A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
3 VERNON DECLARING ITS INTENTION TO VACATE A PORTION
4 OF PACKERS AVENUE

6 WHEREAS, a petition has been presented to the City of Vernon
7 by Masterfoods, Inc., a free holder of property in the City of Vernon
8 requesting that a portion of Packers Avenue excluding the easternmost
9 120 feet thereof, between Downey Road and Alcoa Avenue (originally
10 Magnolia Street), each in the City of Vernon, be vacated; and
11 WHEREAS, said street is shown on the map showing the Master
12 Plan of streets of the City of Vernon located in the office of the
13 Director of Community Services; and
14 WHEREAS, the City of Vernon has public utilities in Packers
15 Avenue for which a public utility easement will need to be reserved
16 and excepted; and
17 WHEREAS public safety and protection require the maintenance
18 of a fire lane for emergency vehicle access on Forty-fourth Street;
19 and
20 WHEREAS, an agreement has been proposed whereby the
21 petitioner will compensate the City of Vernon for the land and public
22 utility lines by lump sum payment.
23 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
24 CITY OF VERNON AS FOLLOWS:
25 SECTION 1: The City Council of the City of Vernon hereby
26 finds and determines that the recitals contained hereinabove are true
27 and correct.
28 SECTION 2: The City Council of the City of Vernon hereby

declares its intention to vacate said portions of Packers Avenue
pursuant to Chapter 1 of Part 3 of Division 9 of the Streets and
Highways Code of the State of California (commencing with Section 8300)
otherwise known as the Public Streets, Highways, and Service Easements
IVacation Law.
SECTION 3: The City Council of the City of Vernon hereby
(declares its intention to reserve and except all necessary public
utility easements and fire access lanes pursuant to Streets and
Highways Code Section 8340.
SECTION 4: The City Council of the City of Vernon hereby
declares its intention to enter into an agreement with petitioner for
payment as consideration for said vacation pursuant to Streets and
Highways Code Sections 8355 and 8356.
SECTION 5: The City Council of the City of Vernon hereby
declares its intention to consider any and all reasonable conditions
to protect the public interest pursuant to Streets and Highways Code
Section 8324.
SECTION 6: The City Council of the City of Vernon hereby
(sets a public hearing on the proposed vacation for Wednesday,
October 20, 2004, at 5:00 p.m., or at such time thereafter as the
matter may be heard, in the City Council Chambers located at 4305
Santa Fe Avenue, Vernon, CA 90058.
SECTION 7: The City Clerk, or his designee, is hereby
directed to publish a notice of the hearing containing the information
required regarding the proposed vacation for at least two successive
weeks prior to the hearing in the Metropolitan News, a newspaper of
general circulation closest to the City.

SECTION 8: The City Clerk, or his designee, is hereby
directed to post two weeks prior to the hearing conspicuous notices of
vacation in accordance with Streets and Highways Code Section 8323.
SECTION 9: The City Clerk, or his designee, is hereby
directed to post said notice, or cause the same to be posted, in three
of the most public places in the City of Vernon, to wit: the northwest
corner of 38th Street and Santa Fe Avenue, the northeast corner of
Leonis Boulevard and Pacific Boulevard, and on the bulletin board in
the lobby of the City Hall of the City of Vernon located at 4305 Santa
Fe Avenue in said City.
SECTION 10: The City Clerk of the City of Vernon shall
certify to the passage of this resolution, and thereupon and
thereafter the same shall be in full force and effect.

