t , 1 RESOLUTION NO. 8363 2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON APPROVING A LOT LINE ADJUSTMENT 3 REQUESTED BY OWENS-BROCKWAY GLASS CONTAINER 4 INC. 5 WHEREAS, Owens -Brockway Glass Container Inc. (Owens- 6 Brockway) is the owner of four adjoining parcels of land 7 (parcels 1, 2, 3, and 4) located at 2901 Fruitland Avenue 8 bounded on the west by Soto Street on the north by 50th Street 9 and on the south by Fruitland Avenue with the exception of a 17 10 foot wide right of way for the Los Angeles Junction Railway in 11 the City of Vernon, all as described and shown on the attached 12 Exhibit "A" consisting of four (4) pages which are incorporated 13 herein by this reference as though fully set forth at length; 14 and 15 WHEREAS, Owens -Brockway desires to adjust the common 16 boundaries, between the parcels whereby said adjustment will 17 create the properties as described and shown on the attached 18 Exhibit "B" consisting of four (4) pages which are incorporated 19 herein by this reference as though fully set forth at length; 20 and 21 WHEREAS, Owens -Brockway has applied for a lot line 22 adjustment pursuant to Government Code Section 66412(d), which 23 provides that the Subdivision Map Act does apply to the 24 following; 25 (d) A lot line adjustment between four or fewer 26 existing adjoining parcels, where the land taken from 27 one parcel is added to an adjoining parcel, and 28 where a greater number of parcels than originally 1 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 j 26 27 28 existed is not thereby created, if the lot line adjustment is approved by the local agency, or advisory agency...." and WHEREAS, Government Code Section 66412(d) permits a local agency to impose conditions or exactions on its approval of a lot line adjustment so long as they relate to a property's conformity with the local general plan, any applicable coastal plan, and zoning and building ordinances, or require the prepayment of real property taxes prior to the approval of the lot line adjustment, or facilitate the relocation of existing utilities, infrastructure, or easements; and WHEREAS, on or about May 23, 2002, Owens -Brockway informally submitted a lot line adjustment application; and WHEREAS, on June 4, 2002, The City's Director of Community Services and Water advised Owens -Brockway that it needed to take certain actions to conform to the building and zoning codes; and WHEREAS, the actions to be taken by Owens -Brockway were: a) To obtain a variance from the parking requirements; b) To convert the westerly wall of the building that was situated on Lot 31 to one hour construction or to have a 20' no build covenant recorded; c) To convert the east wall of the building situated on Lot 30 to one hour construction; d) Sever and refeed all the utility lines (fire 2 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 protection, water, and electrical) crossing the property line; e) Reroute the drainage from the building on Lot 31 or obtain an easement to cross the property line; f) Provide a 60 foot no build yard on the south side of the building situated on Lot 31; g) Remove a canopy attached to the west side of the building situated on lot 31; h) Relocate a tank in the required yard on the south side of Lot 31; i) Provide a copy of any easements that will be retained by Owens -Brockway; and WHEREAS, Owens -Brockway formally submitted its lot line adjustment on or about September 23, 2002; and WHEREAS, on or about October 2, 2002, the Director of Community Services and Water advised Owens -Brockway of the following: 1) The need to comply with the requirements of the City's June 4, 2002 letter with a few minor changes; items b and c were tobe amended to read "If a covenant is used the Applicant shall provide the Covenant and Agreement and any necessary documents"; 2) Show limits on all dimensions on exhibit maps; 3 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 3) All legal descriptions and exhibit maps shall be signed and stamped by a licensed surveyor; 4) Provide closure calculations for all legal descriptions; 5) Provide area in square feet or acres for all described areas; and WHEREAS, since that time Owens -Brockway has complied with most of the City's conditions for approval of the lot line adjustment; WHEREAS, Owens -Brockway has not been able to complete the rerouting of the drainage from the building on Lot 31 or the installation of a fire protection system; and WHEREAS, Owens -Brockway has represented that it will complete the installation of the proper drainage systems from that building by May 15, 2004; and WHEREAS, Owens -Brockway has set aside certain funds in an escrow account to ensure that the drainage system and fire protection system are installed; and WHEREAS, Owens -Brockway will need to install, use and maintain a fire protection line partially across Lot 31; and WHEREAS, Owens -Brockway will need to obtain an easement from its successor -in -interest, the City of Vernon Redevelopment Agency, to install, use and maintain the fire protection line on Lot 31; and WHEREAS, Samuel Kevin Wilson, Director of Community services & Water, has recommended that said lot line adjustment be approved under certain conditions; and 4 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 F*M 23 24 25 26 27 28 WHEREAS, the parcels resulting from the lot line adjustment will conform to the zoning and building ordinances of the City of Vernon once the conditions specified herein are met. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF VERNON AS FOLLOWS: SECTION 1: The City Council of the City of Vernon hereby finds and determines that the recitals contained herein - above are true and correct. SECTION 2: The request for a lot line adjustment dated September 23, 2002, to adjust the common boundaries of parcels 1 and 2 described in the attached Exhibit "A", whereby said adjustment will create two new properties as described as parcels 1 and 2 in the attached Exhibit "B" is hereby approved in accordance with the recommendation of Samuel Kevin Wilson, Director of Community Services & Water and subject to the following conditions: a) That the City of Vernon Redevelopment Agency agree to and approve an easement deed for the installation, use and maintenance of a three foot fire water line for Owens -Brockway. b) That Owens -Brockway will complete the installation of the drainage pumps and fire protection system by May 15, 2004. c) That Owens -Brockway will record a no build side yard covenants on proposed parcels 2 and 4 benefiting the existing building on proposed parcel 1 in compliance with the California Building Code. 5 I SECTION 3: The City Clerk of the City of Vernon shall 2 certify to the passage of this resolution and thereupon and 3 thereafter the same be in full force and effect. 4 5 APPROVED AND ADOPTED this 28th day of January 2004. 6 "EONISC. WHEREAS, Owens -Brockway Glass Container Inc. (Owens - Brockway) is the owner of four adjoining parcels of land (parcels 1, 2, 3, and 4) located at 2901 Fruitland Avenue bounded on the west by Soto Street on the north by 50th Street and on the south by Fruitland Avenue with the exception of a 17 foot wide right of way for the Los Angeles Junction Railway in the City of Vernon, all as described and shown on the attached Exhibit "A" consisting of four (4) pages which are incorporated herein by this reference as though fully set forth at length; and WHEREAS, on or about May 23, 2002, Owens -Brockway informally submitted a lot line adjustment application; and WHEREAS, on June 4, 2002, The City's Director of Community Services and Water advised Owens -Brockway that it needed to take certain actions to conform to the building and zoning codes; and WHEREAS, the actions to be taken by Owens -Brockway were: a) To obtain a variance from the parking requirements; b) To convert the westerly wall of the building that was situated on Lot 31 to one hour construction or to have a 20' no build covenant recorded;
