Resolution No. 82851 2 3 4 5 6 7 8 =1 10 11 12 13 14 15 16 17 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 8285 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON APPROVING AND AUTHORIZING THE EXECUTION OF AN AUTOMATIC AID/INITIAL ACTION AGREEMENT FOR FIRE PROTECTION AND RESCUE SERVICES BY AND BETWEEN THE CITY OF LOS ANGELES AND THE CITY OF VERNON WHEREAS, the Cities of Los Angeles and Vernon (collectively the "Cities") want to coordinate each jurisdiction's responsibility concerning the reasonable exchange of emergency fire and rescue services for responses along or adjacent to the Alameda Corridor (Alameda Boulevard between Slauson Avenue and 25th Street); and WHEREAS, the exchange of emergency fire and rescue services will enhance emergency response times, thereby benefiting the health and welfare of Vernon's citizens; and WHEREAS, the Cities desire to enter into an Automatic Aid/Initial Action Agreement for Fire Protection and Rescue Services (the "Agreement") memorializing their responsibilities; and WHEREAS, the Fire Chiefs of the Cities are continuing to develop the general parameters of the reciprocal exchange which will be memorialized in Memorandums of Understanding that will be incorporated into the Agreement upon execution by the Cities; and WHEREAS, by letter dated September 24, 2003, Bruce V. Malkenhorst, City Administrator/City Clerk, has recommended that the Agreement be approved and executed. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF VERNON AS FOLLOWS: SECTION 1: The City Council of the City of Vernon hereby finds and determines that the recitals contained hereinabove are true 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 �jand correct. SECTION 2: The City Council of the City of Vernon hereby approves the Automatic Aid/Initial Action Agreement for Fire Protection and Rescue Services with the City of Los Angeles, a copy of which is attached hereto as Exhibit "A" and made a part hereof. SECTION 3: The City Council of the City of Vernon hereby authorizes the Mayor and the City Clerk to execute said Agreement for, and on behalf of, the City of Vernon. SECTION 4: The City Council of the City of Vernon hereby lauthorizes the Fire Chief to continue discussions regarding the parameters of the exchange that will be memorialized in memorandums of Understanding that will be incorporated into the Agreement. Such additional amendments or attachments will be submitted to the City Council for approval when completed. SECTION 5: The City Council of the City of Vernon hereby directs the City Clerk, or his designee, to send five (5) fully executed Agreements to: City of Los Angeles Fire Department Attn. William R. Bamattre, Fire Chief 200 N. Main, City Hall East Los Angeles, CA 90012 SECTION 6: The City Clerk of the City of Vernon shall certify to the passage of this resolution, and thereupon and thereafter the same shall be in full force and effect. MALKENHORST, City Clerk 12 13 (SEAL) 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 3 - EXHIBIT V1, AUTOMATIC AID/INITIAL ACTION AGREEMENT FOR FIRE PROTECTION AND RESCUE SERVICES BETWEEN THE CITY OF LOS ANGELES AND THE CITY OF VERNON WHEREAS, the parties to this Agreement provide fire protection and rescue services within their respective jurisdictional limits; and WHEREAS, it is in the best interest of the Vernon Fire Department and the Los Angeles Fire Department to provide the most expeditious response to suppress fires and render other emergency assistance; and WHEREAS, each party is desirous of providing to the other a reasonable and reciprocal exchange of emergency services on a day -today basis, NOW, THEREFORE, in consideration of these mutual covenants, the parties hereby agree as follows: 1. Services by Los Angeles Los Angeles agrees to provide a designated emergency resource response, as jointly agreed upon by the Fire Chiefs of Vernon and Los Angeles, upon request by Vernon, to the "Alameda Corridor" along or adjacent to Alameda Boulevard between Slauson Avenue and 25"' Street, as shown on the attached map, see #1. 2. Dispatch by Los Angeles Upon receipt by Los Angeles of an alarm to the "Alameda Corridor", which .borders the jurisdictions of Los Angeles and Vernon, Los Angeles will dispatch its nearest available and appropriately designated emergency resources to that alarm type and will notify the Vernon fire dispatcher who, in turn, will dispatch the agreed -upon emergency resources by Vernon. 3. Services by Vernon In return for the service to be provided by Los Angeles, Vernon agrees to provide the appropriate designated emergency resource response, as jointly agreed upon by the Fire Chiefs of Vernon and Los Angeles, upon request by Los Angeles, to the "Alameda Corridor". - 1 - 4. Dispatch by Vernon Upon receipt by Vernon of an alarm to "Alameda Corridor", Vernon will dispatch its nearest available and appropriately designated emergency resources to that alarm type and will notify the Los Angeles fire dispatcher who, in turn, will dispatch the agreed -upon emergency resources by Los Angeles. 5. Mutual Benefits Vernon and Los Angeles intend that this Agreement will coordinate each jurisdiction's responsibility and provide mutual benefits to both parties. The Fire Chiefs of Vernon and Los Angeles are hereby authorized to periodically identify and revise any designated areas or types of response as may be dictated by changing conditions. 