A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF VERNON GRANTING A
CONDITIONAL USE PERMIT TO PWP
INDUSTRIES FOR THE OPERATION OF AN
ACCESSORY WAREHOUSE AT 2080 49Tx
STREET
WHEREAS, PWP Industries ("PWP") has applied for a
conditional use permit to operate an accessory warehouse at 2080
49th Street in the City of Vernon; and
WHEREAS, PWP currently has manufacturing, packaging,
warehousing, and office space at 3751 Seville Avenue.
WHEREAS, the City Council of the City of Vernon held
hearing on said application for a conditional use permit o
January 28, 2004; and
WHEREAS, the proposed site is a permitted use in the
General Industry (M) Zone with approval of a conditional use
permit; and
WHEREAS, City staff has determined that the project is
categorically exempt from the California Environmental Quality
Act pursuant to Section 15301, existing facilities; and
WHEREAS, the proposed use, as to location, operation and
design is consistent with the General Plan and Zoning Ordinance
of the City of Vernon; and
WHEREAS, a conditional use permit is required under the
Zoning Ordinance Section 26.3.5-3(j) in order to operate an
accessory warehouse greater than 50,000 square feet in the M-
Zone; and

WHEREAS, the proposed operation will be an integral part of
the manufacturing operation and will include the storage of
goods produced in the PWP's manufacturing operation in the City
of Vernon; and
WHEREAS, PWP proposes to occupy approximately 54,000 square
feet of the building on the site, and the site is adequate in
size, shape and topography for the proposed operation and has
adequate drainage; and
WHEREAS, the proposed site is surrounded by industrial,
warehouse and other permitted uses which are compatible with the
proposed use and no adverse effects from traffic, parking,
noise, odors, dust, smoke, light or glare, or risk of fire,
infection or explosion is anticipated from the proposed
operation; and
WHEREAS, the site has access to Alameda Street and 49th
Street, which are adequate in width and pavement type to carry
the quantity of traffic generated by the proposed use; and
WHEREAS, the site has a nonconforming building on it which
presently does not comply with the current parking and loading
requirements, however, the site is not required to come into
conformity at this time, because no expansion or structural
alteration of a building or buildings is occurring; and
WHEREAS, the proposed use, as to location, operation and
design is consistent with the General Plan and Zoning Ordinance
of the City of Vernon and all applicable County, State, and
Federal law, rules and regulations; and

WHEREAS, the conditions imposed on the conditional use
permit will adequately protect the public health, safety and
general welfare and the operation is consistent with all
applicable rules and laws of the City of Vernon; and
WHEREAS, the City Council has received a Staff Report,
dated January 19, 2004 upon which it has relied on making the
foregoing recitals; and
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
VERNON AS FOLLOWS:
SECTION l: The City Council of the City of Vernon hereby
finds and determines that the recitals contained hereinabove are
true and correct.
SECTION 2: Subject to the conditions set forth below, the
conditional use permit is hereby granted to PWP for the
operation of an accessory warehouse at 2080 49th Street.
SECTION 3: In order to adequately protect the public health
and general welfare the following conditions are required:
a. The facility shall be operated in accordance with, and
made to conform with all current codes, rules, regulations, and
subject to permit fees as adopted by the City of Vernon.
b. All required federal, state, local and regulatory agency
permits shall be obtained prior to operation. Prior to occupancy
a business license and occupancy permit shall be obtained.
c. All parking and loading facilities shall be paved with a
hard durable surface material and shall be adequately drained,'
and kept free of dust, mud, trash and weeds. Where parking or'I
maneuvering areas adjoin the public street a barrier wall or
landscaping shall be installed and maintained to meet City

standards. Adequate on -site parking shall be maintained so that
no on -street parking will occur.
d. The facility shall be operated in a manner that will
prevent unsanitary conditions, odors or other nuisances. The
property shall be provided with adequate refuse containers and
refuse disposal services.
e. PWP shall structurally maintain 2080 49th Street to
exclude rodents and the property shall be maintained rodent
free .
f. Servicing of vehicles including washing, steam cleaning
and repairing, is not permitted and can only be performed in
facilities in compliance with appropriate codes.
g. No equipment or freight shall be stored on the site
other than in buildings, trailers, or on the docks (no outside
storage).
h. A Storm Water Pollution Prevention Plan (SWPPP) shall be
obtained/filed from the Regional Water Quality Control Board, if
required.
i. Adequate plans and materials must be available for
handling leaks or spills from vehicles during storage, loading
or transportation.
j. If required a hazardous materials permit shall be
obtained from the City of Vernon Environmental Health Department
if hazardous materials/waste are used, handled, or stored.
Hazardous materials/waste shall be handled and managed in
compliance with all appropriate federal, state and local laws.
k. The facility shall be operated in a manner that will not
impede traffic on 49thStreet and Alameda Street.

1. All required frontage improvements shall be constructed
and all existing cracked sidewalk, curb and gutter adjacent to
the site on 49th Street shall be repaired and maintained to meet
City Standards.
m. Any extension, expansion, change in use, change in
ownership interest, and/or the issuance of a new occupancy
permit shall require a new conditional use permit.
n. Upon any expansion or structural alteration of the
building, or the advent of August 19, 2009, whichever occurs
first, the entire site shall be made to conform to all truck and
automobile parking requirements and all truck loading
requirements, pursuant to section 26.4.E-4(b) of the
Comprehensive Zoning Ordinance, unless a variance is granted by
the Vernon City Council.
SECTION 4: PWP and any successors in interest shall
indemnify, hold harmless, and defend the City of Vernon, its
officers, agents, and employees from and against any and all
claims, complaints, or petitions for: (1) damages, losses,
expenses resulting from bodily injury, sickness, disease,
disability or death arising from the operation of the facility
excluding therefrom any such claim resulting from the sole
negligence or intentional wrongdoing of the City of Vernon, its
officers, agents or employees; (2) a peremptory writ or other
relief by way of injunction, mandamus, or administrative
mandamus; or (3) legal expenses and attorney's fees incurred by
the City of Vernon on behalf of any party in such actions or
proceedings. The City of Vernon does not waive its right to
participate in the defense of any such action.

