocation of funds made available through the Juvenile Accountability Incentive Block Grant ("JAIBG") to the Los Angeles County District Attorney's Office, Los Padrinos Court since 1999; and WHEREAS, by Resolution No. 7954 adopted on May 8, 2002, the City Council of the City of Vernon authorized the reallocation of funds made available through the JAIBG Program in the amount of Eight Thousand Seven Hundred Three Dollars and No Cents ($8,703.00) to the Los Angeles County District Attorney's Office, Los Padrinos Court; and WHEREAS, the JAIBG Program Grant, which is administered by the Office of Criminal Justice Planning ("OCJP"), is intended to be utilized for matters relating to the suppression of juvenile delinquency, including, but not limited to, funding a contract with a District Attorney or a probation officer relating to juvenile prosecution; and WHEREAS, the Los Angeles County District Attorney's Office has requested that the City continue its partnership with the Los Angeles County District Attorney's Office in the JAIBG Program for Year Five under the same terms as the past year; and WHEREAS, the City of Vernon, acting alone, would not be able to achieve the goals of the Program with the amount of grant money it has been provided; and 1 2 3 4 5 6 7 M 7 10 11 12 13 14 15 j 16 17 18 19 20 21 22 23 24 25 26 27 28 WHEREAS, the City of Vernon would directly benefit by authorizing the entire amount of its subgrant award in Year Five of the Program to be expended by the Los Angeles County District Attorney's Office, Los Padrinos Court; and WHEREAS, the City's grant allocation this year is Seven Thousand One Hundred Two Dollars and No Cents ($7,102.00); and WHEREAS, the Los Angeles County District Attorney's Office has requested that the City execute a Waiver of Direct Subgrant Award From Unit of Local Government (the "Waiver") in order to indicate the City's desire to participate in the Program; and WHEREAS, the Los Angeles County District Attorney's Office required that the signed Waiver, also deemed as the City's letter of intent to release its allocated funds to the District Attorney's Office, be submitted to them prior to May 23, 2003, and the City Administrator executed the Waiver on May 12, 2003, subject to ratification by the City Council; and WHEREAS, by letter dated May 15, 2003, Bruce V. Malkenhorst, City Administrator/City Clerk, recommended that the City Council approve the reallocation of funds and ratify his execution of the Waiver on May 15, 2003; and WHEREAS, the City Council of the City of Vernon desires to approve and ratify the Waiver, as executed by the City Administrator, and to continue its partnership with the Los Angeles District Attorney's Office in Year Five of the JAIBG Program and, therefore, declines to directly accept funds made available through the JAIBG JProgram. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF VERNON AS FOLLOWS: - 2 - l 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 RM 19 20 21 22 23 24 25 26 27 28 SECTION 1: The City Council of the City of Vernon hereby finds and determines that the recitals contained hereinabove are true and correct SECTION 2: The City Council of the City,of Vernon waives its right to its entire direct subgrant award under the JAIBG Program and authorizes the funds to be expended by the Los Angeles County District Attorney's Office, Los Padrinos Court, for the mutual benefit of both units of local government. SECTION 3: The City Council of the City of Vernon hereby approves and ratifies the execution of the Waiver by the City Administrator on behalf of the City of Vernon, a true and correct copy of which is attached hereto as Exhibit "A" and made a part hereof. SECTION 4: The City Council of the City of Vernon recognizes' that any liability arising out of the performance of this Grant Award Agreement, including civil court actions for damages, shall be the responsibility of the grant recipient and that the State of California and the OCJP disclaim responsibility for any such liability. SECTION 5: The grant funds received under the JAIBG Program shall not be used by the City of Vernon to supplant expenditures controlled by the City of Vernon. SECTION 6: The City Clerk of the City of Vernon shall certify to the passage of this resolution, and thereupon and thereafter the same shall be in full force and effect. By releasing these funds to the D.A.'s Office, they will use these funds to place Deputy District Attorneys in juvenile offices to enhance youth accountability and prosecution efforts. I have attached a copy of Resolution No. 7954, dated MayR, 2002, which addresses this same request made last year. Your city manager should also have received a JAIBG Request for Application (RFA) and corresponding paperwork from OCJP. As we did last year, we are again writing to advise you of the time frame to complete the grant application. For the past four years, the District Attorney's Office has utilized its share of Los Angeles County's JAIBG funds to place senior Grade IV deputy district attorneys in juvenile court offices to enhance youth accountability and prosecution efforts. In addition, more than fifty cities have released their JAIBG funds" each year to the District Attorney's Office to support one of four prosecution programs that they select: HEAT (Heightened Enforcement and Targeting, a juvenile gang prosecution program); ACT (Abolish Chronic Truancy); JOIN (Juvenile Offender Intervention Network, a diversion program for first-time, non-violent juvenile offenders); and the "707" prosecution program targeting serious, violent juvenile crime. This year we have updated the 707 program to better address current juvenile crime issues in our local communities, and these prosecutors will be known as "Special Projects" deputies. Please see the attached list of position descriptions for further details. The City of Vernon currently participates in the 707 Program described in more detail in the attachment. Since the inception of these JAIBG programs in 1999, our prosecutors have received positive feedback from cities and local law enforcement agencies for their dedication and service in juvenile investigations and prosecutions. Caseloads in the juvenile courts have been reduced by more than 20% through the elimination of backlogs and the enhancement of prosecution efforts. Case processing time has been streamlined and reduced by more than 30% in the past 5 years. More than 2,000 youth have been diverted from the criminal justice system, and over 100,000 serious juvenile cases were appropriately adjudicated using JAIBG funds. The 2003 allocation for the City of Vernon is $7,102. We are taking this opportunity to invite you to continue your partnership with the Los Angeles County District Attorney's Office in the JAIBG Program for Year Five. If your city chooses to continue in the JAIBG program, we will need to receive a letter of intent to release your allocated funds to the Office of the District Attorney no later than May 23, 2003, to meet the state deadline. To finalize the release of funds, OCJP again requires a waiver form with the city manager/administrator's original signature and city seal or notarization. We recognize that many cities will need city council approval to execute the attached waiver, therefore we ask that you forward your completed waiver form to Special Assistant District Attorney Mia Baker by June 20, 2003.' To reiterate, we need a letter of intent to release funds by May 23, 2003 and a completed waiver no later than June 20, 2003. If your city has lost its JAIBG appropriation this year or the amount of funding was reduced from last year, we welcome your continued participation in a JAIBG program using other city or grant funds.
