Resolution No. 85111 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 8511 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON ADOPTING A RENEWABLE PORTFOLIO STANDARD WHEREAS, Senate Bill 1078, which was signed into law on September 12, 2002, established a California Renewables Portfolio Standard Program; and WHEREAS, as a municipal electric utility, the City of Vernon electric utility is excluded from the Senate Bill, although the following requirements are mandatory: 1) Each municipal governing board is responsible for implementing and enforcing a local renewable portfolio standard that recognizes the Legislature's intent to encourage renewable resources, taking into consideration the effect on rates, reliability, financial resources, and the goal of environmental improvement; 2) Each municipal utility must report annually to its customers: A. Expenditure of public benefits funds collected for renewable energy resource development; B. The resource mix by fuel type including each type of renewable resource; and WHEREAS, the stated intent of the subject legislation is to "encourage renewable resources;" and WHEREAS, in order to implement the applicable requirements of SB 1078 and Section 387 of the Public Utilities Code of the State of California, the City Council desires to approve and adopt a City of 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 Vernon Renewable Portfolio Standard. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF VERNON AS FOLLOWS: SECTION 1: The City Council of the City of Vernon hereby finds and determines that the recitals contained hereinabove are true and correct. SECTION 2: The City Council of the City of Vernon hereby approves and adopts the City of Vernon Renewable Portfolio Standard, a copy of which is attached hereto as Exhibit A and incorporated by reference. SECTION 3: The City Clerk of the City of Vernon shall certify to the passage of this resolution, and thereupon and thereafter the same shall be in full force and effect. MALKENHORST, City Clerk - 3 - EXHIBIT 0 CITY OF VERNON RENEWABLE PORTFOLIO STANDARD BACKGROUND Senate Bill 1078 (SB1078) was signed by Governor Gray Davis on September 12, 2002 and became law January 1, 2003. For local publicly owned electric utilities such as the City of Vernon, the law requires the following: • The governing body of a local publicly owned utility is responsible for implementing and enforcing a Renewable Portfolio Standard (RPS) that recognizes the intent of the legislature to encourage renewable energy resources taking into consideration the effects on rates, reliability, financial resources and the goal of governmental improvement. • Each local publicly owned utility must report to its customers annually: (1) expenditure of public benefits funds collected for renewable energy resources including a description of each program and the expected or actual results and (2) the resource mix by fuel type including contribution of renewable energy resources to the mix. PURPOSE This RPS represents Vernon's commitment to renewable energy resources procurement consistent with the legislative intent of SB 1078. GOAL The City of Vernon's resource mix will consist of electricity from "eligible" renewable energy resources of 20o by 2017. TARGET Subject to the constraints described herein: 1) Renewable energy resources over the next five years will be 50 of the City's load. 2) Emphasis will be made to locate local renewable energy resources within the City limits, particularly on City -owned facilities. A-1 SYSTEM RATE IMPACT Purchase of renewable energy resources shall have no negative impact on retail electric rates. ANNUAL REPORT Annual report to customers on renewable energy resource expenditures and resources mix by fuel type shall be provided via the power content label distribution. PERIODIC REVIEW This RPS will be reviewed at least every five years to address potential changes. A-2
