A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
3 VERNON AUTHORIZING THE CITY CLERK TO MAKE AND
DELIVER A CERTIFICATE OF ELECTION TO COUNCIL
4 MEMBERS HILARIO GONZALES AND WILLIAM J. DAVIS AND
5 TO ADMINISTER THE OATH OF OFFICE
6 WHEREAS, the City Council of the City of Vernon by
7 Resolution No. 8366 on February 4, 2004, appointed Hilario Gonzales
8 and William J. Davis members of the City Council to serve a term of
9 four (4) years pursuant to Section 2.90 of the Vernon City Code and
10 Elections Code Section 10229; and
11 WHEREAS, the General Municipal Election scheduled for
12 April 13, 2004, was thereafter cancelled because no more than one
13 person filed nomination papers for each office; and
14 WHEREAS, Section 10229 of the Elections Code provides, in
15 part, as follows:
16 "The person appointed, if any, shall qualify and
17 take office and serve exactly as if elected at a
18 municipal election for the office;" and
19 WHEREAS, Section 3.4 of the Vernon City Charter requires
20 the City Council to canvass the returns of an election on the first
21 Tuesday following a City Council election or such other date within
22 fifteen (15) days of the election as may be provided by ordinance;
23 and
24 WHEREAS, Section 3.4 also states that the term of each
25 elected councilmember shall begin at the hour of the completion of
26 the canvas of the election returns; and
27 WHEREAS, on January 28, 2004, the City Council of the City
28 of Vernon adopted Ordinance 1098 which established the first

Wednesday following an election as the date to canvass returns and
install appointed councilmembers; and
WHEREAS, Section 10265 of the Elections Code requires that
the City Clerk sign and deliver a Certificate of Election to each
person elected and administer the oath of office.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF VERNON AS FOLLOWS:
SECTION 1: The City Clerk shall immediately make and
deliver to Hilario Gonzales and William J. Davis a Certificate of
Election signed by the City Clerk and duly authenticated.
SECTION 2: The City Clerk shall administer to Hilario
Gonzales and William J. Davis the oath of office prescribed in the
State Constitution of the State of California and shall have them
subscribe thereto and file the same in the office of the City Clerk,
whereupon, Mr. Gonzales and Mr. Davis shall be inducted into the
respective office to which they have been elected.
SECTION 3: The City Clerk of the City of Vernon shall
certify to the passage of this resolution, and thereupon and
thereafter the same shall be in full force and effect.
