Resolution No. 83781 KIN 11 12 13 14 15 OUi 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 8378 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON APPROVING A LOT LINE ADJUSTMENT REQUESTED BY JOSEPH T. RYERSON & SON, INC. WHEREAS, Joseph T. Ryerson & Son, Inc. ("Ryerson") owns four adjoining parcels of land located in the City of IlVernon; and WHEREAS, the addresses of the parcels are: 4310 E. Bandini Boulevard (Assessor's Map Number 6304-002-008), 2939 Sunol Drive (Assessor's Map Number 6304-004-002), 2951 Sunol Drive (Assessor's Map Number 6304-004-003), and 2901 Sunol Drive (Assessor's Map Number 6304-004-004), all as described and shown on the attached Exhibit "A" consisting of three (3) pages which are incorporated herein by this reference as though fully set forth at length; and WHEREAS, Ryerson formally submitted its lot line adjustment on December 17, 2003; and WHEREAS, Ryerson desires to adjust lot lines by eliminating the boundaries around Parcels 2 and 3, and adjusting the common boundaries of Parcels 1 and 4 to create two parcels as described and shown on the attached Exhibit "B" consisting of two (2) pages which are incorporated herein by this reference as though fully set forth at length; and WHEREAS, after the lot line adjustment, the newly created Parcel 2 will have only about a 30 foot of frontage on Sunol Drive; and WHEREAS, Section 28.28(b) of the Vernon City Code requires all lots to have a 150 foot frontage on a public 1 2 3 4 5 6 7 EA M 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 Ilstreet; and WHEREAS, Ryerson has requested a variance from Section 28.28(b) and the City Council has approved said variance; and WHEREAS, Ryerson has applied for a lot line adjustment pursuant to Government Code Section 66412(d), which provides that the Subdivision Map Act does not apply to the following: (d) A lot line adjustment between four or fewer existing adjoining parcels, where the land taken from one parcel is added to an adjoining parcel, and where a greater number of parcels than originally adjustment is approved by the local agency, or advisory agency...;" land WHEREAS, Government Code Section 66412(d) permits a local agency to impose conditions or exactions on its approval of a lot line adjustment so long as they relate to a property's conformity with the local general plan, any applicable coastal plan, and zoning and building ordinances, or require the prepayment of real property taxes prior to the approval of the lot line adjustment, or facilitate the relocation of existing utilities, infrastructure, or easements; and WHEREAS, on September 30, 2003, the City's Director of Community Services and Water advised Ryerson's representative that Ryerson needed to take certain actions to conform to the building and zoning codes prior to the lot line adjustment being approved; and WHEREAS, Ryerson has submitted Development Plans that depict a building which will require a fire access roadway and 2 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 sideyard on proposed Parcel 1 benefiting the proposed building on proposed Parcel 2 and Ryerson will provide such easements prior to the issuance of Building Permit or amend the development such that said easement are no longer necessary; and WHEREAS, since that time Ryerson has complied with the City's conditions for approval of the lot line adjustment; WHEREAS, Samuel Kevin Wilson, Director of Community Services & Water, has recommended that said lot line adjustment be approved under certain conditions; and WHEREAS, the parcels resulting from the lot line adjustment will conform to the zoning and building ordinances of the City of Vernon once the conditions specified herein are met. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF VERNON AS FOLLOWS: SECTION 1: The City Council of the City of Vernon hereby finds and determines that the recitals contained herein - above are true and correct. SECTION 2: The request for a lot line adjustment to adjust the common boundaries of Parcels 1 and 2, and eliminate the boundaries of Parcels 3 and 4 as described in the attached Exhibit "A", through which two new properties will be created, as described as Parcels 1 and 2 in the attached Exhibit "B", is hereby approved in accordance with the recommendation of Samuel Kevin Wilson, Director of Community Services & Water and subject to the following conditions: a) That Joseph T. Ryerson & Son, Inc. record reciprocal access easements for ingress and egress at the entrance to Parcels 1 and 2 from 3 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 the intersection of Sunol Drive and Ayers Avenue in a form approved by the City of Vernon. b) That Joseph T. Ryerson & Son, Inc. will drain each lot individually and drainage shall not cross the proposed property lines of Parcels 1 and 2, unless a drainage easement is provided. c) That Joseph T. Ryerson & Son, Inc. will serve each lot individually with separate utilities, that shall not cross the proposed property lines of Parcels 1 and 2, unless an easement is provided. SECTION 3: The City Clerk of the City of Vernon shall certify to the passage of this resolution and thereupon and thereafter the same be in full force and effect.