SECTION 5: Not later than sixty (60) days from the date of
this Resolution, PWP shall indicate, in writing, its acceptance
of and agreement with the conditions contained in Section 3 of
this Resolution and the indemnification provision contained in
Section 4 of the Resolution.
SECTION 6: The City Clerk of the City of Vernon shall
certify to the passage of this resolution and thereupon and
thereafter the same shall be in full force and effect.

AT 2080 E. 49" STREET
January 19, 2004
PWP Industries (hereafter referred to as "PWP") is a plastic
container manufacturer in the City of Vernon, presently operating
at 3751 Seville Avenue. PWP is proposing to expand its operation
by acquiring an additional building located at 2080 49thStreet.
The proposed site is approximately 54,000 square feet and will be
used as an accessory warehouse for their existing manufacturing
facility. The accessory warehouse will operate as an integral
part of PWP's manufacturing process and store goods produced in
the City.
In order to comply with the Comprehensive Zoning Ordinance
and operate an accessory warehouse greater than 50,000 square
feet in the M-Zone, a conditional use permit is required. As
defined in Section 26.3.5.3(j), an accessory warehouse is an
integral part of a manufacturing operation located in the City of
Vernon and storing goods produced in that operation.
1. GENERAL PLAN
The proposed use conforms to the Zoning
Ordinance and the General Plan with the granting of a conditional
use permit. The site of the proposed use is located in the M-
zone, General Industrial. An accessory warehouse in excess of
50,000 square feet is permitted in the M-Zone with a conditional
use permit.

2. SITE The proposed 54,000 square foot building, located
at 2080 49th Street, is currently vacant. The property contains
three buildings totaling 225,500 square feet in size. The total
size of the parcel is 344,559 square feet. The existing facility
is adequate in size, shape, topography and drainage for the
operation.
3. ADVERSE EFFECT The proposed use is surrounded by
properties with industrial, commercial and warehousing uses
compatible with the proposed use. No adverse impacts from
traffic, parking, noise, odor, dust, smoke, light or glare, or
risk of fire, infection or explosion are expected to occur to the
adjacent or abutting properties. Pursuant to Section 15301 of the
California Environmental Quality Act, this project is exempt from
CEQA, because it is an existing facility.
4. ACCESS The project site, as proposed, will have access
to three driveways along on 49th Street. 49th Street, which is 60
feet in width and is adequate in size and pavement type to handle
the traffic generated by the operation. The site is a preexisting
site that has not been vacant for a continuous period of more
than one year and PWP is not proposing to undertake any
structural alterations. Therefore, the owner is not required to
bring the building into complete compliance with the automobile,
truck parking, truck loading, and maneuvering requirements of the
current City of Vernon Comprehensive Zoning Ordinance at this
time.

5. VEHICLE MOVEMENTS The proposed site is located at the
corner of 49th Street and Alameda Street. There are three
entrances into to the property site, all of which are located on
49th Street. PWP estimates that approximately 1 to 2 trucks per
day will deliver and pick-up product on a daily basis. The
delivery and pick-up times will be between 4:00 a.m. and 12:00
p.m. Only the one employee from the existing warehouse and office
building at 3751 Seville Avenue will be relocated into the new
building. Therefore, there will be no impact on transportation
during operation. The trucks routed to the subject site will
travel south on Seville Avenue to Vernon Avenue (West) to Santa
Fe Avenue (South) onto 49th Street (West) .
6. OPERATIONS PWP is an existing manufacturing facility in
the City of Vernon that is proposing to expand its operation by
acquiring additional warehousing space at 2080 49th Street. PWP,
manufacturers different types of plastic food containers for
various food chains, and restaurants and will use the subject
site as an accessory warehouse for the storage of plastic thermo
food containers. A conditional use permit is required for any
accessory warehouse in excess of 50,000 square feet.
With the addition of the new building the PWP's operation
has proposed to reorganize their operation to maximize there
manufacturing operations. The facilities operating hours will
remain 4:00 a.m. to 4:00 p.m. Monday through Friday.

7. STATE OR FEDERAL CONDITIONS All Federal, State, and
local regulatory permits shall be obtained as required for the
operation.
8. CONDITIONS It is recommended that the following
conditions be set on the permit to adequately protect the public
interests:
a. The facility shall be operated in accordance with, and

Conditional Use Permit Application — Accessory Warehouse

Traffic Study Report:
The subject site is located at the corner of 49th Street and Alameda and is gated. There
are three entrances onto the property, all of which are located on 49th Street. PWP
Industries estimates that approximately 1 to 2 trucks a day would deliver and pick up
product on an in and out basis. The delivery and pick-up times would be between 4AM
and Noon. The truck route would be Seville Avenue to Vernon Avenue to Sante Fe onto
49th Street. This tenant's specific use and their hours of delivery and pick-up would
mitigate any potential traffic impacts.
Operations Report:
The subject site will used as an Accessory Warehouse by PWP Industries, who currently
operates a manufacturing facility on Seville Avenue in Vernon. PWP would use the
subject site for the storage of Plastic Thermo Food Containers. The operating hours
would be 4AM to 4PM, Monday through Friday and the facility would be operated by
one employee. There is no apparent impact to the adjoining properties.

an existing facility as described in Section 15301.
