RESOLUTION NO. 8568
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
VERNON APPROVING AND ADOPTING A DISASTER OVERTIME
PAY POLICY FOR EXEMPT EMPLOYEES
WHEREAS, in the event that a disaster or a state of emergency
is declared in accordance with Chapter 8 of the Vernon City Code, City
officers or employees are entitled to all privileges, benefits and
immunities as are provided by state law for registered disaster service
1workers; and
WHEREAS, the Federal Emergency Management Agency ("FEMA")
requires that a city have a policy in existence regarding disaster
overtime pay for employees prior to a declared disaster or emergency in
order to obtain reimbursement of costs incurred in connection such
declared disaster or emergency; and
WHEREAS, the Personnel Committee on October 19, 2004,
considered the recommendation of Bruce V. Malkenhorst, Director of
Personnel, dated October 13, 2004, that the City adopt a disaster
overtime pay policy for exempt employees to be compensated for overtime,
hours that they work as official emergency workers when a disaster or
state of emergency is declared by the City, the County of Los Angeles,
the State or California or the Federal Government.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF VERNON AS FOLLOWS:
SECTION 1: The City Council of the City of Vernon hereby
finds and determines that the recitals contained hereinabove are true
and correct.

SECTION 2: The City Council of the City of Vernon hereby
approves and adopts a disaster overtime pay policy for exempt employees
as follows: "Emergency Overtime" shall be paid only for those hours
actually worked in excess of forty (40) hours during the exempt
employee's normal work week at time and a half. During the exempt
employee's normal forty (40) hour work week, the employee shall be paid
at an hourly rate equal to the exempt employee's current monthly base
salary divided by 173.33 (straight time rate).
SECTION 3: The City Council of the City of Vernon hereby
repeals and rescinds any previously promulgated policies for a declared
disaster pay overtime policy for exempt employees.
SECTION 4: The City Clerk of the City of Vernon shall
certify to the passage of this resolution, and thereupon and thereafter
the same shall be in full force and effect.
APPROVED AND ADOPTED this 20th day of October, 2004.
