RESOLUTION NO. 8500
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
VERNON APPROVING AND AUTHORIZING THE EXECUTION OF
AN ELECTION TO EXTEND THE TERM OF THE LEASE WITH
CHARLES D. PERRY, III REGARDING THE MALBURG
GENERATING STATION PROJECT
WHEREAS, on January 8, 2003, the City Council of the City of
Vernon adopted Resolution No. 8126 approving and ratifying the
execution of a Standard Industrial/Commercial Single -Tenant Lease --
Gross and A.I.R. Addendum (the "Lease") dated December 16, 2002, with
Charles D. Perry, III ("Perry") for the use of property located at
2650 Leonis Boulevard and a portion of 2670 Leonis Boulevard (the
"Property") during the construction of the Malburg Generating Station
Project (the "Malburg Project"); and
WHEREAS, the Lease commenced December 15, 2002 and will
lexpire on October 31, 2004; and
WHEREAS, in accordance with item 52 of the Lease, the City
of Vernon can exercise its option to extend the term of the lease on a
month -to -month basis for the increased monthly rental rate of
$15,525.00, if it provides written notice of said election by
August 1, 2004; and
WHEREAS, the City has determined that it continues to need
the use of the Property for general office facilities, parking,
warehousing, storage, light assembly and other construction -related
uses during the construction; and
WHEREAS, on July 27, 2004, the Finance Committee considered
the recommendation of Bruce V. Malkenhorst, Director of Finance, dated
July 22, 2004, that the term of the Lease be extended on a month-to-
1 month basis for the monthly rental rate of $15,525.00.
2 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
3 CITY OF VERNON AS FOLLOWS:
4 SECTION 1: The City Council of the City of Vernon hereby
5 finds and determines that the recitals contained hereinabove are true
6 and correct.
7 SECTION 2: The City Council of the City of Vernon hereby
8 elects to exercise its option to extend the term of the Lease on a
9 month -to -month basis for the increased monthly rental rate of
10 $15,525.00.
11 SECTION 3: The City Council of the City of Vernon hereby
12 authorizes and directs the City Administrator to notify Perry in
13 writing by August 1, 2004, of the City's election to extend the term
14 of the Lease on a month -to -month basis commencing November 1, 2004, at
15 the rental rate of $15,525.00 per month.
16 SECTION 4: The City Clerk of the City of Vernon shall
17 certify to the passage of this resolution, and thereupon and
18 thereafter the same shall be in full force and effect.
19 APPROVED AND ADOPTED this 28th day of July, 2004.

hereby certify that the foregoing Resolution, being Resolution No.
8500, was duly adopted by the City Council of the City of Vernon at an
adjourned regular meeting of the City Council duly held on Wednesday,
July 28, 2004, and thereafter was duly signed by the Mayor of the City
of Vernon.
