Resolution No. 8252` r t r 1 RESOLUTION NO. 8252 2 3 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON AUTHORIZING THE CITY ADMINISTRATOR TO MAKE 4 NECESSARY PURCHASES ON BEHALF OF THE CITY OF VERNON 5 IN CONNECTION WITH THE CONSTRUCTION OF THE MA.LBURG GENERATING STATION PROJECT 6 7 WHEREAS, the City of Vernon ("City") is constructing a 134 MW 8 Combined Cycle Power Plant, the Malburg Generating Station (the 9 "Malburg Project"), for the purpose of installing additional generating 10 capacity that will yield an efficient, cost-effective, and reliable 11 source of electric generation to the City's inhabitants; and 12 WHEREAS, the City Administrator/City Clerk serves as the 13 Chief Executive Officer of the Utilities Department; and 14 WHEREAS, in order to construct the Malburg Project with 15 minimal delays, the City needs to expedite the purchase of supplies 16 and/or services that are considered to be urgent or that need 17 immediate action or approval; and 18 WHEREAS, by letter dated July 10, 2003, Bruce V. 19 Malkenhorst, the City Administrator/City Clerk, has recommended that 20 the City Administrator/City Clerk/Chief Executive officer be 21 authorized to approve any purchases, secure any services and/or 22 execute any agreements or contracts that are considered to be urgent 23 or need immediate action or approval, subject to any purchases over 24 $20,000 and consulting service agreements/contracts over $25,000 being 25 presented thereafter for ratification; and 26 WHEREAS, the City Council of the City of Vernon has 27 determined that, pursuant to the provisions of subsection (a) of 28 Section 2.27 of the Vernon City Code, it is in the public interest and ■ 1 necessity to authorize the City Administrator to make the purchases, 2 secure the services, and/or execute the agreements or contracts on 3 behalf of the City that need immediate action or approval during the 4 construction of the Malburg Project. 5 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE 6 CITY OF VERNON AS FOLLOWS: 7 SECTION 1: The City Council of the City of Vernon hereby 8 finds and determines that the recitals contained hereinabove are true 9 and correct. 10 SECTION 2: The City Council of the City of Vernon hereby 11 authorizes the City Administrator to execute any and all documents 12 necessary to implement the purchase of supplies or services during the 13 construction of the Malburg Project if such purchase is considered 14 urgent or immediate action or approval is required, subject to any 15 purchase of supplies over $20,000 or any services over $25,000 being 16 ratified by the Finance Committee. 17 SECTION 3: The City Clerk of the City of Vernon shall 18 certify to the passage of this resolution, and thereupon and 19 thereafter the same shall be in full force and effect. 20 APPROVED AND ADOPTED this 16th day of July, 2003. 21 22 LEONIS C. In order to continue with construction with minimal delays I am recommending that authority be granted for me, as the City Administrator and Chief Executive Officer of the Utilities Department, to approve any purchases and/or execute any agreements that are considered to be urgent or that need immediate action or approval. Any purchases over $20,000 that need immediate approval will thereafter be presented to the Finance Committee for ratification as well as any consulting agreements/contracts over $25,000.
