Resolution No. 86508 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION 8650 A RESOLUTION OF OF THE CITY OF CONDITIONAL USE PACIFIC COMPANY OF AN ACCESSORY BOYLE AVENUE THE CITY COUNCIL VERNON GRANTING A PERMIT TO REHRIG FOR THE OPERATION WAREHOUSE AT 6250 WHEREAS, Rehrig Pacific Company ( "Rehrig ") has applied for a conditional use permit to operate an accessory warehouse at 6250 Boyle Avenue in the City of Vernon; and WHEREAS, Rehrig currently has manufacturing, packaging, warehousing, and office space at 4010 26th Street. WHEREAS, the City Council of the City of Vernon held hearing on said application for a conditional use permit February 2, 2005; and WHEREAS, the proposed site is a permitted use in the General Industry (M) Zone with approval of a conditional permit; and WHEREAS, City staff has determined that the project is categorically exempt from the California Environmental Quality Act pursuant to Section 15301, existing facilities; and WHEREAS, the proposed use, as to location, operation and use design is consistent with the General Plan and Zoning Ordinance of the City of Vernon; and WHEREAS, a conditional use permit is required under the Zoning Ordinance Section 26.3.5 -3(j) in order to operate an accessory warehouse greater than 50,000 square feet in the M- Zone; and -1- 1 WHEREAS, the proposed operation will be an integral part of 2 the manufacturing operation and will include the storage of 3 goods produced in the Rehrig's manufacturing operation in the 4 City of Vernon; and 5 WHEREAS, Rehrig proposes to occupy approximately 98,000 6 square feet of the building on the site, and the site is adequate in size, shape and topography for the proposed 8 operation and has adequate drainage; and WHEREAS, the proposed site is surrounded by industrial, 10 warehouse, commercial, residential, and a school and other uses 11 which are compatible with the proposed use and no adverse 12 effects from traffic, parking, noise, odors, dust, smoke, light 13 or glare, or risk of fire, infection or explosion is anticipated 14 from the proposed operation; and 15 WHEREAS, the site has access to Boyle Avenue, which is. 16 adequate in width and pavement type to carry the quantity of 17 traffic generated by the proposed use; and 18 WHEREAS, the site has a nonconforming building on it which 19 presently does not comply with the current parking and loading 20 requirements, however, the site is not required to come into 21 conformity at this time, because no expansion or structural 22 alteration of a building or buildings is occurring; and 23 WHEREAS, the proposed use, as to location, operation and 24 design is consistent with the General Plan and Zoning Ordinance 25 of the City of Vernon and all applicable County, State, and 26 Federal law, rules and regulations; and 27 / / 28 / / / 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 WHEREAS, the conditions imposed on the conditional use permit will adequately protect the public health, safety and general welfare and the operation is consistent with all applicable rules and laws of the City of Vernon; and WHEREAS, the City Council has received a Staff Report, dated January 24, 2005 upon which it has foregoing recitals; and NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF VERNON AS FOLLOWS: SECTION 1: The City Council of the City of Vernon hereby finds and determines that the recitals contained hereinabove are true and correct. SECTION 2: Subject to the conditions set forth below, the conditional use permit is hereby granted to Rehrig for the operation of an accessory warehouse at 6250 Boyle Avenue. SECTION 3: In order to adequately protect the public health and general welfare the following conditions are required: a. The facility shall be operated in accordance with, and made to conform with all current codes, rules, and regulations, and subject to permit fees as adopted by the City of Vernon not otherwise addressed by this grant of a conditional use permit. b. All required federal, state, local and regulatory agency permits shall be obtained prior to operation. Prior to occupancy a business license and occupancy permit shall be obtained. c. All parking and loading facilities shall be paved with a hard durable surface material and shall be adequately drained, and kept free of dust, mud, trash and weeds. Where parking or maneuvering areas adjoin the public street a barrier wall or relied on making the landscaping shall be installed and maintained to meet City standards. Adequate on -site parking shall be maintained so that no on street parking or staging will occur. d. The facility shall be operated in a manner that will prevent unsanitary conditions, odors or other nuisances. The property shall be provided with adequate refuse containers and refuse disposal services. e. Rehrig shall structurally maintain 6250 Boyle to exclude rodents and the property shall be maintained rodent free. f. Servicing of vehicles, including but not limited to, washing, steam cleaning and repairing, shall not be permitted on the premises and shall only be performed at facilities in compliance with appropriate codes. No inoperative vehicles shall be stored on -site. All vehicles operated at the facility shall be tuned and maintained in accordance with applicable emission standards. g. No equipment or freight shall be stored or assembled on the site other than in buildings or trailers (outside storage is prohibited). h. Adequate plans and materials must be available for handling leaks or spills from vehicles during storage, loading or transportation. i. If required a hazardous materials permit shall be obtained from the City of Vernon Environmental Health Department for all hazardous materials /waste used, handled, or stored at the site. The facility shall be operated in a manner that will not impede traffic on Boyle Avenue. k. All required frontage improvements shall be constructed and all existing cracked sidewalk, curb and gutter adjacent to the site on Boyle Avenue shall be repaired and maintained to meet City Standards. 