1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 8241 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON APPROVING AND RATIFYING THE EXECUTION OF A GRANT APPLICATION AND AGREEMENT TO THE CALIFORNIA AIR RESOURCES BOARD REGARDING FLEET ZERO -EMISSION VEHICLE INCENTIVE PROGRAM WHEREAS, funds have been established by Health and Safety Code Sections 44260-44265 and are available from the Air Resources Board for grants providing incentives for the purchase or lease of new zero -emission vehicles; and WHEREAS, the City of Vernon has received grant funds through Zero Emission Vehicle Incentive Programs I and/or II, administered by the Air Resources Board, regarding the leasing of new zero -emission vehicles; and WHEREAS, the City of Vernon was notified that additional funding was available for zero -emission vehicles that were purchased or leased after May 1, 2002, on a limited basis; and WHEREAS, on March 3, 2003, Dolores Fonseca, the Purchasing Assistant, submitted an Application for a Fleet Zero Emission Vehicle Incentive Grant for Four Thousand Dollars and No Cents ($4,000.00), (subject to ratification by the City Council; and WHEREAS, the Air Resources Board notified the City that the grant application was approved and in order to receive the grant funds, the Air Resources Board required the City to execute a Grant Agreement and Payment Request Form within ninety (90) days; and WHEREAS, in order to receive the additional funds through the Fleet Zero -Emission Vehicle Incentive Grant, Dolores Fonseca, the Purchasing Assistant, executed and submitted the Grant Agreement and 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 Payment Request Form dated June 11, 2003, subject to ratification by the City Council; and WHEREAS, by letter dated June 24, 2003, Bruce V. Malkenhorst, City Administrator/City Clerk, recommended that the execution of the grant application documents by the Purchasing Assistant be ratified; and WHEREAS, the City Council desires to approve and ratify the application, Grant Agreement and Payment Request Form as executed by the Purchasing Assistant. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF VERNON AS FOLLOWS: SECTION 1: The City Council of the City of Vernon hereby finds and determines that the recitals contained hereinabove are true and correct. SECTION 2: The City Council of the City of Vernon hereby approves and ratifies the execution and submittal by the Purchasing Assistant to the Air Resources Board of an Application for a Zero Emission Vehicle Fleet Incentive Grant: Applicant Information and Project Proposal, Grant Agreement (Grant No. FZ-0020) and Payment Request Form, a copy of which is attached hereto as Exhibit "A" and made a part hereof. / / 1 - 2 - a SECTION 3: The City Clerk of the City of Vernon shall certify to the passage of this resolution, and thereupon and thereafter the same shall be in full force and effect. For example, if a zero emission vehicle received $9,000 through ZIP i and was approved for a Fleet ZIP grant of $11,000, the applicant would receive $2,000 from Fleet ZIP making a total grant amount of $11,000. $• INDEMNIFICATION GRANTEE agrees to hold harmless, indemnify, and defend ARB, its officers, employees. representatives, and successors -in -interest against any and all loss, damage, cost or xpenses which ARB, its officers, employees, agents, representatives, and successors -in -interest may incur or be required to pay by reason of any injury or property damage caused or incurred by GRANTEE, its employees, subcontractors, or agents as a result of the performance of this Grant and use of the subject zero emission vehicles. 9. BUDGET CONTINGENCY USE GRANTEE agrees that if the Budget Act of the current year and/or any subsequent years covered by this Agreement does not appropriate sufficient funds for the Fleet ZIP, this Agreement shall be of no further force and effect In this event, the ARB shall have no liability to pay any funds whatsoever to GRANTEE or to furnish any other considerations under this Agreement and GRANTEE shall not be obligated to Perform any provisions of this Agreement. If funding for any fiscal year is reduced or deleted by the Budget Act for purposes of this program, the ARB shall have the option to either cancel this Agreement with no liablity occurring to the State, or offer an agreement amendment to Contractor to reflect the reduced amount. 10. The City has two such vehicles. Due to funding being limited and in order to resume said funding it was necessary to submit an application, which was accepted for total of $4,000.00. This has been reviewed by the City Attorney. Transmitted herewith is the Application for a Zero Emission Vehicle Fleet Incentive Grant executed by the Purchasing Assistant and it is hereby recommended that the application be approved and ratified. Date: 6/12/2003 Re: Additional Grant for EVs On February 4, 2003 the Air Resources Board submitted an application to the City for additional funding available toward eligible EVs. The City has already received grant approval for $9,000.00 per unit (payments are paid in 3 yearly installments of $3,000.00) for two RAV4s which were eligible for the grants. The Fleet Zero Emission Vehicle Incentive Grant application was submitted and accepted for an additional $2,000.00 per unit. Attach is the application and the Grant Agreement. I request authorization to submit the Fleet Zero Emission Vehicle Incentive Grant. The full funding amount of $4,000.00 will be immediately disbursed upon receipt of the Grant. 0 Page 1
