RESOLUTION NO. 8313
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF VERNON ACCEPTING THE WORK OF SULLY
MILLER CONTRACTING COMPANY IN ACCORDANCE
WITH CONTRACT NO. 538 OF THE CITY OF VERNON
WHEREAS, Sully Miller Contracting Company was awarded Contract No. 538
for Various Streets Improvement pursuant to Resolution No. 7158 of the City of Vernon; and
WHEREAS, Samuel Kevin Wilson, Director of Community Services and Water
II has reported to the City Council of the City of Vernon on November 12, 2003 that said work has
been completed and recommends that the work be accepted and payment be made to the
Contractor in accordance with the agreement.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF VERNON AS FOLLOWS:
SECTION 1: The City Council of the City of Vernon hereby finds and
determines that the recitals contained hereinabove are true and correct.
SECTION 2: The work of Sully Miller Contracting Company pursuant to
Contract No. 538 is hereby approved and accepted by the City Council of the City of Vernon.
SECTION 3: The total expended amount is One Million One Hundred Twenty
Nine Thousand Five Hundred Seventy Seven Dollars and Fifty -Four cents ($1,129,577.54). The
remaining ten percent (10%) or the sum of One Hundred Twelve Thousand Nine Hundred Fifty
Seven Dollars and Seventy -Five cents ($112,957.75) is payable thirty-five days after the
adoption of this resolution.
SECTION 4: The City Council of the City of Vernon hereby directs payment of
said sums as set forth to Sully Miller Contracting Company and instructs the City Clerk to file a
notice of completion with the County Recorder.
SECTION 5: The City Clerk of the City of Vernon shall certify to the passage
this resolution and thereupon and thereafter the same shall be in full force and effect.