1. Any extension, expansion, change in use, change in ownership interest, and /or the issuance of a new occupancy permit shall require a new conditional use permit. m. Upon any expansion or structural alteration of the building, or the advent of August 19, 2009, whichever occurs first, the entire site shall be made to conform to all truck and automobile parking requirements and all truck loading requirements, pursuant to section 26.4.6 -4(b) of the Comprehensive Zoning Ordinance, unless a conditional use permit is granted by the Vernon City Council. SECTION 4: Rehrig and any successors in interest shall indemnify, hold harmless, and defend the City of Vernon, its officers, agents, and employees from and against any and all claims, complaints, or petitions for: (1) damages, losses, expenses resulting from bodily injury, sickness, disease, disability or death arising from the operation of the facility excluding therefrom any such claim resulting from the sole negligence or intentional wrongdoing of the City of Vernon, its officers, agents or employees; (2) a peremptory writ or other relief by way of injunction, mandamus, or administrative mandamus; or (3) legal expenses and attorney's fees incurred by the City of Vernon on behalf of any party in such actions or 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 proceedings. The City of Vernon does not waive its right to participate in the defense of any such action. SECTION 5: Not later than sixty (60) days from the date of this Resolution, Rehrig shall indicate, in writing, its acceptance of and agreement with the conditions contained in Section 3 of this Resolution and the indemnification provision contained in Section 4 of the Resolution. SECTION 6: The City Clerk of the City of Vernon shall certify to the passage of this resolution and thereupon and thereafter the same shall be in full force and effect. They are proposing to operate an accessory warehouse in excess of more than 50,000 square feet in the building located at 6250 Boyle Avenue in the City of Vernon. After review of the application by the Community Services Department, it is recommended that the conditional use permit be granted. Herewith for your consideration are the following supporting documents: 1. Staff Report. 2. Request for conditional use permit and information supporting the application. 3. Notice of Public Hearing, copies of notification letters to owners and tenants in the area and affidavits of posting and mailing. The project is categorically exempt from CEQA because it is an existing facility as described in Section 15301. Notice of Exemption will be prepared. In my opinion the proposed operation will pose no adverse effects to the City of Vernon and will have no significant effects on the environment. The project is consistent with the General Plan as Adopted by the City of Vernon. Rehrig is proposing to expand its operation by acquiring an additional building located at 6250 Boyle Avenue. The proposed site is approximately 98,000 square feet and will be used as an accessory warehouse for their existing manufacturing facility. The accessory warehouse will operate as an integral part of Rehrig's manufacturing process and store goods produced in the City. In order to comply with the Comprehensive Zoning Ordinance and operate an accessory warehouse greater than 50,000 square feet in the M -Zone, a conditional use permit is required. As defined in Section 26.3.5.3(j), an accessory warehouse is an integral part of a manufacturing operation located in the City of Vernon and storing goods produced in that operation. 1. GENERAL PLAN The proposed use conforms to the Zoning Ordinance and the General Plan with the granting of a conditional use permit. The site of the proposed use is located in the M- zone, General Industrial. An accessory warehouse in excess of 50,000 square feet is permitted in the M -Zone with a conditional use permit. -1- 2. SITE The subject property is located at 6250 Boyle Avenue. The property contains one building totaling 149,067 square feet in size. The total size of the parcel is 401,267 square feet. Rehrig proposes to occupy 98,000 square feet of the existing building, which is currently vacant. The existing facility is adequate in size, shape, topography and drainage for the operation. 3. ADVERSE EFFECT The proposed use is surrounded by industrial, warehouse, commercial, residential, and a school and other uses which are compatible with the proposed use. No adverse impacts from traffic, parking, noise, odor, dust, smoke, light or glare, or risk of fire, infection or explosion are expected to occur to the adjacent or abutting properties. Pursuant to Section 15301 of the California Environmental Quality Act, this project is exempt from CEQA, because it is an existing facility. 