VACATION OF PACKERS AVENUE
AUGUST 19, 2004
Masterfoods USA, a Mars Incorporated company (hereinafter referred to as Masterfoods) has
requested that a portion of Packers Avenue, excluding the easternmost 120 feet thereof, between Alcoa
Avenue (originally Magnolia Street) and Downey Road be vacated. In accordance with Division 9 of the
Streets and Highway Code (commencing with Section 8300) otherwise known as the Public Streets,
Highways and Service Easements Vacation Law gives the authority to the City to vacate the street.
BACKGROUND
Packers Avenue was created in 1923 as part of the approval of Tract No. 6056 recorded in map
book 74 page 33, a copy of which is attached as Exhibit "A". Packers Avenue was dedicated as a 50-foot
right-of-way. In 1966 the Packers Island annexation was approved by the City Council by Resolution No.
2813 and Ordinance No. 778 and incorporated the area containing Packers Avenue into the City. A map
showing the Packers island annexation boundary is attached as Exhibit `B". At that time Packers Avenue
became part of the City's street system. In 1988 Kal Kan deeded several pieces of property to the City for
the widening of Packers Avenue. Instrument Number 88 1742345 is attached as Exhibit "C", dedicated a
5 foot strip along the south side of Packers from the Los Angeles Department of Water & Power
(LADWP) right-of-way to 200' feet west of said LADWP right-of-way. Instrument Number 88 1742347,
attached as Exhibit "D", dedicated a 5-foot strip along the north side of Packers Avenue bounded on the
west by the L.A.D.W.P. right-of-way and the east by the above mentioned alley. Instrument Number 88
1742570, attached as Exhibit "B", dedicated a 5 foot strip along the north side of Packers Avenue from
Alcoa Avenue to the west side of the LADWP right-of-way. Instrument Number 88 1742571, attached as
Exhibit "F", dedicated a 100 foot wide strip along the south side of Packers Avenue from Alcoa Avenue to
the east side of the LADWP right-of-way. In 1992 per Instrument Number 92 1468402, attached as
Exhibit "G", the City of Los Angeles granted the City of Vernon two easements for street and highway
purposes, the two five foot wide strips of land allowed for the widening of Packers Avenue through the
LADWP right-of-way. The current Packers Avenue right-of-way is shown in Exhibit "H".
In 1990 the City; under Contract No. 497, reconstructed Packers Avenue. As part of the project
Packers Avenue was aligned with 46t' Street. Photos of Packers Avenue are attached as Exhibit "I". The
realignment of Packers Avenue created an excess triangular shaped parcel on the south side of Packers
Avenue bounded on the east by the LADWP right-of-way and the Vernon Sanitation property on the south.
A plan of the triangular parcel is attached as Exhibit "J". The City had proposed to sell off this excess
property to an adjoining property owner. However, during an environmental review of the parcel it was
determined that the soil underlying the site was contaminated with tetrachloroethylene. Further
investigation determined that soil -underlying portions of Packers Avenue were also contaminated. The
contamination was traced back to Vernon Sanitation's operation. Currently both City and Vernon
Sanitation properties are being remediated by SCS Engineers through a vapor extraction methodology. It
is anticipated that the remediation will be complete in approximately one year.
Masterfoods over time has acquired the majority of the property adjoining Packers Avenue with he
exception of the excess street right-of-way on the south side of the street just East of Alcoa Avenue.
Masterfoods is currently in the process of purchasing this excess parcel from the City. At the conclusion of
this purchase of land Masterfoods will own all the property adjoining Packers Avenue between Alcoa
Avenue and Downey Road.
UTILITIES
Packers Avenue currently contains the following utilities within its right-of-way: City of Vernon
6" P.E. gas line; Southern California Gas Company 2" gas main; City of Vernon 12" VCP sewer pipeline;
City of Vernon 10" C.I water main; City of Vernon 8" abandoned sewer main; and Pacific Bell telephone
conduit. Additionally, both City of Vernon Light & Power' and Pacific Bell's overhead utility lines within
the right-of-way. Plans depicting the underground utilities are attached as Exhibit "K".
In accordance with Section 8340 of the Streets and Highways Code, the City intends to reserve an
easement for public utility purposes and a fire access easement, until such time as all utilities are
abandoned or relocated and a fire road provided. The water and gas lines in Packers Avenue are proposed
to be abandoned in the vacated portions of Packers Avenue. Additionally, Masterfoods will be required to
provide an effective alternative fire protection system prior to having the public fire hydrants currently
contained in Packers Avenue abandoned. The Light & Power Department has estimated the power lines
will cost $75,000 to abandon. Pacific Bell has estimated that it will cost $176,000 to relocate the
telephone lines. When all public utilities are relocated or abandoned or a separate easement provided by
Masterfoods the City reservation of easement may be terminated by a Quitclaim Deed.
TRAFFIC
Packers Avenue is shown on the City's Master Plan as a local street. Recent traffic counts show
that approximately 1045 vehicles utilize Packers Avenue in the westbound direction and 563 vehicles in
the eastbound direction on a daily basis. The A.M. peak hour in both in the directions occurred at 7:00
a.m. The westbound traffic count for the A.M. peak hour had 126 vehicles and 48 vehicles in the
eastbound direction. The P.M. peak hour occurred at 2:00 p.m. for both directions and had vehicles counts
of 78 in the westbound direction and 63 vehicles in the eastbound direction. In addition the City
performed hand counts to verify machine counts. It was found that the machine counts were accurate.
However, it was noted that approximately 54% of the vehicles traveling on Packers Avenue in the A.M.
peak were parking in the Masterfoods parking lots. Leonis Blvd. parallels Packers Avenue to the south
and Vernon Avenue parallels Packers Avenue to the north. Although Packers Avenue aligns with 46ffi
Street on the west and Exchange Avenue on the east, there is not a large volume of thru traffic due to the
fact that neither Packers Avenue and Alcoa Avenue nor Packers Avenue and Downey Road are signalized.
Downey Road is a north south collector and given its traffic volumes it is difficult to cross with stop only
controls in the east west direction. If Packers Avenue is vacated, Leonis Boulevard and Vernon Avenue
have sufficient capacity to handle the rerouted traffic from Packers Avenue. All intersections in the
vicinity of Packers Avenue currently operate at an acceptable level of service.
PARKING
Due to a lack of onsite parking, businesses along Downey Road between 45 h and Packers Avenue
utilize Packers Avenue for overflow parking. Masterfoods proposed several parking alternatives to offset
the parking lost on Packers Avenue. However, no agreement could be reached. The alley just west of
Downey Road between 456' Street and Packers Avenue will continue to provide vehicular access to the
existing parking and loading facilities for these businesses. Additionally, employees from Fortune
Fashions located at 4700 Boyle Avenue park on the west end of Packers Avenue. The City's zoning
ordinance requires all properties to provide sufficient parking on its' own site to meet the occupants'
needs. Additionally, the City of Vernon's police powers gives it authority to determine if parking should
be allowed on public streets.
DISPOSITION OF THE VACATED STREET
If Packers Avenue is vacated the street property will be owned by the City of Vernon. In
accordance with Section 8355 of the Streets and Highway Codes, the legislative body may sell or exchange
the property, upon terms and conditions approved by the City Council. In this case the City is proposing to
enter into an agreement with Masterfoods to sell the street right-of-way. Masterfoods will be responsible
for abandoning the sewer lines, relocating the telephone lines and providing sufficient fire access and
protection if it intends to develop the property within the vacated street right-of-way. In the interim the
City will reserve an easement for public utility and fire access purposes.
RECOMMENDATION
Given the facts above it is recommended that a portion of Packers Avenue from Alcoa Avenue to
the alley just west of Downey Road be vacated.
