RESOLUTION NO. 8437
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
VERNON APPROVING AND RATIFYING THE WITHDRAWAL FROM
THE INDEPENDENT CITIES RISK MANAGEMENT AUTHORITY
PROPERTY INSURANCE PROGRAM AND LIABILITY POOL AND
AUTHORIZING THE CITY ADMINISTRATOR TO DO ALL OTHER
ACTS DEEMED NECESSARY OR ADVISABLE TO COMPLETE THE
WITHDRAWAL
WHEREAS, the City of Vernon is a member in good standing of
the Independent Cities Risk Management Authority ("ICRMA"), a Joint
Powers Authority, that provides risk management programs of insurance
to protect its members from the effect of unexpected losses and to
provide excess insurance and other services, including risk management,
loss prevention, claims adjustment, insurance brokerage, legal and
other services related to its purpose; and
WHEREAS, on June 10, 1986, the City Council of the City of
Vernon adopted Resolution No. 5287 approving the City of Vernon joining'.
with certain other municipalities as a member of the ICRMA's Property,
Liability and Workers' Compensation Risk Management Committees and
approving an Amendment to Joint Exercise of Powers Agreement for
Insurance and Risk Management Purposes and By -Laws of the Property,
Workers' Compensation and Liability Risk Management Committees; and
WHEREAS, on July 2, 2003, the City Council of the City of
Vernon adopted Resolution No. 8242 electing to participate in the
ICRMA Workers' Compensation Program ("Program") through which member
cities, including the City of Vernon, secure workers' compensation
1coverage; and
WHEREAS, by letter dated April 30, 2003, Thomas Ybarra, Mayorl
IPro Tem of the City of Vernon and ICRMA Governing Board Member,

notified the General Manager of the ICRMA of the City's wish to
continue its membership in the ICRMA, a copy of which is attached
hereto as Exhibit "A" and made a part hereof; and
WHEREAS, by letter dated September 23, 2003, Bruce V.
Malkenhorst, City Administrator, notified the General Manager of the
ICRMA of the City's withdrawal from the ICRMA property insurance
program effective July 1, 2004, in accordance with Article IX of the
ICRMA Property Risk Management Program By -Laws, a copy of which is
attached hereto as Exhibit "B" and made a part hereof; and
WHEREAS, by letter dated December 16, 2003, Thomas Ybarra,
Mayor Pro Tem of the City of Vernon and ICRMA Governing Board Member
notified the General Manager of the ICRMA of the City's withdrawal from
its membership in the ICRMA Liability Pool effective July 1, 2004, a
copy of which is attached hereto as Exhibit "C" and made a part hereof;)
and
WHEREAS, on April 21, 2004, the Finance Committee considered
the recommendation of Bruce V. Malkenhorst, Director of Finance, dated
April 15, 2004, that the actions taken by the City Administrator and
the Mayor Pro Tem to withdraw from the Independent Cities Risk
Management Authority Property Insurance Program and Liability Pool
effective July 1, 2004, be ratified and authorization be granted to
execute any further documents and/or take any actions deemed necessary
to implement the withdrawal.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF VERNON AS FOLLOWS:
SECTION 1: The City Council of the City of Vernon hereby
finds and determines that the recitals contained hereinabove are true
and correct.

SECTION 2: The City Council of the City of Vernon hereby
approves and ratifies the actions of the City Administrator and the
Mayor Pro Tem in authorizing the withdrawal from the ICRMA Liability
Pool and Property Insurance Program.
SECTION 3: The City Council hereby authorizes and directs
the City Administrator, or his designee, to act on the City's behalf
in all matters pertaining to the withdrwal from the ICRMA Liability
Pool and Property Insurance Program. The City Administrator, or his
designee, is authorized and empowered to execute in the name of the
City of Vernon all necessary documents and make any payments to the
ICRMA as may be required to implement the withdrawal.
SECTION 4: The City Clerk of the City of Vernon shall
certify to the passage of this resolution, and thereupon and
thereafter the same shall be in full force and effect.
