Resolution No. 82881 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 8288 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON APPROVING AND AUTHORIZING NOTICE INVITING SEALED PROPOSALS OR BIDS FOR THE PURCHASE OF TWO TVI 3-LINE DECONTAMINATION SHELTER SYSTEMS FOR THE FIRE DEPARTMENT WHEREAS, the Fire Department is requesting the purchase of two (2) mass decontamination tents for use during a hazardous materials spill or a chemical attack; and WHEREAS, the Fire Department has selected the TVI 3-Line Decontamination Shelter System (the "TVI Shelter System") based upon its rapid set-up features, the lightweight materials providing easier storage and the shower facilities; and WHEREAS, on September 23, 2003, the Finance Committee considered the recommendation of Bruce V. Malkenhorst, Director of Finance, dated September 18, 2003, that authority be granted for the Purchasing Agent, or his designee, to seek formal bids for the purchase of the TVI Shelter System; and WHEREAS, Specification dated September 26, 2003, (the "Specification") has been prepared for the purchase of the TVI Shelter System; and WHEREAS, the City Council of the City of Vernon has determined that it is in the best interests of the City of Vernon that bids or proposals be solicited in accordance with applicable State law and the Vernon City Code. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF VERNON AS FOLLOWS: SECTION 1: The City Council of the City of Vernon hereby 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 finds and determines that the recitals contained hereinabove are true (land correct. SECTION 2: The Specification, a copy of which is attached hereto as Exhibit "A" and made a part hereof, is hereby approved by the City Council of the City of Vernon. SECTION 3: The City Clerk of the City of Vernon, or his designee, is hereby directed to give notice, in writing, inviting sealed proposals or bids for the purchase of the TVI Shelter System in accordance with the Specification, and in accordance with this resolution. SECTION 4: There being no newspaper of general circulation printed, published or circulated in the City of Vernon, the City Clerk is hereby directed to post said notice, or cause the same to be posted, in three of the most public places in the City of Vernon, to wit: the northwest corner of 38th Street and Santa Fe Avenue, the northeast corner of Leonis Boulevard and Pacific Boulevard, and on the bulletin board in the lobby of the City Hall of the City of Vernon, located at 4305 Santa Fe Avenue, in said City. SECTION 5: The City Clerk of the City of Vernon is hereby directed to post said notice forthwith and the first posting of said notice shall be at least ten (10) days before the opening of the bids for the proposed contract. The City of Vernon has evaluated different types of decontamination products and has determined that the following items are best suited for the departments needs in safety, quality, performance, and standardization. In comparing proposals, consideration will not be confined to price only. The successful bidder will be one whose product is judged shall best serve the interests of the City of Vernon when price, product, safety, quality and delivery are considered. The City of Vernon reserves the right to reject any or all bids or any part thereof, and to waive any minor technicalities from the specifications. A contract will be awarded to the bidder submitting the lowest qualified and responsible bid meeting the requirements for this specification. EQUIVALENT PRODUCT Bids will be accepted for the consideration on any product that is equal or superior to the items specified. Decisions of equivalency will be at the sole interpretation of the City. A blanket statement that equipment proposed will meet all the requirements will not be sufficient to establish equivalency. Original manufacture's brochures of the proposed unit are to be submitted with the proposal. All modifications made to the standard production unit described in the manufacture's brochures must be certified by the manufacturer and submitted with the bid, or the bid will be deemed "non -responsive" and rejected without further review. Bidder must be prepared to demonstrate a unit similar to the one proposed, if requested. INTERPRETATIONS In order to be fair to all bidders, no oral interpretations will be given to any bidder as to the meaning of the specification documents or any part thereof. Every request for such a consideration shall be made in writing to the City of Vernon. Based on such inquiry, the City may choose to issue an Addendum. GENERAL The specification herein states the minimum requirements of the City. All bids must be regular in every respect. Unauthorized conditions, limitations, or provisions shall be cause for rejection. The City of Vernon will consider as "irregular" or "non -responsive" any bid not prepared and submitted in accordance with the document and specification, or any bid lacking sufficient technical literature to enable the Department to make a reasonable determination of compliance to the specification. It shall be the bidder's responsibility to carefully examine each item of he specification. Failure to offer a completed bid or failure to respond to each section of the technical specification will cause the proposal to be rejected without review as "non -responsive". All variances, exceptions and /or deviations shall be fully described in the appropriate section. Deceit in responding to the specification will be cause for rejection.
