DBA RELIABLE TRANSPORTATION, INC. FOR THE OPERATION OF AN EXISTING FREIGHT AND TRUCK TERMINAL AT 2043 ROSS STREET WHEREAS, Valley Fruit and Produce Co. dba Reliable Transportation, Inc. (hereinafter referred to as "Valley Fruit") has applied for a conditional use permit to operate an existing freight and truck terminal at 2043 Ross Street in the City of Vernon; and WHEREAS, the City Council of the City of Vernon held a hearing on said application for a conditional use permit on June 16, 2004; and WHEREAS, the proposed site is a legal non -conforming use in the General Industry (M) Zone which has been used previously as a freight and truck terminal by United-S-Transfer; and WHEREAS, a conditional use permit is required under the Zoning Ordinance in order to continue the use as a freight and truck terminal; and WHEREAS, the proposed operation will include the hauling and temporary storage of general products; and WHEREAS, the proposed site is approximately 1.2 acres in size, and is adequate in size, shape and topography for the proposed operation and has adequate drainage; and WHEREAS, the proposed site is surrounded by industrial uses compatible with the proposed use and no adverse effects from traffic, parking, noise, odors, dust, smoke, light or glare, or risk of fire, infection or explosion is anticipated from the -1- I proposed operation; and 2 WHEREAS, the majority of outbound trips will take Ross 3 Street to Alameda Street traveling North to the 10 Freeway and 4 vice versa for inbound traffic; and 5 WHEREAS, the streets to be used by the applicant are 6 sufficient to handle the traffic generated from the proposed 7 operations; and 8 WHEREAS, the proposed operation will generate 40 vehicle 9 movements, including employee vehicles, out of the site daily; 10 and 11 WHEREAS, the proposed operation will not generate more 12 traffic trips than have been generated historically at the site 13 and there will be no traffic impact; and 14 WHEREAS, the site, as proposed, has ample room on -site to 15 provide adequate off-street parking and loading facilities as 16 required by the Vernon City Code; and 17 WHEREAS, the conditions imposed on the conditional use 18 permit will adequately protect the public health, safety and 19 general welfare and the operation is consistent with all 20 applicable rules and laws of the City of Vernon; and 21 WHEREAS, the proposed use, as to location, operation and 22 design is consistent with the General Plan and Zoning Ordinance 23 of the City of Vernon; and 24 WHEREAS, the project is categorically exempt from the 25 California Environmental Quality Act as an existing facility 26 pursuant to Section 15301 of the California Environmental 27 Quality Act Guidelines and a Notice of Exemption will be 28 prepared and filed with the County Clerk; and -2- 1 2 3 4 5 6 7 a 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 WHEREAS, the City Council has received a Staff Report, dated on June 9, 2004 upon which it has relied on making the foregoing recitals; and NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF VERNON AS FOLLOWS: SECTION 1: The City Council of the City of Vernon hereby finds and determines that the recitals contained hereinabove are true and correct. SECTION 2: Subject to the conditions set forth below, thel conditional use permit is hereby granted to Valley Fruit for the operation of a freight and truck terminal at 2043 Ross Street. SECTION 3: In order to adequately protect the public health and general welfare the following conditions are required: a. The facility shall be operated in accordance with, and made to conform with all current codes, rules, regulations and subject to permit fees as adopted by the City of Vernon not otherwise addressed by this grant of a conditional use permit. All trucking operations, including truck and trailer parking, shall be limited to the lot located at 2043 Ross Street in the City of Vernon. b. All required federal, state, local and regulatory agency permits shall be obtained prior to operation. Prior to occupancy a business license and occupancy permit shall be obtained. C. Any extensions, change in use, change in ownership interest, and/or the issuance of a new occupancy permit shall require a new conditional use permit. -3- 1 d. All parking and loading facilities shall be paved with 2 a hard durable surface material and shall be adequately drained, 3 and kept free of dust, mud, trash and weeds. Where parking or 4 maneuvering areas adjoin the public street a barrier wall or 5 landscaping shall be installed and maintained to meet City 6 standards. Adequate on -site parking shall be maintained so that 7 no on -street parking will occur. 8 e. The facility shall be operated in a manner that will 9 prevent unsanitary conditions, odors or other nuisances. The 10 property shall be provided with adequate refuse containers and 11 refuse disposal services. Collection service shall be performed 12 by a City of Vernon franchised solid waste hauler. 13 f. The facility's buildings shall be structurally 14 maintained to exclude rodents and the property shall be 15 maintained rodent free. 16 g, Servicing of vehicles, including but not limited to, 17 washing, steam cleaning and repairing, shall not be permitted on 18 the premises and shall only be performed at facilities in 19 compliance with appropriate codes. No inoperative vehicles shall 20 be stored on -site. All vehicles operated at the facility shall 21 be tuned and maintained in accordance with applicable emission 22 standards. 