4. ACCESS The project site, as proposed, will have access to two driveways along on Boyle Avenue. Boyle Avenue, which is 80 feet in width and is adequate in size and pavement type to handle the traffic generated by the operation. The site contains a preexisting building that has not been vacant for a continuous period of more than one year and Rehrig is not proposing to undertake any structural alterations. Therefore, the owner is not required to bring the building into complete compliance with the automobile, truck parking, truck loading, and maneuvering requirements of the current City of Vernon Comprehensive Zoning -2- Ordinance at this time. 5. VEHICLE MOVEMENTS The proposed site is located at the corner of Boyle Avenue and Randolph Street. There are two entrances into to the property site, all of which are located on Boyle Avenue. Rehrig estimates that approximately 1 to 3 trucks per day will deliver and pick -up product. Only three employees from the existing warehouse and office building at 4010 26th Street will be relocated to the 6250 Boyle Avenue building. Therefore, due to the low volume of vehicular traffic the City anticipates no impact on transportation system from Rehrig's operation. The trucks routed to the subject site will travel south on Indiana Street to Bandini Boulevard (West) to Downey Road (South) to Slauson Avenue (West) to Boyle Avenue (South). 6. OPERATIONS Rehrig is an existing manufacturing facility in the City of Vernon that is proposing to expand its operation by acquiring additional warehousing space at 6250 Boyle Avenue. Rehrig, manufacturers different types of plastic products and will use the subject site as an accessory warehouse for the storage of its manufactured products. The facilities operating hours will remain 7:30 a.m. to 5:00 p.m. Monday through Friday. 7. STATE OR FEDERAL CONDITIONS All Federal, State, and local regulatory permits shall be obtained as required for the operation. 8. Boyle Ave Vernon, CA 90058 The site for the proposed use is adequate in size, shape and topography, including drainage and landscaping The existing site to maintain the existing warehouse is a relatively large, flat, and trapezoidal site that contains 8.8 acres. The site currently contains a 149,067 square foot industrial building. Rehrigh Pacific Company currently occupies 98,000 square feet of this building for warehousing of finished plastic goods. There is also an 8,080 (4,040 square feet/floor) square foot office. The site is adequately landscaped for the use for which it is intended. This site is therefore, adequate in size, shape and topography to maintain the existing warehouse. B) The proposed use will not have an adverse effect upon adjacent or abutting properties in terms of traffic, parking noise, odors, dust, smoke, light or glare, or risk of fire, infection, or explosion. Rehrig Pacific company has leased this facility for warehousing only. There is no manufacturing on site. The proposed use, therefore, will not have an adverse effect upon adjacent or abutting properties in terms of traffic, parking noise, odors, dust, smoke, light or glare, or risk of fire, infection, or explosion. C) The proposed use will be compatible with the permitted uses of surrounding and adjacent properties. The surrounding uses of the subject site include warehousing and manufacturing to the north and east and residential uses to the south and west in the City of Huntington Park. The residences to the south are separated by a railroad track on Randolph Ave. The proposed use, therefore, will be compatible with the permitted uses of surrounding and adjacent properties. D) The site has sufficient access to streets and highways, which are adequate in width and pavement type to carry the quantity of traffic generated by the proposed use, and that the routes which vehicles will have to follow to reach the site are adequate in width and pavement type to carry the volume of traffic generated by the proposed use. The site is located on the northeast corner of Boyle Ave and Randolph Ave, both of which streets can be used as truck routes. There are two ingress /egress on Boyle Ave. Boyle Ave is a major north -south arterial in the City of Vernon and Randolph Ave serves as city boundary between the City of Vernon and the City of Huntington Park. The exiting warehouse generates approximately three trips per day, served from our manufacturing facility and administrative office currently located at 4010 E. 26th St in Vernon. The site, therefore, has sufficient access to streets and highways, which are adequate in width and pavement type to carry the quantity of traffic generated by the proposed use. E) The site has adequate off - street parking and loading facilities. The site contains 216 parking spaces, 10 truck parking spaces and 16 truck loading spaces. We currently have only three employees at this location as is used only as our warehouse. The existing parking spaces on the site can adequately serve us and the other existing tenant. The site, therefore, has adequate off- street parking and loading facilities. F) The use, assto location, operation and design, is consistent with the general plan, any applicable specific plan and zoning regulations of the City of Vernon and all applicable County, State and federal law, rules and regulations.
