RESOLUTION NO. 8453
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
VERNON APPROVING AND RATIFYING THE EXECUTION OF A
WAIVER FOR YEAR SIX OF THE JUVENILE ACCOUNTABILITY
INCENTIVE BLOCK GRANT PROGRAM
WHEREAS, the City Council of the City of Vernon has
authorized the reallocation of funds made available through the
Juvenile Accountability Incentive Block Grant, now known as the
Juvenile Accountability Block Grant ("JABG"), to the Los Angeles County)
District Attorney's Office, Los Padrinos Court since 1999; and
WHEREAS, by Resolution No. 8201 adopted on May 21, 2003, the
City Council of the City of Vernon authorized the reallocation of funds'
made available through the JABG Program in the amount of Seven Thousandlli
One Hundred Two Dollars and No Cents ($7,102.00) to the Los Angeles
County District Attorney's Office for participation in the Special
Projects Prosecution Program; and
WHEREAS, the JABG Program Grant, which is administered by the
Office of Criminal Justice Planning ("OCJP"), is intended to be
utilized for matters relating to the suppression of juvenile
delinquency through its Abolish Chronic Truancy Program, Heightened
Enforcement and Targeting Program, Special Projects Prosecutor Program,
Juvenile Offender Intervention Network Program and Gift -Equipment and
Training Program; and
WHEREAS, the Los Angeles County District Attorney's Office
has requested that the City continue its partnership with the Los
Angeles County District Attorney's Office in the JABG Program for Year
Six under the same terms as the past year; and
WHEREAS, the City of Vernon, acting alone, would not be able

Ito achieve the goals of the Program with the amount of grant money it
1has been provided; and
WHEREAS, the City of Vernon would directly benefit by
authorizing the entire amount of its subgrant award in Year Six of the
Program to be expended by the Los Angeles County District Attorney's
Office; and
WHEREAS, the City's grant allocation this year is Five
Thousand Four Hundred Fifty -Seven Dollars and No Cents ($5,457.00); and
WHEREAS, the Los Angeles County District Attorney's Office
has requested that the City execute a JABG 2004 Waiver of Direct
Subgrant Award From Unit of Local Government (the "Waiver") in order to
indicate the City's desire to participate in the JABG Program; and
WHEREAS, the Los Angeles County District Attorney's Office
required that the signed Waiver, also deemed as the City's letter of
intent to release its allocated funds to the District Attorney's
Office, be submitted to them prior to May 21, 2004, and the City
Administrator executed the Waiver on May 19, 2004, subject to
ratification by the City Council; and
WHEREAS, by letter dated May 24, 2004, Bruce V. Malkenhorst,
City Administrator/City Clerk, recommended that the City Council
approve the reallocation of funds and ratify his execution of the
Waiver on May 19, 2004; and
WHEREAS, the City Council of the City of Vernon desires to
approve and ratify the Waiver, as executed by the City Administrator,
and to continue its partnership with the Los Angeles District
Attorney's Office in Year Six of the JABG Program and, therefore,
declines to directly accept funds made available through the JABG
Program.

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF VERNON AS FOLLOWS:
SECTION 1: The City Council of the City of Vernon hereby
finds and determines that the recitals contained hereinabove are true
and correct.
SECTION 2: The City Council of the City of Vernon waives its
right to its entire direct subgrant award under the JABG Program and
authorizes the funds to be expended by the Los Angeles County District
Attorney's Office for the mutual benefit of both units of local
government.
SECTION 3: The City Council of the City of Vernon hereby
approves and ratifies the execution of the Waiver by the City
Administrator on behalf of the City of Vernon, a true and correct copy
of which is attached hereto as Exhibit "A" and made a part hereof.
SECTION 4: The City Council of the City of Vernon recognizes
that any liability arising out of the performance of this Grant Award
Agreement, including civil court actions for damages, shall be the
responsibility of the grant recipient and that the State of California
and the OCJP disclaim responsibility for any such liability.
SECTION 5: The grant funds received under the JABG Program
shall not be used by the City of Vernon to supplant expenditures
controlled by the City of Vernon.

SECTION 6: The City Clerk of the City of Vernon shall
certify to the passage of this resolution, and thereupon and thereafter
the same shall be in full force and effect.