23 h. No equipment or freight shall be stored on the site 24 other than in buildings, trailers or on the docks (outside 25 storage is prohibited). 26 i. In accordance with National Pollutant Discharge 27 Elimination System permit regulations, Valley Fruit shall submit 28 a Notice of Intent to the State Water Resources Control Board, and a Storm Water Pollution Prevention Plan shall be prepared -4- 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 and implemented. j. Adequate plans and materials must be available for handling leaks or spills from vehicles during storage or transportation. Valley Fruit shall provide a mop sink in the warehouse and provide hot water to sinks. k. Any hazardous substances used, handled and/or stored shall have prior approval from the Vernon Fire and Health Departments. A Health Permit shall be obtained if there are reportable quantities of hazardous materials on the site. 1. Valley Fruit shall submit and maintain a Food Warehouse Permit from the City of Vernon Health Department. M. The facility shall be operated in a manner that will not impede traffic on Ross Street. All vehicles shall enter and exit the site in a front forward manner. No maneuvering shall', take place on the public street. n. All existing cracked sidewalk, driveways, curb and gutter adjacent to the site on Ross Street shall be repaired and maintained to meet City standards. o. The site shall not generate more than 40 truck trips) (20 inbound and 20 outbound) per day. p. This Conditional Use Permit (CUP) shall become void on January 1, 2029 in accordance with Section 26.4.6-3 of the Vernon Municipal Code or when Valley Fruit no longer is conducting business as a freight and truck terminal at the subject site, whichever occurs first. Upon the permit becoming void, Valley Fruit shall vacate the site. -5- 1 SECTION 4: Valley Fruit and any successors in interest 2 shall indemnify, hold harmless, and defend the City of Vernon, 3 its officers, agents, and employees from and against any and all 4 claims, complaints, or petitions for: (1) general and/or special 5 damages, losses, expenses resulting from bodily injury, 6 sickness, disease, disability or death arising from the 7 operation of the facility excluding therefrom any such claim 8 resulting from the sole negligence or intentional wrongdoing of 9 the City of Vernon, its officers, agents or employees; (2) a 10 peremptory writ or other relief by way of injunction, mandamus, 11 or administrative mandamus; or (3) legal expenses and attorney's 12 fees incurred by the City of Vernon on behalf of any party in 13 such actions or proceedings. (hereinafter referred to as "Valley Fruit") has submitted an application for a conditional use permit to operate an existing freight and truck terminal at 2043 Ross Street. This site was previously operated as a freight and truck terminal by United-S- Transfer. The applicant proposes to occupy a 10,000 square foot building that is situated on the property. The proposed site plan for the operation indicates the site is adequate in size, shape, topography including drainage and landscaping. -1- 3. ADVERSE EFFECT No potentially significant impacts are expected to result from traffic, parking, noise, odor, dust, smoke, light or glare, or risk of fire, infection or explosion from the project. The project is categorically exempt under Section 15301 of the California Environmental Quality Act because it is an existing facility with no expansion of use. A Notice of Exemption will be prepared and filed with the County Clerk. The proposed site is surrounded by industrial uses compatible with the proposed use. The proposed use is also the same as the past use of this site. 4. ACCESS The site has access to Ross Street, which is 60 feet wide. The street is of adequate size to handle the traffic generated from the proposed operation. 5. VEHICLE MOVEMENTS Valley Fruit will operate approximately eight (8) tractor -trailers, four (4) bobtails, and three (3) vans out of the facility. As proposed, the site has ample room for parking and loading facilities for these vehicles as required by the Vernon City Code. The bulk of vehicles will arrive primarily from Alameda Street to Ross Street. In addition to the trucks there will be approximately 18 automobile trips into and out of the facility daily. The majority of inbound and outbound trips will take Ross Street to Alameda Street traveling North to the 10 Freeway on outbound traffic and vice versa for inbound traffic. -2- 6. OPERATIONS Valley Fruit will use the facility to operate a freight and truck terminal. As previously mentioned, the proposed site was previously used as a freight and truck terminal by United-S-Transfer. All merchandise that is stored and transferred by Valley Fruit are manufactured finished goods. Other operational activities include sales and customer service of existing freight customers. 7. STATE OR FEDERAL CONDITIONS All Federal, State, and local regulatory permits shall be obtained as required for the operation. 8.
