A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
VERNON PROVIDING FOR THE IMPLEMENTATION OF THE
CITIZENS OPTION FOR PUBLIC SAFETY (COPS) PROGRAM

6 WHEREAS, Assembly bill 1913 (AB 1913) (Cardenas) was
7 chaptered into law on September 7, 2000 for supplemental local law
8 enforcement funding pursuant to the bill; and
9 WHEREAS, AS 1913 provides $100,000,000 statewide for the
10 Citizens for Public Safety (COPS) Program; and
11 WHEREAS, the County of Los Angeles has established a
12 Supplemental Law Enforcement Service Fund (SLESF) in accordance with
13 Section 30061 of the Government Code to receive AB 1913 funds which
14 have been allocated for use in Los Angeles County; and
15 WHEREAS, the City has established its own Supplemental Law
16 Enforcement Service Fund (SLESF) in accordance with Section 30061 of
17 the Government Code; and
18 WHEREAS; Assembly Bill 823 (AB 823) (Poochigian) was
19 chaptered into law on April 8, 2002 amending Sections 30061 and 30063
20 of the Government Code relating to law enforcement funding; and
21 WHEREAS, AB 823 provides that funds received be expended no
22 later than June 30 of the following fiscal year; and
23 WHEREAS, the City of Vernon has participated in the COPS
24 Program since 2001 and receives its share of any funds available for
25 the purpose of ensuring public safety through the procurement of
26 equipment to deter juvenile crime and improving frontline municipal
27 police services and enhancing the effectiveness of its officers; and
28 WHEREAS, by letter dated January 11, 2005, Bruce V.
1 Malkenhorst, City Administrator/City Clerk, recommended that the
2 Police Department be authorized to proceed with the purchase of three
3 Chevrolet Tahoe vehicles and three mobile computers for each of the
4 vehicles, to ensure the availability of field units on a routine basis
5 by using COPS grant funds; and
6 WHEREAS, the City Council has conducted a public hearing to
7 consider funding requests from the Chief of Police to use COPS grant
8 funds by June 30, 2006 for frontline law enforcement needs, including
9 but not limited to personnel, equipment and programs and shall
10 determine each submitted request as required by AB 823 in order to
11 enhance the effectiveness of its officers.
12 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
13 CITY OF VERNON AS FOLLOWS:
14 'SECTION 1: The City Council of the City of Vernon hereby
15 finds and determines that the recitals contained hereinabove are true
16 and correct.
17 SECTION 2: The City Council of the City of Vernon hereby
18 directs that the City maintain its own Supplemental Law Enforcement
19 Service Fund (SLESF) as required by AB 823 and State law pursuant to
20 Government Code Sections 30061 and 30063.
21 SECTION 3: The City Council of the City of Vernon finds
22 that all persons have had the opportunity to be heard or to file
23 written comments to the expenditure of COPS grant funds provided by AB
24 823, and after due consideration of any and all evidence submitted at
25 the public hearing determines that there are compelling reasons to
26 justify the expenditure of COPS grant funds for the equipment
27 requested by the Chief of Police.

SECTION 4:
The City Council of the City of Vernon hereby
2 requests that the City's share of the funding be allocated to SLESF
3 for purposes of front line law enforcement needs.

SECTION 6:
The City Clerk of the City of Vernon shall

In October 2004, the City received $100,000.00 of the State's Citizen
Options for Public Safety (COPS) Fund to be allocated for frontline
law enforcement services including but not limited to personnel,
equipment, and programs. Said funds must be encumbered within the
first year and the funds utilized before June 30, 2008. The Police
Department is requesting authorization to utilize COPS funds in
support of the purchase of three Chevrolet Tahoes and three mobile
computers, one for each vehicle, to ensure the availability of field
units on a routine basis.
This has been reviewed by the City Attorney and it is hereby
recommended that the Police Department be authorized to utilize COPS
funds for the support of the purchase of three vehicles and three
mobile computers.

SUBJECT: Citizen Option for Public Safety (COPS) Grant Public Hearing
Sir: I am requesting that a public hearing be placed on the City Council agenda to
discuss the proposed use of the $100,000 COPS grant which was received in October 2004.
I am recommending that the $100,000 COPS grant be applied to the purchase of three Chevrolet
Tahoes to increase the department's patrol fleet. The three Tahoes will be in addition to our
budgeted number of police vehicles, This increase in our patrol fleet will help ensure that we
field units on a routine basis.
In addition to the Grant funding, it will be necessary to use funds available but not
specifically budgeted for the additional Tahoes' emergency equipment and radios.