6. Administration Details as to amounts and type of assistance to be dispatched, methods of dispatching and communications, training programs and procedures, methods of requesting aid, and the names of persons authorized to send and receive such requests, together with lists of equipment and personnel which will be utilized, shall be developed by the Fire Chiefs of Vernon and Los Angeles. Such details shall be recorded in Memorandums of Understanding which are to be incorporated into this Agreement upon execution by both Fire Chiefs of Vernon and Los Angeles, see #2, Frequency Sharing Agreement).; 7. Incident Command In those instances where either Department arrives before the other Department, the first -arriving Department will take the necessary action dictated by the situation. However, it is assumed that the other Department will arrive shortly after the arrival of the first -arriving Department. Overall command of the incident will be under,a unified command until or unless the jurisdictional Department can be clearly defined and then assumed by the jurisdictional Department upon its arrival at the scene. Each Department's personnel will remain under the command of the highest-ranking officer of their own Fire Department at the incident. 8. Commitment of Resources When it is determined that an emergency incident is clearly located in the other Department's jurisdiction, both parties mutually understand and agree that this Agreement does not relieve either party from the necessity and obligation of using its own resources for furnishing fire and rescue services within any part of its own jurisdiction. The aiding party's response to a request for aid will be dependent upon the existing emergency conditions within its own jurisdiction and the status of its resources. - 2 - If it is determined that an incident is clearly in the other's jurisdiction, the aiding Department will be released from the scene as soon as practical. Any personnel and/or equipment being used in the other's jurisdiction must be able to return to their own jurisdiction within one hour. 9. No Third -Party Benefit This Agreement shall not be construed as, or deemed to be, an Agreement for the benefit of anyone not a party hereto, and anyone who is not a party hereto shall not have a right of action hereunder for any cause whatsoever. 10. Consideration No party furnishing aid pursuant to this Agreement shall be entitled to compensation for services rendered to the requesting agency, it being understood that the respective covenants contained in this Agreement shall constitute the sole consideration for such services. 11. Public entity mutual hold harmless clause Pursuant to the provisions of Sections 895.4 et seq. of the California Government....:: Code; each party agrees to indemnify and hold the other harmless from all loss or liability for injury or damage, actual or alleged, to person or property arising out of or resulting from the indemnifying parry's acts or omissions in the performance of this Agreement. In the event of third -party loss caused by the negligence, wrongful act or omission of more than one party, each party hereto shall bear financial responsibility in proportion to its percentage of fault as may be mutually agreed between them or judicially determined. The provisions of California Civil Code Section 2778 regarding interpretation of indemnity agreements are hereby incorporated into this Agreement. 12. Term This Agreement shall commence when Vernon and Los Angeles execute this agreement and shall remain operative and effective until participation is terminated by either party. It is further agreed that either party may terminate the Agreement at any time by giving written notice to the other party at least thirty (30) days prior to the date of withdrawal. - 3 - 13. No Effect on Master Mutual Aid Agreement It is mutually understood that this Agreement will in no way affect or have a bearing on the existing California Master Mutual Aid Agreement. 14. Malburg, Mayor APPROVED AS TO CONTENT: By - 5 - City Manager ATTACHMENT #2 LOS ANGELES FIRE DEPARTMENT FREQUENCY SHARING AGREEMENT The Los Angeles Fire Department (LAFD) grants permission to the City of Vernon Fire Department (VFD), to utilize Fire Department radio frequencies: TAC 1, TAC 2, TAC 3, OCD 4, OCD 7, OCD 8, OCD 9, EMS 10, TAC 12, TAC 13, TAC 14, TAC 15, TAC 16, TAC 17, TAC 18, ICALL (MAF 19), ITAC 1 (MAF 20), ITAC 2 (MAF 21), ITAC 3 (MAF 22), ITAC 4 (MAF 23), FIREMARS (MAF 24) The primary use of these frequencies is for, but not necessarily limited to, use in facilitating emergency communications between LAFD personnel and VFD personnel during emergency incidents. Permission is granted pursuant to the strict adherence to the following radio procedures: 1. The VFD will receive from the LAFD: two (2) portable radios, one (1) charger, and two (2) extra batteries. The VFD will be responsible for the care and maintenance of the above listed equipment. 2. If an MDC1200 signaling protocol is used, for any apparatus radios or separately obtained hand-held radios, VFD shall secure a written statement from the LAFD containing a unique radio identifier (four digit). Such request shall be coordinated through the LAFD FCCS II/RCN Section at (213) 485-2772. 3. If any radio has emergency trigger capabilities, it shall be completely disabled or programmed to prohibit the use of LAFD frequencies for emergency trigger broadcasting. 4. Radio equipment shall be properly maintained to ensure compliance with LAFD, Manufacturer and FCC operating parameters. 5. All radio traffic shall be in compliance with existing FCC rules and protocols. 6. Communication shall be of an official nature and is restricted to joint operations between the LAFD and VFD. Personal communications are prohibited. 7. Radio traffic of the LAFD has priority over radio traffic of the VFD, except during an "Emergency Traffic" situation during an emergency incident. 8. All requests for LAFD Resources shall be made through the LAFD Operations Control Dispatch (OCD). 9. Plain text language shall be used. Do not use radio codes. 10. The LAFD may cancel this agreement at any time. If the agreement is cancelled, the VFD agrees to immediately cease operation on all LAFD frequencies and the portable radios.
