ONE TO AGREEMENT FOR PROFESSIONAL CONSULTING SERVICES BY AND BETWEEN THE CITY OF VERNON AND POWER ENGINEERS, INCORPORATED. FOR THE MALBURG GENERATION STATION PROJECT WHEREAS, the City of Vernon is in the process of developing the Malburg Generating Station Combined Cycle Power Plant (the "Malburg Project") for the purpose of installing additional generating capacity and WHEREAS, on January 8, 2003, the City Council of the City of Vernon approved the execution of an Agreement for Professional Consulting Services (the "Agreement") with Power Engineers, Incorporated ("Power"); and WHEREAS, the City has determined that the existing scope of services with Power needs to be expanded to include engineering services for the design and specification of the fire protection and detection system for the Malburg Project; and WHEREAS, the City believes that the expanded scope of services by Power is necessary to complete the Malburg Project; and WHEREAS, in accordance with Sections 6 and 12.J of the Agreement, the City of Vernon and Power desire to amend the Agreement to incorporate changes to the scope of services and the adjustment of compensation and completion time required therefor; and WHEREAS, on May 19, 2003, the Finance Committee considered the recommendation of Bruce V. Malkenhorst, Director of Finance, dated May 6, 2003, that Amendment No. One to the existing Agreement with Power be approved and executed. 1 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE 2 CITY OF VERNON AS FOLLOWS: 3 SECTION 1: The City Council of the City of Vernon hereby 4 finds and determines that the recitals contained hereinabove are true 5 and correct. 6 SECTION 2: The City Council of the City of Vernon hereby 7 approves Amendment No. One to the Agreement for Professional 8 Consulting Services with Power, a copy of which is attached hereto 9 as Exhibit "A" and made a part hereof. 10 SECTION 3: The City Council of the City of Vernon hereby 11 authorizes the Mayor and the City Clerk to execute said Amendment for, 12 and on behalf of, the City of Vernon. 13 SECTION 4: The City Council of the City of Vernon hereby 14 directs the City Clerk, or -his designee, to send one fully executed 15 Amendment to: 16 Power Engineers, Incorporated Attn. Director of Engineering & Operations City of Vernon 4305 Saute Fe Ave. Vernon, CA 90058 Subject: 516476-04 Malburg Generating Station Fire Protection Engineering Scope Dear Ramon, As we have discussed over the past several weeks, POWER Engineers, is pleased to provide this proposal for additional engineering services for the Malburg Generation Project. These services relate to the design and specification of the fire protection and detection system This work was not included in our original proposal to the City as it was previously being performed by COSCO under the Scott Company contracting arrangement. The scope of services to be provided is included in the attached summary of Design Services and the Division of Responsibility (DOR) Matrix. We request that these documents be provided to U1VIIY T as . well to clarify and confirm their responsibilities. The design will proceed under the following base assumptions: The design drawings and specifications will provide sufficient detail to enable Fire Protection Contractors (FPC) to provide firm bids to UMMT for the supply and installation of the fire protection and alarm system Drawings are intended as design concept drawings. Detailed submittals of equipment and components to be supplied and preparation of installation shop drawings will be the responsibility of the FPC. These submittals will be reviewed by POWER Engineers and the CBO. 2. Fire sprinkler design will be provided for the control building and the STG enclosure/lube oil skid areas only. Deluge systems for the transformers or ammonia storage area have previously been deemed to not be required. Fire protection for the PDCMs will be provided with hand held extinguishers — an FM200 or similar system is not envisioned. 3. The existing cooler tower basin will be used as the sole source of fire protection water. Details on the construction. of this basin will be required to complete this design and for submittal to the CBO. Supply of existing drawings or preparation of as-builts of this, basin is the responsibility of the City of Vernon. 4. Fire response plans or HAZOP plans have not been included and have been assumed to be provided by others. Provide detection for other areas of the site as well as monitoring of ammonia detectors and other equipment as directed. Provide title sheet, notes, riser diagram, and details as required. Fire alarm design drawings to be prepared in AutoCAD format. B. Prepare fire alarm,system technical specification in CSI format. C. Prepare automatic sprinkler system design concept drawings in accordance with State and local AHJ requirements for the Control Building and STG enclosure. Analyze adequacy of the water-cooling tower basin for use as fire protection water supply source. Review water supply distribution design drawings. If required by CBO provide review letter stamped by a registered Fire Protection Engineer. H. Submit automatic sprinkler and fire alarm design documents at the 100 percent stage of design. Incorporate comments into a final set of documents. Allow for minor changes in design concepts and incorporate changes into the final set of documents. Provide California Registered Fire Protection Engineer stamp for the final submittals. Each submittal to include ten copies of design documents. I. Review the types and sizes of fire extinguishers to be used at various buildings and site locations. J. Participate in meetings with City, and others as directed. Meetings to include telephone conference calls and meetings at the site. K. Provide general fire protection consulting as requested. L. Review one complete submittal of contractor's automatic sprinkler system, fire alarm system, and fire pump shop drawings and equipment submittal for conformance with Construction Documents.
