Resolution No. 86291 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 8629 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON APPROVING AND AUTHORIZING NOTICE INVITING SEALED PROPOSALS OR BIDS FOR THE PURCHASE OF ONE 2005 FORD ESCAPE HYBRID FOR THE HEALTH DEPARTMENT WHEREAS, the City currently leases three 1999 EV Ford Ranger pickup trucks from the Ford Motor Credit Company for use by its Light & Power Department and Environmental.Health Department pending a determination on the nature of the City's future use of fuel -efficient vehicles; and WHEREAS, the Environmental Health Department has determined that its 1999 EV Ford Ranger pickup truck should be replaced because there are no state incentive programs available for electric vehicles and, after the initial warranty period, Ford does not provide routine maintenance or warranty service and the garage is unable to perform the specialized repair and service needed on older electric vehicles; and WHEREAS, the Environmental Health Department has determined that a Ford Escape Hybrid vehicle running on a gasoline engine, electric battery power or both together meeting the Super Ultra Low Emission Vehicle and Partial Zero Emission Vehicle emission standards is the best replacement vehicle to meet its needs; and WHEREAS, on December 14, 2004, the Finance Committee considered the recommendation of Bruce V. Malkenhorst, Director of Finance, dated December 9, 2004, that authority be granted for the Purchasing Agent, or his designee, to seek formal bids for the purchase of a 2005 Ford Escape Hybrid; and WHEREAS, a bid specification for the purchase of the 2005 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 Ford Escape Hybrid has been presented to the City Council of the City of Vernon; and WHEREAS, the City Council of the City of Vernon has determined that it is in the best interests of the City of Vernon that bids be solicited in accordance with the Vernon City Code. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF VERNON AS FOLLOWS: SECTION 1: The City Council of the City of Vernon hereby finds and determines that the recitals contained hereinabove are true land correct. SECTION 2: The bid specification, which is attached hereto as Exhibit A and incorporated by reference, is hereby approved by the City Council of the City of Vernon. SECTION 3: The City Clerk of the City of Vernon is hereby directed to give notice, in writing, inviting sealed proposals or bids for the purchase of one 2005 Ford Escape Hybrid vehicle, in accordance with the bid specification, and in accordance with this resolution. SECTION 4: There being no newspaper of general circulation printed, published or circulated in the City of Vernon, the City Clerk is hereby directed to post said notice, or cause the same to be posted, in three of the most public places in the City of Vernon, to wit: the northwest corner of 38th Street and Santa Fe Avenue, the northeast corner of Leonis Boulevard and Pacific Boulevard, and on the bulletin board in the lobby of the City Hall of the City of Vernon, located at 4305 Santa Fe Avenue, in said City. SECTION 5: The City Clerk of the City of Vernon is hereby directed to post said notice forthwith and the first posting of said notice shall be at least ten (10) days before the opening of the bids - 2 - 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 for the proposed contract. Said notice shall provide that sealed proposals or bids will be received by the City of Vernon at the office of the City Clerk, or his designee, at the City Hall, 4305 Santa Fe Avenue, Vernon, CA 90058-0805. SECTION 6: The City Clerk of the City of Vernon shall certify to the passage of this resolution, and thereupon and thereafter the same shall be in full force and effect. POZZEBON Director of Environmental Health FAX: (323) 588-4320 It is the intent of this specification to provide for the purchase of one (1) new and unused 2005 Ford Escape Hybrid (FWD) with a 2.3L I4 Atkinson Cycle Engine and ECVT Transmission. The City of Vernon has evaluated different types of vehicles and has determined that this product is best suited for the department's needs in safety, economy, quality, performance, and standardization. In comparing proposals, consideration will not be confined to price only. The successful bidder will be one whose product is judged best to serve the interests of the City of Vernon when price, product, safety, quality and delivery are considered. The City of Vernon reserves the right to reject any or all bids or any part thereof, and to waive any minor technicalities. A contract will be awarded to the bidder submitting the lowest qualified and responsible bid meeting the requirements of this specification. EQUIVILENT PRODUCT Bids will be accepted for consideration on any make or model that is equal or superior to the vehicle specified. Decisions of equivalency will be at the sole interpretation of the City. A blanket statement that equipment proposed will meet all requirements will not be sufficient to establish equivalency. Original manufacturer's brochures of the proposed unit are to be submitted with the proposal. All modifications made to the standard production unit described in the manufacturer's brochures must be certified by the manufacturer and submitted with the bid, or the bid will be deemed "non -responsive" and rejected without further review. Bidder must be prepared to demonstrate a unit similar to the one proposed, if requested. INTERPRETATIONS In order to be fair to all bidders, no oral interpretations will be given to any bidder as to the meaning of the specification documents or any part thereof. Every request for such a consideration shall be made in writing to the City of Vernon. Based on such inquiry, the City may choose to issue an Addendum. GENERAL The specification herein states the minimum requirements of the City. All bids must be regular in every respect. Unauthorized conditions, limitations, or provisions shall be cause for rejection. The City of Vernon will consider as "irregular" or "non -responsive" any bid not prepared and submitted in accordance with the document and specification, or any bid lacking sufficient technical literature to enable the'Department to make a reasonable determination of compliance to the specification. It shall be the bidder's responsibility to carefully examine each item of the specification. Failure to offer a completed bid or failure to respond to each section of the technical specification will cause the proposal to be rejected without review as "non -responsive". -All variances, exceptions and/or deviations shall be fully described in the appropriate section.
