RESOLUTION NO. 8380
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON
AUTHORIZING THE DIRECTOR OF COMMUNITY SERVICES AND
WATER TO DEPUTIZE QUALIFIED EMPLOYEES TO EVALUATE AND
APPROVE BUILDING PERMITS
WHEREAS, pursuant to Section 24.1 of the Vernon City Code,
the Director of Community Services and Water is also the Building
Official for the City of Vernon; and
WHEREAS, on March 5, 1974, pursuant to Ordinance No. 844,
Ithe City Council of the City of Vernon adopted by reference the
California Building Code; and
WHEREAS, Section 104.2.1 of the California Building Code
1provides that the Building Official is authorized to enforce all
provisions of the California Building Code; and
WHEREAS, Section 104.1.1 of the California Building Code
provides that the code enforcement agency authorized to enforce all
provisions of the California Building Code is under the administrative
and operational control of the Building Official; and
WHEREAS, Section 106.4.1 of the California Building Code
provides that the Building Official shall evaluate and issue building
permits; and
WHEREAS, Section 104.2.2 of the California Building Code
provides that the Building Official may deputize such inspectors or
employees as may be necessary to carry out the functions of the code
enforcement agency, subject to the approval of the appointing
authority; and
WHEREAS, the Community Services and Water Department
currently evaluates and approves approximately twelve hundred building
1 permits per year; and
2 WHEREAS, the operation of the City's Community Services and
3 Water Department would improve if the City's Building Official was
4 authorized to deputize qualified employees to assist in evaluating and
5 approving building permits; and
6 WHEREAS, certified inspectors or plan checkers who are
7 qualified and necessary to carry out the function of evaluating and
8 approving building permits are currently employed within the City's
9 Community Services and Water Department; and
10 WHEREAS, by letter dated February 11, 2004, Bruce V.
11 Malkenhorst, the City Administrator/City Clerk, has recommended that
12 the Director of Community Services and Water be authorized to deputize
13 qualified employees to evaluate and approve building permits and assist
14 in carrying out the Building Official's functions.
15 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
16 CITY OF VERNON AS FOLLOWS:
17 SECTION 1: The City Council of the City of Vernon hereby
18 finds and determines that the recitals contained hereinabove are true
19 and correct.
20 SECTION 2: The City Council of the City of Vernon hereby
21 authorizes the City's Building Official, the Director of Community
22 Services and Water, to deputize certified inspectors or plan checkers
23 to evaluate and approve building permits to be issued by the City of
24 Vernon Community Services and Water Department.

1 SECTION 3: The City Clerk of the City of Vernon shall
2 certify to the passage of this resolution, and thereupon and
3 thereafter the same shall be in full force and effect.
4 APPROVED AND ADOPTED this 18th day of February, 2004.

8380, was duly adopted by the City Council of the City of Vernon at a
