RESOLUTION NO. 8442
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
VERNON APPROVING AND RATIFYING THE EXECUTION OF A
GRANT APPLICATION UNDER THE CALIFORNIA BEVERAGE
CONTAINER RECYCLING AND LITTER REDUCTION ACT TO THE
DEPARTMENT OF CONSERVATION'S DIVISION OF RECYCLING
WHEREAS, the State of California has enacted the California
Beverage Container Recycling and Litter Reduction Act that provides
funds to the cities and counties for beverage container recycling and
litter cleanup activities; and
WHEREAS, the California Department of Conservation's
Division of Recycling has been delegated the responsibility for the
administration of the program within the State and setting up
necessary procedures for cities and counties or their designees under
the program; and
WHEREAS, the City of Vernon has applied for grant funds
under the program since May of 2000; and
WHEREAS, the California Department of Conservation has
announced that the City of Vernon is eligible for Five Thousand
Dollars and No Cents ($5,000.00) in grant funds over fiscal year 2004-
2005; and
WHEREAS, pursuant to Section 14581(a)(4)(E) of the
California Beverage Container Recycling and Litter Reduction Act, the
eligible participant must submit a Funding Request Form by a certain
due date in order to request funds from the Department of
Conservation's Division of Recycling; and
WHEREAS, in order to receive the grant funds, the Department
of Conservation required the grant application to be submitted prior to

May 3, 2004, and the Director of Environmental Health executed the
application, subject to ratification by the City Council and submitted
the application to the Department of Conservation; and
WHEREAS, by letter dated April 26, 2004„ Bruce V.
Malkenhorst, City Administrator/City Clerk, recommended that the
execution of the Beverage Container Recycling and Litter Reduction
grant fund application be ratified; and
WHEREAS, the City Council desires to approve and ratify the
grant fund application as executed by the Director of Environmental
Health.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF VERNON AS FOLLOWS:
SECTION 1: The City Council of the City of Vernon hereby
finds and determines that the recitals contained hereinabove are true
and correct.
SECTION 2: The City Council of the City of Vernon hereby
approves, authorizes and ratifies the submittal of the "City/County
Funding Request Form (FRF) FY 2004/2005" ("Form"), a copy of which is
attached hereto as Exhibit "A" and made a part hereof, to the
Department of Conservation's Division of Recycling for all available
grant funds under the California Beverage Container Recycling and
Litter Reduction Act for the period governing the grant program.
SECTION 3: The City Council of the City of Vernon hereby
ratifies the execution of the application by the Director of
Environmental Health on behalf of the City of Vernon and hereby
authorizes and empowers the Director of Environmental Health to
execute all forms necessary to secure, implement and carry out the
purposes specified in Section 14581(a)(4)(A) of the California

Beverage Container Recycling and Litter Reduction Act and to provide
information regarding this program to the Department of Conservation's
Division of Recycling, upon request.
SECTION 4: The City Council of the City of Vernon hereby
directs the City Clerk, or his designee, to send a copy of this
resolution to:

SECTION 5: The City Clerk of the City of Vernon shall
certify to the passage of this resolution, and thereupon and
thereafter the same shall be in full force and effect.
